This article describes the origins and shaping of the classic text, with special emphasis on the goals of the authors and the developmental phase of clinical legal education from which their work emerged. The author surveys Gary Bellow's unique role and influence from the perspective of a contemporary, and identifies innovative teaching approaches that the text facilitated. Comments from law teachers over the years highlight the utility and importance of the book. The debate over the legality and morality of NATO's actions with respect to Kosovo has been fierce, and writings on this subject have been legion. Although the primary focus of this chapter is on the legal dimensions of the Kosovo crisis, it also explores moral and political considerations. Payment Of Pre-Petition And Post-Petition Employee Severance Benefits, Daniel Austin

This article examines whether severance benefits promised to employees pre-petition may be paid after the employer has filed a chapter 11 bankruptcy petition. The answer depends on whether the severance benefits were payable based on length of service or in a single lump-sum payment, and whether the debtor is in a majority-or-minority-rule jurisdiction. For most debtors, pre-petition lump-sum severance benefits are not payable as an administrative expense. Severance benefits based on length of service must be allocated between pre- and post-petition service. This article does not deal with benefits provided under a collective bargaining agreement, which are governed under Section …

How Judges, Practitioners, And Legal Writing Teachers Assess The Writing Skills Of New Law Graduates: A Comparative Study, Susan Duncan, David Ritchie

This article discusses the results of a survey which asked members of the profession - attorneys, judges and law professors - what they thought of the writing skills of their colleagues. To quantify the responses we asked specifically about the respondents' opinions concerning elements generally acknowledged as key to good legal writing. In particular, we provided survey respondents with a checklist of elements that are commonly included in the various sections of appellate briefs and memoranda. Respondents were then asked to rank the elements in each section. This ranking gave us an idea of what each group perceived to be …
