This project reflects the process of writing and attempting to pass state legislation, Legislative Bill 519, as a college student. LB 519 is an immunity policy for certain drug and alcohol charges that would be potentially prohibitive to a survivor or witness of sexual assault reporting the crime. The first several sections cover the process of developing and introducing legislation. These sections cover the process of developing the idea for LB 519 and the thought process behind the language and structure of the bill. Within the American criminal legal system, it is a well-established practice to presume the innocence of those charged with criminal offenses unless proven guilty beyond a reasonable doubt. Such a judicial framework-like approach, called a legal maxim, is utilized in order to ensure that the law is applied and interpreted in ways that legislative bodies originally intended.

The urban/rural divide is pervasive in policy-making in Nebraska. In this nonpartisan state, coalitions based on spatial identity or whether the legislator is urban or rural seem to have greater weight than party especially in the creation of economic development policy. Often, economic development policies include locational considerations which give areas such as rural areas and economically distressed areas greater weight when distributing program funds. In my study, I investigate whether constituency or party has a greater impact on the legislative behavior of Nebraska state legislators when voting on economic development and environmental legislation. In recent years, civil society has risen to speak on behalf of underrepresented groups in Africa. In particular, civil society has advocated for the representation of women’s interests (Tripp et al. 2008). Yet, relatively little is known about the full range of actors who seek the representation of women’s interests, mobilize around women’s issues, and articulate specific preferences.1 Some of these actors include not only feminists, but also religious activists who may clash over women’s issues. Policy diffusion research pays virtually no attention to policy content. Yet we should expect content to shape the adoption of any policy--this is what legislators and policy makers, after all, fight about. Thus the extent and speed of diffusion likely critically depend on policy content, which the current literature virtually ignores. This dissertation shows how we can better understand policy diffusion by taking policy content seriously. Prior models of the policy process have examined how human characteristics can affect policy decision-making in such a way that it leads to aggregate effects on policy outcomes as a whole. I develop a model of the policy process which suggests that emotions related to fair and unfair experiences in the same policy domain are utilized by decision-makers as policy criteria. In the lab, I empirically tested this, and find that emotions and experience related to fairness do influence the policy decision to move away from the status quo alternative.
