As Title IX celebrates its thirty-fifth anniversary, many have noted its enormous positive effect on women's sports. But an unintended and too-often neglected byproduct is that as opportunities for female students have increased, opportunities for female professionals have declined. This Article focuses on the barriers that still confront women in college athletics, particularly those who seek professional positions in coaching and administration. Part I presents a brief overview of Title IX, which makes clear its limitations in securing gender equity. Institutes Of Higher Education, Safety Swords, And Privacy Shields: Reconciling Ferpa And The Common Law, Stephanie D. Humphries

In light of the Virginia Tech shootings, this Note argues that both FERPA and the common law contain internal tensions regarding safety and privacy that neither Congress nor the courts have adequately reconciled, and that important discrepancies regarding information sharing exist between IHEs' practices, the common law's demands, and FERPA's limitations.

Part I provides background on FERPA and argues that FERPA's emergency exception is too narrow and confusing, so that IHEs default to the nondisclosure option rather than disclosing information to third parties, such as parents, when students threaten to harm themselves or others. The contemporary college or university campus is a complex and dynamic environment that requires students to navigate myriad institutional processes. College preparedness is not simply a matter of being academically ready for postsecondary-level work, but also requires that students have a procedural knowledge of other university processes - what we define herein as "college knowledge." This article presents that results of an evaluation of a college preparation program that focuses on college knowledge and provides a road map for designing an effective college knowledge program.

This chapter provides a concise and up-to-date synthesis of the published case law where a student teacher was the plaintiff, the defendant was an institution of higher education or cooperating local school district, and the issues in dispute were related to diversity. The number of such court decisions was surprisingly small, and the outcomes generally favored the defendant institutions. The court cases fall under three categories: 1) student teachers’ diverse views on religion, 2) student teachers’ diverse forms of free speech, and 3) student teachers with special needs. First, this Essay considers the existing federal legal framework for education litigation and particularly the idea that there may be a fundamental right to at least a minimally adequate education. Second, this Essay describes the situation in New Orleans before Hurricane Katrina and the resulting confusion in the months following the disaster. This Essay relies on interviews with New Orleans public school administrators, teachers, and personnel, as well as employees of local and national nonprofit organizations. The Portuguese Constitution (1976) came after a period of 48 years of authoritarianism and a closed society, in which some happy few enjoyed great privileges while the great majority of people were charged with heavy duties So, by a very understandable "law of human nature", the constituent law givers could not reasonably impose constitutionally many obligations, in an autonomous way. As rights and duties are the twin sides of the same coin, the juridical formulation under the sign of rights also implies obligations, related to those same rights. This is kinder and more pleasant to do by a liberating Constitution...

The Bologna Process is a massive, multi-year project designed to create the European Higher Education Area by the year 2010. It began approximately ten years ago when four European Union (EU) countries signed a relatively vague declaration. It has now grown to forty-six countries, including all of the EU Member States and nineteen non-EU countries. The Bologna Process countries have agreed on ten action lines for restructuring European higher education. These action lines are nothing short of revolutionary - they address everything from adoption of a three-cycle degree system (e.g., bachelor-master's-doctorate degrees), European-wide quality assurance efforts, mobility of higher education …
