Mothering As A Life Course Transition: Do Women Go Straight For Their Children?, Venezia Michalsen
Department of Justice Studies Faculty Scholarship and Creative Works
In this study, qualitative, in-depth interviews were conducted with 100 formerly incarcerated mothers to explore the relationship between attachment to children and desistance from criminal behavior. Exploratory data analysis revealed that mothers do believe that children play important roles in their desistance, consistent with the tenets of life course theory. However, children were also described as sources of great stress, which may in turn promote criminal behavior. Women also related desistance to reliance on self and a higher power, and to a desire to avoid future involvement with the criminal justice system. The article concludes with a call for more …

1st Step: Integrated Trial Advocacy And Evidence Class At Golden Gate University School Of Law, Wes R. Porter

We all conceive ways to best train future litigators and trial advocates during their time in law school. Two summers ago, I listened intently to some of those ideas at Stetson's Educating Advocates Conference. If we program directors and skills professors ran the law school, we would want to: 1) teach every student the rules of evidence our way; 2) show our students how the rules play out in litigation and at trial while they are learning evidence; 3) afford more of our students the attention, critique, and training that we devote to mock trial competitors; and, 4) maximize our …

How does one embrace the riches of the knowledge presented in this Conference? This Conference’s participants have presented the fiduciary relationship from so many points of view: interdisciplinary perspectives, current issues, and particular fascinating narrower topics. Does this event suggest that critics are correct, and that fiduciary law as a category is incoherent?1 Arguably, fiduciary relationships and the rules that govern them are too varied. Yet I maintain that the variety presented in this Conference leads to the opposite conclusion, and that the papers in this Conference provide support for my claim: that fiduciary law should be viewed and understood …

Review Of Compact, Contract, Covenant: Aboriginal Treaty Making In Canada. By J.R. Miller., Sidney L. Harring

In Canada, the term First Nations explicitly recognizes a nation-to-nation relationship between the Crown and the original inhabitants of North America that requires treaty making as the primary political and legal process for the taking of Indian lands and the incorporation of Indian nations into the multinational Canadian state. There are great political difficulties embodied in this process, including the continued impoverishment and marginalization of the First Nations, and the repeated failure of successive Canadian governments to carry out their responsibilities under these treaties, but the treaty process remains the required process.
