Private Police Regulation And The Exclusionary Remedy: How Washington Can Eliminate The Public/Private Distinction, Jared Rothenberg

Private security forces such as campus police, security guards, loss prevention officers, and the like are not state actors covered by the Fourth Amendment’s prohibition against unreasonable searches and seizures nor the Fifth Amendment’s Miranda protections. As members of the umbrella category of “private police,” these private law enforcement agents often obtain evidence, detain individuals, and elicit confessions in a manner that government actors cannot, which can then be lawfully turned over to the government. Though the same statutory law governing private citizens (assault, false imprisonment, trespass, etc.) also regulates private police conduct, private police conduct is not bound by …

Women have encountered many obstacles in their quest to gain leadership in law enforcement. While research has studied how well women officers strive to achieve higher-level positions within police departments, the challenges women face when they gain top leadership roles remain largely unexplored. This research paper will discuss the unique challenges faced by women police chiefs, drawing from first-hand experiences of women police chiefs and existing literature. The study finds that women police chiefs encounter challenges in communication, transferring to a new department, overtasking, introvertedness, and general police chief stress. Lower courts and litigants depend a great deal on the Supreme Court to articulate and communicate signals regarding how to interpret existing doctrine. Signals are at their strongest and most reliable when they originate from the Court’s merits docket. More recently, the Court has been increasingly relying on its orders docket—colloquially referred to as its “shadow docket”—to communicate with lower courts by summarily reversing and correcting errors in interpretation without briefing or oral argument.

In California, many law enforcement agencies have partnered with local mental health services to manage situations that involve people with mental illness in crisis; much of the research on these programs has focused on the effectiveness and financial savings of implementing these programs (i.e. reductions in adjudications and hospitalizations). This study examined whether these programs are effectively managed mental health crises across California. This study implemented a sequential mixed methods design that used qualitative data to explain quantitative results to determine effectiveness. Crime victims are often instrumentalized within the criminal legal process in furtherance of state prosecutorial interests. This is a particularly salient issue concerning victims of gender-based violence (GBV) because victim testimony is typically considered essential for successful prosecution of these types of crimes. Since the U.S. Supreme Court’s 2004 decision in Crawford v. Washington, courts require declarants to be available for cross-examination on “testimonial” hearsay evidence. Consequently, criminal legal actors are further incentivized to employ highly coercive practices aimed at securing GBV victims’ participation in the criminal legal process as evidentiary tools. This research is an in-depth examination of how transformational leadership and conflict management style drive job satisfaction in law enforcement. Constitutional torts—private lawsuits for constitutional wrongdoing—are the primary means by which violations of the U.S. Constitution are vindicated and deterred. Through damage awards, and occasionally injunctive relief, victims of constitutional violations discourage future misconduct while obtaining redress. However, the collection of laws that governs these actions is a complete muddle, lacking any sort of coherent structure or unifying theory. The result is too much and too little constitutional litigation, generating calls for reform from across the political spectrum along with reverberations that reach from Standing Rock to Flint to Ferguson.

Black males are often the recipients of police brutality, criminal stereotyping, and inequitable treatment in higher education. This qualitative study examined the experiential narratives of 15 Black male college students’ perception towards law enforcement officers. The data was collected via one-on-one interviews, concluded with a focus group, and then presented in narrative forums. The participants’ feelings, attitudes, or beliefs about themselves as Black males significantly contributed to their inherent identification of the cultural challenges associated with law enforcement officers. The participants’ personal and vicarious life experiences prior to enrolling into higher education were significant to the authentic comprehension of the …

This study is based upon Bass and Riggio’s (2006) Augmentation Model on Transactional and Transformational Leadership, in which this quantitative study sought to identify the amount of variance in police officer job satisfaction and organizational commitment that can be explained by police chiefs’ transformational leadership behaviors above and beyond the influence of transactional behaviors. The Black Lives Matter movement reinforces that race dominates all aspects of the judicial system. Police officers are significantly more likely to stop African Americans than Whites. Even when a stop or arrest is unwarranted, law enforcement agencies can still profit from the property seized under the guise of forfeiture statutes. Various state and federal civil asset forfeiture statutes legitimize law enforcement seizing cash, homes, cars, and office equipment—all with nominal due process protections. Despite evidence of discriminatory police practices, the U.S. Supreme Court deems these forfeiture practices constitutional.

Law enforcement abuse their discretion by providing favorable treatment to individuals that demonstrate a relationship to the law enforcement community. Private organizations affiliated with law enforcement have capitalized on this by creating association cards which are distributed by members to friends, family members, and others. Card holders present the card during encounters with law enforcement to signal that they have a relationship with law enforcement, with the expectation that they will receive favorable treatment. Using a case study methodology, this paper assesses the unique tactical challenges faced by law enforcement officers responding to the October 1, 2017, Las Vegas active shooter incident. The authors assessed the tactical strengths of the assailant, Stephen Paddock, and challenges faced by law enforcement personnel. The authors present several proposed applications of unmanned aircraft systems that could have potentially mitigated the active shooter’s tactical advantages.
