Increasing protectionist policies in the United States have attempted to protect solar manufacturing jobs; however, they have created negative repercussions for the majority of the industry. This paper aims to analyze the 2018 30% US tariff on all imported photovoltaic cells and modules and whether or not it has been an effective policy to protect and encourage the solar industry. To do so, the paper will analyze similar tariffs enacted in 2012 and 2014 by the United States to understand how the tariffs have been impacting the solar energy’s labor market and photovoltaic module and cell price fluctuations. The international economic trends of globalization and neoliberalism have exposed and enabled the exploitation of Mexican workers, especially women in the maquiladora garment industry. During the 1950s, globalization gave rise to the new international division of labor and transnational corporations (TNCs) that have offshored labor-intensive phases of production to developing countries, many of which have pursued export-led industrialization. Export processing in Mexico was encouraged in the 1960s by Item 807 of the U.S. Tariff Code and Mexico’s Border Industrialization Program. This paper examines the effect of different skill levels of emigration on a country’s labor market, from high skill brain drain to low skill emigration. By utilizing an IADB Brain Drain data set to measure emigration rates among those with low, medium, and high educational attainment in a country, the effect of brain drain vs. low skill emigration on productivity and unemployment is examined. These data span from 1980 to 2010 with measurements every five years for 195 World Bank countries. Mergers of competitors are conventionally challenged under the federal antitrust laws when they threaten to lessen competition in some product or service market in which the merging firms sell. Mergers can also injure competition in markets where the firms purchase. Although that principle is widely recognized, very few litigated cases have applied merger law to buyers. This article concerns an even more rarefied subset, and one that has barely been mentioned. Nevertheless, its implications are staggering. Some mergers may be unlawful because they injure competition in the labor market by enabling the post-merger firm anticompetitively to suppress wages or salaries. …

The United States and France are at opposite ends of the spectrum in protecting employees from employment termination. France has developed an elaborate regulatory and judicial scheme to protect workers, while the U.S. still allows workers to be in an at will relationship with their employers. In France employment is deemed to be permanent. In the U.S., workers are employed at the whim of their employer. In a major shift of policy, France adopted legislation allowing parties to enter into voluntary employment separation agreements. Fears of NAFTA in the United States were largely based on the belief that Mexicans and U.S. workers were substitutes: lowering barriers would allow competing products into the United States and investment outflows that would cause U.S. workers to lose their jobs to Mexico. While this may have been true when NAFTA first went into effect, subsequent production specialization between Mexico and the United States may suggest that Mexican and U.S. workers are now complements. Inequality has been rising across the world in recent decades. Latin America has been an exception to what otherwise seems to be the prevalent trend in the U.S., Europe and Asia. In the U.S. the rise in inequality since the 1970s has coincided with the rise in Mexican immigration. In Mexico, inequality has been declining since the mid-1990s, a period during which emigration to the U.S. first increased to historic highs and then declined steeply.

Our review of the literature suggests that low-skilled immigration to the U.S., much of it from Mexico, has only played a minor role in rising …

Using data from the 2000 5 per cent Integrated Public Use Microdata Series, this article advocates three shifts in our theoretical and empirical approaches to understanding immigrant economic incorporation. First, through a comparison of Mexican and Vietnamese immigrants, these findings highlight the importance of an immigrant population’s relationship to the state for economic outcomes, and cautions against analyses that aggregate the foreign-born population. Second, through a joint analysis of unemployment and poverty outcomes, these findings call for researchers to be specific about the varied aspects of ‘‘economic incorporation’’ and distinguish between factors that drive labor market access, and those that …

This thesis and its corresponding art installation, Lessons from Ziggy, attempts to deconstruct the variables prevalent within several complex systems, analyze their transformations, and propose a methodology for reasserting the soap box within the display pedestal. In this text, there are several key and specific examples of the transformation of various signifiers (i.e. media-bred fear’s transformation into a political tactic of surveillance, contemporary freneticism’s transformation into complacency, and community’s transformation into nationalism as a state weapon). In the last twenty years, the United States government has put substantial resources behind the fight against .foreign bribery by using the Foreign Corrupt Practices Act (FCPA) to prosecute unilaterally foreign and domestic companies who engage in corruption abroad. The United States is not entirely alone in this effort, but other countries have been far less vigorous in investing resources in investigations and prosecuting cases. Because of the unilateral and extraterritorial nature of FCPA prosecutions, these cases are sometimes controversial as foreign governments resist American influence in their commercial relations.

[Excerpt] In this talk I want to trace the development of the field and how international labour law has taken root in five areas: 1) trade legislation (namely, the US and EU Generalized System of Preferences), 2) trade agreements, 3) international organizations, 4) corporate social responsibility, and 5) lawsuits in national courts. In each, I try to give one or two examples of how international labour law works in practice. But first, some background on the international labour law field and my involvement with it.

Scandinavian countries are known for having a high adoption of cooperative models of work design. This article investigates the role of parity labour market associations, termed intermediary cooperative associations, in the dissemination of these models. Findings are based on an examination of the Centre for the Development of Human Resources and Quality Management (SCKK), a social partnership-based organization that funds workplace development projects at state workplaces, and of nine participative development projects that received financial and logistical support from the SCKK. This paper examines recent changes in collective bargaining and employer strategies in the German telecommunications industry following market liberalization in the late 1990s. Germany’s distinctive co-determination and vocational training institutions encouraged large firms to adopt employment systems in technician and call center workplaces that relied on high levels of worker skill and discretion. However, organizational restructuring is undermining these gains, as firms use outsourcing and the creation of subsidiaries to escape or weaken company-level collective agreements. These trends have substantially weakened unions and contributed to the further disorganization of coordinated bargaining structures. Findings are based on interviews with union and …

This article examines the dynamics of workplace change in European call centers. Survey data and case studies from Austria, Denmark, France, Germany, the Netherlands and Spain show large national and sectoral differences in institutional inclusiveness and labor market segmentation. These reflect variation in the institutional constraints and resources available to employers and unions as they adjust to market changes. However, union strategies to organize new groups and close gaps in existing regulations are becoming increasingly important as restructuring undermines traditional forms of bargaining power.

Drawing on case studies from the telecommunications and auto industries, we argue that the vertical disintegration of major German employers is contributing to the disorganisation of Germany’s dual system of in-plant and sectoral negotiations. Subcontractors, subsidiaries, and temporary agencies often have no collective bargaining institutions, weaker firm-level agreements, or are covered by different sectoral agreements. As core employers move jobs to these firms, they introduce new organisational boundaries across the production chain and disrupt traditional bargaining structures.
