There is a fundamental clash in contemporary society between, on the one hand, an orthodox Christian understanding of human dignity and of what is required of us if we are to respect and honour the dignity of every human being and, on the other hand, a secularist vision of human existence. In his great Encyclical Evangelium Vitae, 'The Gospel of Life', Pope John Paul II identified as the practical expression of this clash the conflict between what he called the 'culture of life' and the 'culture of death'. The doctrine of stare decisis serves several purposes, among them judicial efficiency, consistency, manageability, and reliance. These are all conservative virtues. Yet is it possible for a conservative-minded jurist to adhere strictly to principles of stare decisis that would require affirming precedents by progressive courts that did not similarly follow principles of stare decisis because of the progressive belief in an inevitable forward march of history? Most theoretic models of multiparty electoral competition make the assumption that party leaders are motivated to maximize their vote share or seat share. In plurality-rule systems this is a sensible assumption. However, in proportional representation systems, this assumption is questionable since the ability to make public policy is not strictly increasing in vote shares or seat shares. We present a theoretic model in which party leaders choose electoral declarations with an eye toward the expected policy outcome of the coalition bargaining game induced by the party declarations and the parties’ beliefs about citizens’ voting behavior. The mistreatment of those of Arab, Muslim, and Sikh descent in the United States post September 11 amounts to vigilante racism--the enforcement of a presumed code of what constitutes a "true" American. In the process, the culprits engage in a process of "de-Americanizing" individuals of color, informing them that they do not belong to the American community. There are two Americas; one that is embracing of diversity, the other that continues to be premised on a Euro-centric vision.

Good ideas do not always lead to legal acts. Setting up a prediction market in science claims, for instance, certainly sounds like a good idea. Such a market could effectively open a shortcut to the future, answering crucial questions more quickly, accurately, and cheaply than extant institutions. Notwithstanding those salient benefits, however, U.S. law does not clearly permit markets in claims about science. Such a market would not fit neatly into any common law, statutory, or regulatory category, and courts have yet to clarify the matter. The oral contraceptive pill has been safely and effectively used for over 40 years. It seems reasonable to ask whether the pill should be made available over-the-counter (OTC) without a physician's prescription. If so, what will be the subsequent change in cost due to OTC pill availability? A cost-effectiveness model was adapted and modified to estimate the current contraceptive methods' cost and OTC pill availability cost. The possible changes from other contraceptive methods to the use of a potential OTC pill were assumed in this study. Using a predictive model, it was found that in the United States alone, nearly …

This article is an adaptation of an amici curiae brief filed in support of the petition for writ of certiorari in Beazley v. Johnson, 242 F.3d 248 (5th Cir. 2001), cert. denied, 534 U.S. 945 (2001), application of stay of execution denied, 533 U.S. 969 (2001).
