The International Criminal Court: Taiwan's Last Hope?, Christa Tzu-Hsiu Lin

In 1989, the United Nations General Assembly began work on establishing the first-ever permanent International Criminal Court. Eight years later, the draft code for the International Criminal Court is nearing completion and establishment of the Court is proposed for 1998. The goal of the International Criminal Court is to enhance international cooperation in international criminal matters. This Comment discusses the International Criminal Court in light of China's missile tests off the coast of Taiwan. The lack of international response to the missile tests in the past demonstrates the need for an international body to intervene in this act of aggression. …

Dashing Consumer Hopes: Strict Products Liability And The Demise Of The Consumer Expectations Test, Rebecca Korzec

The threshold issue in American products liability litigation is whether the product was defective at the time it left the manufacturer's control. Traditionally, courts and scholars define “defect” in three functional categories: manufacturing defects, design defects and marketing defects. American products liability doctrine employs two major tests to determine whether a "defect” exists: the seller-oriented risk-utility test and the buyer-oriented consumer expectations test. The Draft of the Restatement Third of Torts: Products Liability, like some American jurisdictions, rejects the “consumer expectations” test as an independent standard in defective warning and design cases. The central argument of this paper is that the character of a nation's system of law is inextricably connected with its socio-economic, cultural, religious and political make-up. To understand the attitude of a nation towards other nations, one must not be ignorant of the laws through which that nation gives expression to its sense of justice and regulates its structure. Furthermore, one must bear in mind that each system of law has different concepts through which its law is expressed, language through which it is explained, categories by which it is organized, and legal rules which themselves embody the law …

The United Nations Convention Of The Rights Of The Child: A Feminist Landmark, Cynthia Price Cohen

The United Nations Convention on the Rights of the Child,1 adopted by the General Assembly on November 20, 1989, is a ground-breaking human rights treaty for many reasons. It had the largest number of signatories on the day that it was opened for signature.2 It went into force more quickly than any other human rights treaty;3 it reached near-universal ratification by mid-1996;4 and it protects the entire range of human rights: civilpolitical, economic-social-cultural, and humanitarian.5 In addition, the Convention's monitoring mechanism gives unique powers to its monitoring body, the Committee on the Rights of the Child.6 Unfortunately, these achievements have …

The Role Of The United Nations In Dealing With Global Problems, Jost Delbruck

In this article, Professor Jost Delbruck maintains that the United Nations
(U.N) has evolved beyond its original conception as merely an international
organization designed to facilitate cooperation between its various Member
States. As evidence of this transformation, Delbruck offers examples of UN.
practice and its impact. In particular, UN. regulation concerning global
commons and human rights has encouraged globalization by confirming
limitations on States' rights and sovereignty. Further, the UN. practice of
involving non-governmental organizations has helped to expand (or globalize)
the recognized subjects of international law.

Professor Fidler's article examines the Cuban Liberty and Democratic
Solidarity (LIBERTAD) Act of
1996,
Act, from within liberal international relations theory. He takes as his starting
point the controversy that the Helms-Burton Act has produced among liberal,
democratic states. Professor Fidler outlines the major tenets of the liberal
tradition in international relations thinking: promoting economic
interdependence, internationall aw, internationali nstitutions,a nd democracy.
He then looks at the arguments made by opponents of the Helms-Burton Act

In this article, Professor Obiora begins with the premise that the
credibility of traditional legal frameworks has eroded, because the law
remains unable to relieve the oppressions and polarization between cultures,
even in the wake of global institutional transformations that seem to help the
