Re-Entering The Arena: Restoring A Judicial Role For Enforcing Limits On Federal Mandates, John Eastman

The mini-revolution in 1994 that gave Republicans control of Congress for the first time in forty years, and which led to the enactment of the Unfunded Mandate Reform Act of 1995 (UMRA) as part of the Contract with America, was designed in part to revive some foundational constitutional principles, including federalism, enumerated powers, and the non-delegation of lawmaking authority. This Article considers how successful the UMRA has been in furthering these principles and how shortcomings of the UMRA that have become evident over the past seven years might be corrected to further these principles still further. Cultural Models Of Diversity In America : The Psychology Of Difference And Inclusion, Victoria Plaut

Various cultural models of diversity that can be found in America are summarized. Models of diversity in essence are representations of culture and humanity--specifically, the important aspects of being human and the dimensions along which people differ, and how to come to terms with these differences. It is noted that although social psychology has provided many tools for the dismantling of intergroup bias, it has not looked carefully at the ideological assumptions that undergird its theories and applications, and it has not taken stock of the heterogeneity of representations of diversity that can be engaged by different individuals and different …

Place Matters: Consensual Features And Regional Variation In American Well-Being And Self., V Plaut, H Markus

Consensual and regionally distinct features of well-being and self were examined in a nationally representative survey of midlife Americans (ages 25-75). Consistent with key American ideology, Study 1 found that a majority of Americans believe they have high levels of mastery, purpose, life satisfaction, overall health, family and work obligation, and partner and family support. Study 2 found distinct regional well-being profiles (e.g., New England reflected concern with not being constrained by others; Mountain showed concern with environmental mastery; West South Central with personal growth and feeling cheerful and happy; West North Central with feeling calm, peaceful, and satisfied, and …

There is little doubt that Europeanization is making headway now in the field of criminal justice. Some provisions of the Union Treaty (like Art.29, 31, 34 TEU) are at least an indication of the forces which are likely to shape future developments. There exist different possible lines of development: more intensive co-operation, assimilation and harmonisation, for example in the form of a model penal code or in form of the proposed Corpus Juris. They all have their weaknesses.

The tragedies of 9/11, Katrina and Rita raised major problems with emergency responses, which did not proceed according to plan. Emergency action plans (EAP's) are a relatively new phenomenon, but the legal principles governing them are based in long-established rules of negligence. Statutes, regulations, and professional standards often require the preparation of emergency action plans (EAP's) to facilitate the response, recovery, and rebuilding efforts when a disaster occurs.
