Mason Ladd's life in the law of evidence will never be stilled. The contributions are too thoughtful, too productive, too filled with impact for that ever to happen. In the galaxy of great figures that includes Wigmore, Clearly, Morgan, Maguire, Weinstein, McCormick, Louisell, and others, Dean Ladd's star shone brightly. The mix of insight, humor, and good will that he brought to teaching and scholarly writing is unmatched. The influence of Mason Ladd is perhaps best summarized by this tribute: You can lose a man like Dean Ladd by your own death, but not by his.

In order to understand the perceptions of extradition’s function and purpose in modern France and the United States, it is important to consider the evolution of thought regarding extradition. This article will focus on the history of extradition law as it has influenced contemporary law in the United States and France. The purpose of the article is to provide insight into the development of the “modern” extradition. Although the process has not always been executed by use of a treaty agreement, treaty authorized extraditions have existed since antiquity. The current laws regarding experimentation upon animals should be drastically revised. These laws permit virtually unrestricted experimentation on animals without regard to the benefits to be obtained from such experimentation, and without regard to the consequences of such experimentation upon the subject animal. Legislation constituting a two-step jump from the current laws is needed: laws sanctioning and requiring animal experimentation should be repealed; and laws significantly restricting acceptable experimentation should be enacted. The principle underlying this proposal for change is straightforward: Nonhuman animals, like human animals, have interests in the integrity of their bodies which deserve legal protection. Only by …

Vietnamese refugees face a series of hurdles in entering the United States. Questions of fear of persecution, time of persecution and illegal departure face the refugees generally. Those leaving Vietnam for economic reasons and those displaced within Vietnam face additional difficulties. However, careful application of United States immigration law should accommodate the Vietnamese refugees as well as the policies behind the laws.

Liability And Damages In Libel And Slander Law, Melinda J. Branscomb

This article discusses the traditional law of defamation, with particular emphasis on standards of liability and proof of compensatory damages, and points out inconsistencies in these rules and problems with their application. It analyzes two major Supreme Court decisions that concern libel of public figures and officials and libel of private-citizen plaintiffs. This article then discusses three recent Tennessee cases and their impact upon the state's defamation law. It finds that a less complex, more uniform law of defamation is needed in light of the intricacies of traditional defamation law and its recent changes at the Supreme Court and state …

Since the late 1930s, lawyers have argued that their services are not used to the fullest advantage by a large segment of the population. More recently, other concerned groups such as trade unions and consumer organizations also have become convinced that there is an underutilization of lawyers' services, and that it is important to increase access to such services. As a result, attempts have been made to develop alternatives to the traditional methods of providing legal services that to date have proved inadequate in meeting the legal needs of the public. Extradition Between France And The United States: An Exercise In Comparative And International Law, Christopher L. Blakesley

In 1878 Cardaillac defined extradition as “the right for a State on the territory of which an accused or convicted person has take refuge, to deliver him up to another State wich has requisitioned his return and is competent to judge and punish him.” The term “extradition” was imported to the United States from France, where the decret-loi of Febraury 19, 1791, appears to be the first official document to have used the term. The term is not found in treaties or conventions until 1828. The Latin equivalent to extradition, “tradere”, is not found in early Latin works, but the …

What Counts Is How The Game Is Scored: One Way To Increase Achievement In Learning Mathematics, Layman E. Allen, Gloria Jackson, Joan Ross, Stuart White

Pior investigation indicates that instructional gaming can be an effective tool for enhancing both motivation and achievement in the learning of mathematics. This study explores the extent to which the effectiveness of instructional gaming in facilitating the learning of specific mathematical ideas can be increased by incorporating devices that channel learners’ attention upon those ideas. In particular, the effect of channeling attention by changing the method of scoring is explored.

Anglo-American parole owes its theoretical development and its early systematization, indeed its very existence, to France. It has been said that France has the genius of invention, but that too often the great ideas born in France are neglected there to find their baptism of success in other countries. This remark characterizes the history of the parole concept in France. Yet, the latest innovations being developed in France portend new possibilities for success in the rehabilitation of convicts. The Juvenile Justice Standards Project volumes were publicly discussed for months prior to their publication. Unavoidably, much of the discussion was based upon rumor regarding their contents. In that context, critics charged that the proposed Standards would "destroy the nation's juvenile court system and replace it with a 'junior criminal system' "1 and claimed that the Standards substitute the philosophy of "just deserts" for the traditional rehabilitative goals of juvenile justice.'
