The Epistemology Of Ethnography: Method In Queer Anthropology, Margot D. Weiss
The Epistemology Of Ethnography: Method In Queer Anthropology, Margot D. Weiss
Margot Weiss
This essay explores methodological dilemmas in queer anthropology by reviewing three recent queer ethnographies: Mary Gray's Out in the Country: Youth, Media, and Queer Visibility in Rural America; Mark Padilla's Caribbean Pleasure Industry: Tourism, Sexuality, and AIDS in the Dominican Republic; and Gloria Wekker's The Politics of Passion: Women's Sexual Culture in the Afro-Surinamese Diaspora. The essay aims to illuminate the epistemology of queer studies more broadly by focusing on a key paradox of ethnographic method: the binary of theory and data that is simultaneously made and unmade in ethnographic research and writing. In a newly transnational queer studies, ethnography …
The Man In The Text: Desire, Masculinity, And The Development Of Poe's Detective Fiction, Peter J. Goodwin
The Man In The Text: Desire, Masculinity, And The Development Of Poe's Detective Fiction, Peter J. Goodwin
Peter J Goodwin
This article finds the kernel of Poe's detective fiction in his investigations into the construction of "gentlemanliness" that he began at Burton's Gentleman's Magazine. As precursors to Poe's tales of ratiocination, "The Man That Was Used Up" and "The Man of the Crowd" train the reader not to expect a satisfying conclusion to the mystery surrounding masculinity that the author has woven. In "The Murders in the Rue Morgue," the homoerotic desire to apprehend an integral masculine subject ends in frustration bordering on the absurd. In thus undermining the American ideal of masculinity as unified, integral, impenetrable, and fraternal, Poe …
Truly Sovereign At Last: C.B.C. Distribution V. Mlb Am And The Redefinition Of The Concept Of Baseball, Mitchell J. Nathanson
Truly Sovereign At Last: C.B.C. Distribution V. Mlb Am And The Redefinition Of The Concept Of Baseball, Mitchell J. Nathanson
Mitchell J Nathanson
This article is the second in the author’s series examining the interplay between baseball and the law (the first being The Sovereign Nation of Baseball: Why Federal Law Does Not Apply To “America’s Game” And How It Got That Way, 16 Vill. Sports & Ent. L.J. 49 (2009)). The Sovereign Nation of Baseball provided the groundwork for this series by discussing how federal courts have historically deferred to those who have traditionally run Major League Baseball (the office of the Commissioner of Baseball as well as the cabal of club owners), bending the rules that would otherwise dictate the resolution …
Amos Lee's "Street Corner Preacher" Through Michel Foucault's Critique Of Scientific Knowledge: A Critique Of Legal Knowledge, Nick J. Sciullo
Amos Lee's "Street Corner Preacher" Through Michel Foucault's Critique Of Scientific Knowledge: A Critique Of Legal Knowledge, Nick J. Sciullo
Nick J. Sciullo
This article will demonstrate that although students of the law, legal scholars, and practitioners rely on a relatively narrow body of “legal scholarship,” there are in fact sundry diverse sources of legal thought that deserve to be evaluated along with currently accepted legal scholarship. It will present arguments in favor of appreciating music as a unique and important source of legal commentary through which we might understand how people relate to the law—what I have called “coming to the law.” It will demonstrate that music can be uniquely transgressive and presents a powerful alternative to what Michel Foucault called “scientific …
What Child Is This?: Closely Reading Collectivity And Queer Childrearing In Lackawanna Blues And Noah’S Arc, Vincent L. Stephens
What Child Is This?: Closely Reading Collectivity And Queer Childrearing In Lackawanna Blues And Noah’S Arc, Vincent L. Stephens
Vincent L Stephens
Increasing hostilities toward intimate change are rooted in longstanding affective investments in a sexual normativity that oppresses multiple strands of intimacy, including African American kinship networks and same-sex coupling. Since homosexuality is always racialized sexuality and African American kinship patterns have always been marginal by U. S. heteronormative standards, the present essay unmasks the ways sexual normativity has obscured collectivity as a resistive strategy in the lives of two "alternative" intimate groups with important overlaps, black gay and lesbian communities and African American extended families. The essay interrogates sexual normativity by defining and affirming the relevance of black collectivity to …

Transnational Law: An Essay In Definition With A Polemic Addendum, Allen P. Mendenhall
Transnational Law: An Essay In Definition With A Polemic Addendum, Allen P. Mendenhall
Allen Mendenhall
What is transnational law? Various procedures and theories have emanated from this slippery signifier, but in general academics and legal practitioners who use the term have settled on certain common meanings for it. My purpose in this article is not to disrupt but to clarify these meanings by turning to literary theory and criticism that regularly address transnationality. Cultural and postcolonial studies are the particular strains of literary theory and criticism to which I will attend. To review “transnational law,” examining its literary inertia and significations, is the objective of this article, which does not purport to settle the matter …

"Flourishing And Synthesis" (Review Essay), Allen P. Mendenhall
Allen Mendenhall
Edward W. Younkins's book, Flourishing and Happiness in a Free Society, is a welcome contribution to individualist thought. Focusing on Aristotle, Ayn Rand, Carl Menger, Ludwig von Mises, and Murray Rothbard, Younkins demonstrates the compatibility of Aristotelian liberalism, Objectivism, and Austrian Economics. Younkins suggests that synthesizing these philosophies will lead to human flourishing and happiness. These philosophies share certain general principles that can serve as moral bases for political action.
