2003 Testimony On Securitization And Predatory Lending In A Hearing On 'Protecting Homeowners: Preventing Abusive Lending While Preserving Access To Credit', Kurt Eggert

This 2003 Congressional Testimony warns of the dangers of securitizing subprime loans. After defining "predatory lending" and describing the process of securitization, it argues that securitizing subprime loans has many dangers. While some have claimed that securitizing loans lowers loan costs to borrowers, the reverse might be true and securitization may actually increase the costs of loans to borrowers. This testimony states that securitization undermines loan underwriting. As originators immediately sell their loans and so face less risk of loss even if a borrower defaults, the originators naturally will spend less time and effort screening potential loans for default, thus …

Section 1031 And Proximate And Midstream Business Transactions, Brad Borden

Section 1031 exchanges frequently occur in proximity to business transactions (i.e., entity formations, mergers, divisions, and dissolutions). Although section 1031 exchanges and many business transactions can be tax free, the proximity of such transactions often presents challenging legal and theoretical questions. In fact, depending on the order of the transactions, taxpayers may lose the tax-free treatment of the exchange or of the proximate business transaction. This Article examines the tax consequences and theoretical aspects of section 1031 exchanges and proximate business transactions.

Lawyers must excercise diligence to protect the confidentiality of privileged client materials. Lawyers who mistakenly press the "send" button on their computers or "reply to all" may find that they inadvertently disclosed confidential material to adversaries -- or the public. The recipient of such inadvertently sent confidential materials may have a duty to alert an adversary to the mistaken disclosure, depending on the precautions taken to preserve privilege, and whether there is evidence of a conscious or reckless waiver of the privilege.

This article describes the origins and shaping of the classic text, with special emphasis on the goals of the authors and the developmental phase of clinical legal education from which their work emerged. The author surveys Gary Bellow's unique role and influence from the perspective of a contemporary, and identifies innovative teaching approaches that the text facilitated. Comments from law teachers over the years highlight the utility and importance of the book. The article proposes that 18 USC 1960, a criminal statute that criminalizes the unlicensed operation of a money service business, may be used to prosecute not only traditional bricks and mortar businesses, but also informal money transfer operations of the kind typically used by drug trafficking, terrorist financing and other criminal organizations.
