Special Education, Poverty, And The Limits Of Private Enforcement, Eloise Pasachoff

Georgetown Law Faculty Publications and Other Works

This Article examines the appropriate balance between public and private enforcement of statutes seeking to distribute resources or social services to a socioeconomically diverse set of beneficiaries through a case study of the federal special education law, the Individuals with Disabilities Education Act (IDEA). It focuses particularly on the extent to which the Act’s enforcement regime sufficiently enforces the law for the poor. The Article responds to the frequent contention that private enforcement of statutory regimes is necessary to compensate for the shortcomings of public enforcement. College And University Developmental Education: The Professional Development Needs Of College And University Remedial Instructors, Kyle Trevor Miller

The purpose of this mixed method study, which utilized both survey data and personal interviews, was to determine if Murray's (2001) theory of six constructs applies to faculty who instruct remedial students at both four and two-year institutions. The research study used both quantitative and qualitative methods of research. A survey that included 23 items concerning college and university remedial faculty's perceptions about professional development at their institutions was administered to 300 remedial instructors. Ninety seven participants' responses were analyzed for the study. Survey answers were analyzed using factor analysis with Cronbach's ? reliability tests. Survey responses from college and …

The single best predictor of the success of university sponsored student development activities is the degree to which the students are engaged in these activities (Kuh, 2007). Sax (2008) observes though that much of our understanding of the impact of the college experience is based on the study of students in the aggregate, with relatively little work done on how the college environment differentially influences men and women. While a growing body of scholarship has focused on the personal, professional, and organizational factors that influence faculty members’ involvement in publicly engaged scholarship, the nature and scope of faculty publicly engaged scholarship itself has remained largely unexplored. What types of activities are faculty members involved in as publicly engaged scholarship? How does their involvement vary by demographic, type of faculty appointment, or college grouping? The purpose of the study was to examine the mission and structure of governance of three providers of pre-university pathway programs based in Australia and operating on a global basis. The aim of the research was to investigate changes, if any, to the purpose and form of governance in this sector for which virtually no research has been undertaken. The literature review of governance in the higher education sector on a global scale in relation to universities revealed an increasing trend toward a corporate style of management. A majority of rural public schools face difficult and challenging problems: geographical isolation, escalating crime, impoverished families, economic inequities, faculty nonretention, declining enrollments, and lack of success in meeting accreditation benchmarks. In the past decade, support for character education as a valuable pedagogy to complement instruction and academic achievement emerged. The obligation to meet federal and state standards created expectations that school principals have the leadership ability to facilitate strong academic curricula as well as programs fostering students' moral development through character education. The certification of financial aid administrators has been debated for over 37 years. A job satisfaction survey conducted by the National Association of Student Financial Aid Administrators (NASFAA, 2008a) revealed that college and university administrators' perceptions of the efficiency, effectiveness, and quality of the services provided by the financial aid office have a direct effect on the job satisfaction of financial aid practitioners. The study also hinted at a possible link between these perceptions and the resources allocated to the financial aid office. Problem. The average length of stay for school principals in the Seventh-day Adventist system of education in North America is 2.5-4.0 years. Elementary principals remain in leadership for 2.5 years, day academy principals stay for 3.6 years, and boarding academy principals stay for 4.0 years. The purpose of this study was to understand the relationship between time spent by students engaged in student co-curricular involvement, online social networking, and studying on their academic achievement. Additional factors such as student residence, gender, ethnicity, class standing and work for pay were also considered. Existing literature supports the concept that the more time students spend in educationally purposeful activities, the more likely students are going to be successful. The purpose of this study was to investigate characteristics associated with resilient school leaders. Principals juggle multiple responsibilities and work under increasingly stressful conditions. Despite recent role changes, added job responsibilities, and increased accountability, some principals remain remarkably resilient while working in a tumultuous environment. Using Henderson and Milstein's (2003) definition, principal resiliency was described as "the capacity to spring back, rebound, successfully adapt in the face of adversity, and develop social, academic, and vocational competence despite exposure to severe stress or simply to the stress that is inherent in today's world" (p. 7). The purpose of the study was to identify international university administrators' perspectives on organizational strategies to support higher education internationalization. Internationalization is the conscious effort to integrate international, intercultural, and global dimensions into the ethos and outcomes of higher education (NAFSA, 2008). A descriptive survey design method was used and the instrument entitled "Strategic Internationalization Priority Scale" was developed for this research. While African American women have been participating in American higher education for more than a century, they remain significantly underrepresented among college and university administrators. Researchers have noted that when these women are able to secure administrative positions, many of them contend with intense isolation and marginalization, which compromises their personal well-being and jeopardizes their professional success. Black feminist scholars have suggested that African American women may be assisted by involving themselves in supportive networks that provide them the opportunity to connect with other African American women.
