This capstone focuses on a comparative analysis of information collected via literature review and incorporates responses from interviews conducted with experts in the field of servant leadership. The Greater New Orleans Foundation (GNOF) in partnership with the University of New Orleans’ (UNO) Political Science Department undertook a study to gain insights on the impact the ongoing COVID-19 pandemic is having on nonprofit organizations located in Southeast Louisiana and to share this information as a resource to philanthropy, nonprofits, and civic leaders in our region. GNOF and UNO conducted online and phone surveys beginning March 23, 2020 through April 13, 2020 which targeted 501(c)3 public charities, excluding churches, foundations, and unique groups of larger nonprofits such as hospitals, universities, and charter schools. Directors of nonprofit organizations owe fiduciary duties to their organizations, but the content of these duties—and how and when courts should enforce these duties—has long been debated among scholars and courts. This debate emerges in several areas, including the level of deference to be shown by courts to nonprofit directors (the business judgment rule), who should be allowed to sue to enforce duties (standing), and the type of relief available to prevailing plaintiffs (remedies). The more than 35,000 nonprofit organizations in Massachusetts employ 20% of the state’s workforce and serve as a vital part of the social safety net. Many of these organizations face challenges concerning fiscal sustainability. Funding often covers current services with little surplus to address organizational capacity issues. Successful public-nonprofit partnerships are key to building a resilient nonprofit sector. This study contributes to the nonprofit sector’s knowledge of how best to engage with policymakers at the state and local level.

Recent work in Canada and Europe has re-emphasized the place of nonprofit organizations, as that term is conventionally understood in the broader context of social economy. Although not generally recognized by U.S. and international scholars, a distinctive concept of social economy largely compatible with the Canadian and European formulations is embedded in U.S. constitutional, corporate, charitable and tax law. However, its full recognition is discouraged in the current U.S. political culture and third sector studies. The U.S. social economy provides full and robust, recognition of the social, political and economic organizations known as commons, as well as nonprofit firms.

Recent events in both the public and private sectors have lead to an environment of mistrust and caution surrounding the way organizations are managed and funds are handled. For the nonprofit sector, this has led to an emergence of charity rating or watchdog organizations and increased scrutiny of finances. Individual donors, charity rating agencies, and funding institutions have begun using expense ratios as a measure of financial efficiency.
