Constitutional Law--No Right To Counsel At Probation Revocation Hearings, Robert R. Potter

Mercer Law Review

In Mercer v. Hopper, the Georgia Supreme Court, in a four-sentence per curiam opinion, held that "[tihere is no right to counsel at a probation revocation hearing in Georgia." Mercer pleaded guilty to, and was convicted of, three charges of driving under the influence of intoxicants and one charge of forgery. He received a five year sentence for forgery and three 12-month sentences for the DUI charges, the latter to run consecutively, but concurrently with the forgery sentence. All sentences were ordered to be served on probation.

Professor Baude's purpose in this discussion is to elicit police officers' comments on what members of the legal profession ought to know about the influence of the "street perspective" in shaping those officers' attitudes towards the criminal justice system and the role they play in it. It is police insistence on the broad validity of insights which only "the street" can provide that accounts for the considerable gulf between "front-line" enforcement officers and other functionaries in (and students of) that system. A Critique Of Two Arguments Against The Exclusionary Rule: The Historical Error And The Comparative Myth, Donald E. Wilkes Jr.

“The great body of the law of evidence consists of rules that operate to exclude relevant evidence.” The most controversial of these rules are those which prevent the admission of probative evidence because of the irregular manner in which the evidence was obtained. Depending on whether the method of obtaining violated a provision of positive law, irregularly obtained evidence may be separated into two classes. Evidence obtained by methods which meet legal requirements but contravene some moral or ethical principle is unfairly obtained evidence. Evidence obtained in violation of a legal right or immunity is improperly obtained evidence, regardless of …
