Distinctively Delineated Fictional Characters Who Constitute The Story Being Told: Who Are They And Do They Deserve Separate Copyright Protection?, Jasmina D. Zecevic
Distinctively Delineated Fictional Characters Who Constitute The Story Being Told: Who Are They And Do They Deserve Separate Copyright Protection?, Jasmina D. Zecevic
ExpressO
Literary characters are protected within the copyright of the original work in which they appear, but the law is less clear when a character is separated from the original work and leads an independent life. The two main tests articulated by courts to deal with the phenomenon of an independent character, the “distinctly delineated” and “story being told” tests have not been particularly helpful. The tests are mainly used after a decision has already been reached to give the decision additional validity by uttering the magic words “distinctly delineated” or “story being told”.
A better alternative is to rely on …
Politically Motivated Bar Discipline, James E. Moliterno
Politically Motivated Bar Discipline, James E. Moliterno
Faculty Publications
Bar discipline and admission denial have a century~long history of misuse in times of national crisis and upheaval. The terror war is such a time, and the threat of bar discipline has once again become an overreaction to justifiable fear and turmoil. Political misuse of bar machinery is characterized by its setting in the midst of turmoil, by its target, and by its lack of merit. The current instance of politically motivated bar discipline bears the marks of its historical antecedents.

Nurse Gordon On Trial: Those Early Days Of The Birth Control Clinic Movement Reconsidered, Rose Holz
Women's and Gender Studies Program: Faculty Publications
It is a story many of us know well. As historian Linda Gordon explained nearly thirty years ago, in the early days of the teens Margaret Sanger was a radical. She talked about sex. She talked about revolution. She criticized doctors. She even opened a clinic in overt defiance of the law. And in this clinic she exercised her skills as a nurse and educated women about birth control. But then, as Gordon’s story also goes, by the 1920s Sanger shifted tactics: she softened her critique and she put a doctor in charge of her new facility, with the message …

House Prices In The Measurement Of Inflation: An Application Using Irish Data, Róisín O'Sullivan
House Prices In The Measurement Of Inflation: An Application Using Irish Data, Róisín O'Sullivan
Economics: Faculty Publications
This paper illustrates the impact on Irish inflation of including a house-price series with the current components of the harmonised index of consumer prices (HICP). We construct a dynamic factor index of inflation that weights the individual price series according to the strength of their signal about the common trend in prices. As the relatively noisy house-price series attracts a weight of only 3 per cent in the index, the inclusion of house prices in this way does not hugely alter the recent pattern of inflation for Ireland, despite house prices exhibiting much stronger growth on average than the current …
Abridging The Antiquitee Of Faery Lond: New Paths Through Old Matter In The Faerie Queene, Chloe Wheatley
Abridging The Antiquitee Of Faery Lond: New Paths Through Old Matter In The Faerie Queene, Chloe Wheatley

Sixteenth-century history may have been recorded most spectacularly in prestigious folio chronicles, but readers had more ready access to printed books that conveyed this history in epitome. This essay focuses on how Edmund Spenser (1552?– 99) appropriated the rhetoric and form of such printed redactions in his rendition of fairy history found in book 2 of The Faerie Queene (1596). Through his abridged fairy chronicle, Spenser connects to a broadly defined reading public, emphasizes the deeds not only of kings but their imperial and civic deputies, and provides an alternative interpretive pathway through his poem.

From 1961 to 1988, Genevieve O’Farrell, a Daughter of Charity, was the principal of Saint Louise’s Comprehensive College in Belfast. Her many achievements as a leader of the school and within Belfast are described, along with her own formation, the events and characteristics that made her a leader, and the lessons that may be drawn from her life and career. Aid And Comfort: Rasul V. Bush And The Separation Of Powers Doctrine In Wartime, Ryan Mckaig
Aid And Comfort: Rasul V. Bush And The Separation Of Powers Doctrine In Wartime, Ryan Mckaig
Campbell Law Review
By failing to recognize the challenges facing political and military leaders in the wake of the September 11, 2001 attacks, in reversing fifty-four years of precedent relied upon by the executive branch, and in failing to consider the political question doctrine, the Supreme Court in Rasul charted a dangerous constitutional course that could lead to greater judicial involvement in war-making powers and greater levels of conflict among the three branches. These trends will ultimately threaten the nation's ability to fight and win future wars. The decision is ill-advised, ill-timed, and invites unintended consequences.
