Aggregation And Urban Misdemeanors, Alexandra Natapoff

The urban misdemeanor process relies on a wide variety of informal groupings and aggregations. Order maintenance police arrest large numbers of people based on neighborhood, age, race, and other generalizations. Prosecutors and public defenders resolve entire classes of minor plea bargains based on standard local practices and pricing. Urban courts process hundreds of cases en masse. At each stage, the pressure to aggregate—to treat people and cases by group—weakens and sometimes eliminates individuated scrutiny of defendants and the evidence in their cases; people are largely evaluated, convicted, and punished by category and based on institutional habit. This Essay will focus on the approach a Christian poverty lawyer can take to answering these questions. This Essay will argue that because a lawyer's actions are ultimately based on what she believes about herself and her place in the world, the Christian lawyer will begin her move away from paternalism and towards power-sharing. She will do this by embracing a Christian self-understanding and integrating that understanding into her work in the most significant ways possible. This Article considers the effects of nurturing law student interest in public service intersects with the goals of developing lawyering expertise. This Article discusses one Southern California court's attempt to provide greater access to underrepresented litigants in a mixed urban and rural county northwest of Los Angeles. The Article explores Ventura County Superior Court's outreach program designed to increase court access through pro se self-help services, educational outreach, specialty courts, and collaboration with social service organizations. The Article hopes to inspire others to try creative methods to improve access in their jurisdictions.

This Article discusses the importance of public outreach and education in the judicial system. The Article advocates for various court-sponsored outreach programs to increase citizen contact with the courts for problem solving purposes. The Article provides examples of the perils of litigation and explains that business executives can avoid these perils by anticipating potential legal problems. The Article argues that the successful business executive must find a way to balance an optimistic, entrepreneurial spirit with a lawyerlike way of considering potential future problems. Employing psychological principles to reform the structure and agendas of business organizations increases employee fulfillment. This Essay proposes changes in corporate structure in order to nurture employee's mental health in a way that also benefits companies by resulting in greater employee productivity. This Speech discusses the decline of the law profession in its commitment to public service. It analyzes the reasons as to why the practice of law has evolved from a profession once thought to epitomize professionalism into one that does not seem much different from other businesses. It discusses the consequences of such a reality. The author suggests measures that the American Bar Association should employ to ameliorate the effects of this reality and outlines steps it should take to help restore the high level of professionalism to the industry.

Availability Of A New York Class Action For Railroad Commuters: David V. Goliath, Maura E. O'Sullivan

A class action brought under the New York statute (modeled after Federal Rule 23 of Civil Procedure) is an appropriate procedural device for remedying the continual breaches of the commuter carriage contract. In Pennsylvania Railroad Co. v. Puritan Coal Mining Co., the Supreme Court held that the common law mandates that common carriers treat passengers reasonably. Additionally, in the contract carriage, the carrier impliedly guarantees that the vehicle is in sound and proper order. Individual suits, unfortunately, have little effect on the actions of the common carriers; only nominal damages have been awarded in commuter actions against railroads for equipment …
