A Long Time Gone: Post-Conflict Rural Property Restitution Under Customary Law, Sandra F. Joireman, Laura S. Meitzner Yoder 2016 University of Richmond

A Long Time Gone: Post-Conflict Rural Property Restitution Under Customary Law, Sandra F. Joireman, Laura S. Meitzner Yoder

Political Science Faculty Publications

Mass displacement of people due to violence poses a unique set of challenges for property restitution when people return to their homes after a long absence. This is particularly evident in rural areas where the dominant form of land holding is customary tenure. Violence-induced displacement, unlike voluntary migration, challenges both customary and public legaladministrative structures. The lack of written documentation of customary holdings and the importance of the support of community leaders means that incorporating returnees back into a community can be easier for those who choose to return, while reclaiming property without physical return is nearly impossible. This article …

Their Brothers' Keepers? Ethnicity, Rebel Diplomacy, And State Support For Insurgency, Connor Somgynari

Honors Theses

This thesis aims to contribute to the filling of a theoretical lacuna by asking: what role do ethnic ties play in rebel groups' efforts to lobby for state support? Researchers have examined many facets of state support for armed rebel groups. Most literature on this topic has been dedicated to decision calculi of states choosing to support rebel groups. However, comparatively little has been said about the other side of this relationship: the demand for these goods and services by rebel groups themselves. Salehyan, Gleditsch, and Cunningham (2011) introduce the concept of the demand side into the literature, maintaining that …

Exploring Small Business Strategies To Comply With The Foreign Corrupt Practices Act, John Palmer

U.S. aerospace companies are estimated to lose more than $25 billion in international contracts per year due to bribery. These losses create Foreign Corrupt Practices Act (FCPA) compliance strategy challenges for U.S. aerospace companies' management. The purpose of this single case study was to explore strategies that U.S. aerospace small business leaders use to comply with the FCPA. The conceptual framework for this study was the regulatory compliance conceptual model, which suggests that small business leaders must gain deeper insight into how corporate compliance policies address the FCPA requirements. The target population for this study was leaders of a small …

The Influence Of Economic Ideologies On U.S. K-12 Education Policy: Testing, Markets, And Competition, Corinna M. Svarlien 2016 Scripps College

The Influence Of Economic Ideologies On U.S. K-12 Education Policy: Testing, Markets, And Competition, Corinna M. Svarlien

Scripps Senior Theses

The Elementary and Secondary Education Act (ESEA) was first passed in 1965 and has since been reauthorized several times, including as No Child Left Behind in 2001 and the Every Student Succeeds Act of 2015. The ESEA seeks to address the needs of low-income students; however, decades of reform efforts and government reports documenting inequality have done little to close gaps in educational resources or outcomes for marginalized groups. Accountability systems based on standardized testing are seen by policymakers on the Left and Right as the best way to improve education for marginalized groups, improve students’ economic preparedness, hold schools …

No Child Left Behind Leaves Behind English Language Learners, Daniela A. Canas Baena 2016 Scripps College

No Child Left Behind Leaves Behind English Language Learners, Daniela A. Canas Baena

Scripps Senior Theses

Goals 2000 and No Child Left behind have developed a new timeline for language acquisition, have promoted the practice of teaching to the test rather than the understanding of content, and High School Exit Exams have led to the widening of the achievement gap between ELL students and their Non-ELL counterparts. In additions, the policies’ narrow definition of success leads to federal sanctions that penalize schools with ELL student populations further contributing to the widening of the gap.

Crackdown And Consent: China’S War On Terror And The Strategic Creation Of A Public Discourse In The U.S., Kehaulani R. Jai 2016 Scripps College

Crackdown And Consent: China’S War On Terror And The Strategic Creation Of A Public Discourse In The U.S., Kehaulani R. Jai

Scripps Senior Theses

Scholars have extensively detailed China’s conflation of the Uyghur issue in Xinjiang with the international war on terror following September 11, 2001. Less studied is how the U.S. responded to China’s framing of the Uyghur as terrorists, and of the Chinese government’s characterization of Xinjiang as a region fraught with violence and extremism. On the whole, scholars who have addressed this latter issue conclude that China successfully coopted the U.S., and consequently cracked down on Xinjiang without substantial international outrage. On the basis of a review of official U.S. documents before and after 9/11, I argue that the U.S. response …

Can We Really Claim ‘Full Responsibility’? The Problem With Normative Luck Egalitarianism In A Luck-Pervasive World, Emilie Ho 2016 Scripps College

Can We Really Claim ‘Full Responsibility’? The Problem With Normative Luck Egalitarianism In A Luck-Pervasive World, Emilie Ho

Scripps Senior Theses

In the last four decades, luck egalitarianism has emerged as a hotly debated theory of distributive justice. The tenet, in its most normative sense, calls for distribution or assistance when circumstances of disadvantage arise from bad luck that is independent of human influence. Disadvantages that can be traced back to individual choice and responsibility, on the other hand, are left for the sufferer to bear. In this paper, I argue that luck egalitarianism should be abandoned as a standard for determining whether a disadvantage should be addressed, because the assumption that there are instances of disadvantage completely attributable to individual …

To Trade Or Not To Trade: Public Opinion And Trade Liberalization In Chile, Nicholas J. Surkala Ii

Chile has been used as a model for successful trade liberalization in Latin America, and is the country analyzed in this paper.

The public opinion data gathered from Latino Barometer surveys will …

The Responsibility To Protect And United States Intervention In The Libyan Civil War (2011), Paul Tang Abomo 2016 Loyola University Chicago

The Responsibility To Protect And United States Intervention In The Libyan Civil War (2011), Paul Tang Abomo

Dissertations

ABSTRACT

On April 6, 1994, Rwandan president Juvenal Habyarimana’s plane was shot down. Soon after, there were reports that massive ethnic-based violence was unfolding, and the only way to stop it was the presence of an outside military force. The Clinton administration knew Rwanda was being engulfed by genocide but ignored the information to justify its inaction. Seventeen years later, on 15 February 2011, the arrest of Mr. Fathi Terbil, a well-known lawyer and human rights defender by the Libyan internal security forces (Jihaz al-Amn al-Dakhili) sparked a mass protest in Benghazi, Libya. When demonstrations began the Gaddafi government responded …

How Many Lightbulbs Does It Take To Change The Financial System? Economic Ideas And Financial Regulation, 1846–2007, Michael Lee 2016 CUNY Hunter College

How Many Lightbulbs Does It Take To Change The Financial System? Economic Ideas And Financial Regulation, 1846–2007, Michael Lee

Publications and Research

Ideas may impact economic policy change, but their specific effects are difficult to untangle. Material factors may influence both ideational change and policy change. In order to study these complex interrelationships, this article looks at the impact of both ideational change (the rise and fall and rise of free-market economics) and material factors (competitive pressure, crises, and domestic politics) on financial regulatory change and on one another in the United Kingdom and United States since 1846. Using a vector error correction model, I find that elite ideas influenced regulation in Britain, but not the United States. Material factors exhibited more …
