The Reluctant Lawmaker. The European Union And The Regulation Of Gambling Between The Principle Of Free Circulation Of Services And Member States Prerogatives, Nadia Coggiola Ph.D

International Conference on Gambling & Risk Taking

Abstract

Although the European Union legislator is generally very keen to rely primarily and sometimes even exclusively on economic considerations, and therefore to generally protect consumers’ interests, this attitude is largely different when gambling issues are a stake.

In fact, even if it is generally undisputed, also by the same European Union legislator, that authorized gambling contracts are to be considered as consumers’ contracts, when facing the regulation of gambling contracts, the European Union often restrains from using all of its legislative powers.

As a consequence, the European legislation on consumer’s contracts generally explicitly exclude from its application gambling contracts, …

Christian Influence On Roman Natural Law In The Corpus Juris Civilis, Bryce Tenberg

Helm's School of Government Conference - American Revival: Citizenship & Virtue

Few civilizations have influenced the contemporary world more than the Romans, and the same can be said regarding the field of law. Today, legal foundations throughout the West are built upon the Roman legal system, with the Code of Justinian—also known as the Corpus Juris Civilis—being arguably the most influential. This work compiled and simplified centuries of Roman law to ensure a more efficient jurisprudence, and due to its survival, it would form the foundation of the modern jurisprudence. However, at the same time this work was written, the empire had changed significantly with the adoption of Christianity. This …

Civil Disobedience From A Biblical Perspective, Gabriel Reed May 2021

Civil Disobedience From A Biblical Perspective, Gabriel Reed

Helm's School of Government Conference - American Revival: Citizenship & Virtue

To say that civil disobedience is a complicated topic is to severely understate the topic. It is a subject matter that has derived many different and disparate opinions, points of view, and public policies. Specifically, within America today, we observe calls for civil disobedience from both sides of the political spectrum, over several divergent political ideals. These issues are, primarily, driven from both sides’ desire to provide protection and provision for the oppressed and those who cannot necessarily speak for themselves. The definition of who is necessarily oppressed and whom their oppressors are varies from person to person, regardless of …

Biennial Conference: The Social Practice of Human Rights

The scientific development in Artificial Reproductive Technology (ART), especially IFV solutions, are promoting the development of our reproductive options. Surrogacy is now one of these solutions and new ethical and legal problems arise.

Domestic Laws have the most different positions. If there are countries that admit surrogacy arrangements, even commercial ones like the Florida State in the USA (and the particular case of India); others criminalize these procedures and others, like the UK (and Portugal), have a middle term position.

Considering the frontier zone in which surrogacy takes its place, the debate is more exuberant since the concrete legal solution …

The Just And The Unjust: Ernest Hemingway And Protest Literature In Response To Civil Disobedience In The Context Of The Two World Wars, Trang Hoang May 2019

The Just And The Unjust: Ernest Hemingway And Protest Literature In Response To Civil Disobedience In The Context Of The Two World Wars, Trang Hoang

Celebration of Learning

By obeying unjust laws, human beings give up their own opportunity to live in a humane world. Henceforth, the two World Wars stand remarkably as situations that conscience of morality has to be placed on top of obedience to ensure the essence of human existence, and a failure to do so led to not only the deaths and exhaustions worldwide but also the collapse of human love and human responsibility to love. Protest literature, especially Ernest Hemingway's novels allow people to reflect on this philosophy through an artistically credible lens.

The Personal Record Book Of Hayyim Gundersheim Dayyan (1774), Edward Fram

Early Modern Workshop: Resources in Jewish History

Rabbinic courts were and remain an integral part of the Jewish community and the Jewish community in Frankfurt in the late eighteenth century had not one but two such courts. The courts handled a wide range of issues including divorces, contracts, real estate transactions, trusts, estates, and also gave opinions on the scope of Jewish communal authority. This particular case deals with a house on the so called "Judengasse" in Frankfurt. The Jewish ghetto was divided up into lots that had names rather than street numbers and houses on the lots were often owned by more than one family. The …
