Mass-tort MDLs dominate the federal civil docket, yet they present enormous challenges to transferee judges assigned to manage them. There is little official guidance and no rules specific to the management of mass-tort MDLs, often requiring the transferee judge to develop procedures out of whole cloth.

Beginning in 2013, the Bolch Judicial Institute (then the Center for Judicial Studies) sought to address this issue through a series of annual bench-bar conferences. Recent years have witnessed two linked revivals in the legal academy. The first is renewed interest in articulating a normative “master principle” by which legal rules might be evaluated. The second is renewed interest in the prospect that a variant of Benthamite “utility” might serve as the requisite touchstone. One influential such variant now in circulation is what the Article calls “Paretian welfarism.” This Article rejects Paretian welfarism and advocates an alternative it calls “fair welfare.” It does so because Paretian welfarism is inconsistent with ethical, social, and legal prescription, while fair welfare is what we have been groping for …

In common-law systems, the standard of proof for ordinary civil cases requires the party who bears the burden of proof to establish by a preponderance of the evidence that the facts alleged are true. In contrast, the prevailing standard of proof for civil cases in civil-law systems is indistinguishable from the standard for criminal cases: the judge must be firmly convinced that the facts alleged are true. This striking difference in common-law and civil-law procedures has received very little attention from either civilian or comparative scholars. This Essay focuses not on how fact-finders process evidence but on how they apply the specified standard of proof to their finding. The oddity that prompts speculation is that, in noncriminal cases, the common law asks only that the fact appear more likely than not, while the Civil Law seems to apply the same high standard in these cases as it does in criminal cases. As a psychological explanation of the cognitive processes involved, some theorists posit that the bulk of fact-finding is an unconscious process, powerful but dangerous, which generates a level of confidence against which the fact-finder could …

It is rare that a court as sophisticated as the Florida Supreme Court casually makes a fundamental mistake in an important area of the law. Unfortunately, Saleeby v. Rocky Elson Construction, Inc., 3 So. 3d 1078 (Fla. 2009) represents one of these unusual instances. The Court was faced with a simple question: may evidence pertaining to a prior settlement be offered at trial when it is relevant to something other than liability or the invalidity or amount of the pending claim. En una reciente sentencia casatoria, la Sala Civil Permanente de la Corte Suprema ha hecho prevalecer el embargo inscrito frente a la propiedad no registrada. En opinión del autor, esta sentencia, a diferencia de anteriores pronunciamientos, invoca argumentos distintos a los tradicionales, por lo que marca un punto de referencia imprescindible para cualquier análisis de la tendencia jurisprudencial sobre la materia. El autor está en desacuerdo con la jurisprudencia sentada en el Quinto Pleno Casatorio Civil. Señala que el Pleno dejó de tomar en cuenta las directivas de la interpretación autoritativa, según la cual se debe utilizar recursos hermenéuticos constituidos por las opiniones de autorizados jurisperitos, además de haberse dejado de lado la doctrina sobre la anulabilidad de los actos colegiales asociativos contrarios a la ley y al contenido del estatuto. Advierte que se debe tomar en cuenta de que en nuestro ordenamiento solo cabe hablar de nulidades textuales.
