Recent advancement in digital technology, specifically blockchain, is offering an opportunity for brands to meet both these consumer demands. In five laboratory studies, I demonstrate that blockchain augmented claims, as compared to traditional industry practices (i.e., use of third-party labels and brand’s self-made claims), increases …

To that end, 23 innovation leaders, most of whom founded software companies worth hundreds of millions to billions of dollars, were interviewed with a grounded theory approach using Peter Drucker’s innovation theory as a lens through which to view new …

Notice Risk And Registered Agency, Andrew K. Jennings Jan 2020

Notice Risk And Registered Agency, Andrew K. Jennings

Faculty Articles

To sue a firm is to sue an artificial person, making the most reliable service method—physically handing papers to the defendant—unusable. This problem illustrates notice risk: if a plaintiff’s service obligations are loose, it is advantaged (because the defendant may never receive notice), whereas if they are strict, the defendant is advantaged (because the plaintiff may struggle to effect service). For litigation involving corporate defendants, civil procedure and corporate law mitigate this problem through a technology for managing notice risk: registered agency. A firm using this technology, because it cannot be served directly, appoints an agent who will accept papers …

Strive To Survive: The Redbox Example, Jake N. Conlin Oct 2019

Strive To Survive: The Redbox Example, Jake N. Conlin

Marriott Student Review

As technology continues to progress, companies can either adapt with technology or die. Advancements in technology should be used to better satisfy consumers. Companies that refuse to update their technology will not be able to survive in the future. Each company must make the most of its current technology, utilize new technology, and notify its customers of changes in its use of technology. Redbox finds itself at the crossroads of adapting or dying. Redbox can apply these three steps by milking its existing disc rental market, making the move to streaming, and marketing the new streaming service to consumers.

Decoding Smart Contracts: Technology, Legitimacy, & Legislative Uniformity, Jared Arcari

Fordham Journal of Corporate & Financial Law

Blockchain technology is increasingly permeating the everyday lives of countless people. Applications of the cutting-edge technology range from secured banking to tracking mortgage titles. A particular blockchain technology, dubbed “smart contracts,” has the potential to revolutionize how individuals and companies securely contract with each other. Smart contracts, however, are not widely employed, mainly because potential users are uncertain of their enforceability as contracts under existing state contract laws. Similar skepticism slowed the acceptance of electronic signatures in the late 1990s, but was resolved ultimately through a model uniform act recognizing electronic signatures’ effectiveness across interstate borders. This Note proposes a …
