The Greater New Orleans Foundation (GNOF) in partnership with the University of New Orleans’ (UNO) Political Science Department undertook a study to gain insights on the impact the ongoing COVID-19 pandemic is having on nonprofit organizations located in Southeast Louisiana and to share this information as a resource to philanthropy, nonprofits, and civic leaders in our region. GNOF and UNO conducted online and phone surveys beginning March 23, 2020 through April 13, 2020 which targeted 501(c)3 public charities, excluding churches, foundations, and unique groups of larger nonprofits such as hospitals, universities, and charter schools. Directors of nonprofit organizations owe fiduciary duties to their organizations, but the content of these duties—and how and when courts should enforce these duties—has long been debated among scholars and courts. This debate emerges in several areas, including the level of deference to be shown by courts to nonprofit directors (the business judgment rule), who should be allowed to sue to enforce duties (standing), and the type of relief available to prevailing plaintiffs (remedies). The nonprofit sector has seen a 20% increase in the number of higher education institutions over a period of 10 years, from 2000-2010, (Blackwood et al. 2012), which had a big impact on the public charity revenues and expenses. The more than 35,000 nonprofit organizations in Massachusetts employ 20% of the state’s workforce and serve as a vital part of the social safety net. Many of these organizations face challenges concerning fiscal sustainability. Funding often covers current services with little surplus to address organizational capacity issues. Successful public-nonprofit partnerships are key to building a resilient nonprofit sector. This study contributes to the nonprofit sector’s knowledge of how best to engage with policymakers at the state and local level.

The U.S. Social Economy And The Commons Model Of Production, Roger A. Lohmann

Recent work in Canada and Europe has re-emphasized the place of nonprofit organizations, as that term is conventionally understood in the broader context of social economy. Although not generally recognized by U.S. and international scholars, a distinctive concept of social economy largely compatible with the Canadian and European formulations is embedded in U.S. constitutional, corporate, charitable and tax law. However, its full recognition is discouraged in the current U.S. political culture and third sector studies. The U.S. social economy provides full and robust, recognition of the social, political and economic organizations known as commons, as well as nonprofit firms.

The U.S. "nonprofit sector" and other forms of contemporary national third sectors which are currently spreading around the world arose in a unique historical moment and for distinct historical reasons and are unlikely to outlast that moment in history. Voluntary action on the other hand has deep roots reaching far back in human history and is likely to be around far into the future.

The third sector is currently the most popular label for capturing the activities of a highly diverse set of tax-exempt corporations and nonprofit organizations. For some, the third sector is also the nonprofit organization sector, although for many of us it is also the sector of voluntary associations, clubs, self-help groups, and volunteering, although these components of voluntary action have been over-shadowed by interest in nonprofit management.
