In September 1977, the State Department of Employment Security mailed out forms to every municipality on which to designate whether a particular municipality was to be treated as a "taxpaying" employer or a "reimbursement" employer. To assist cities in making this judgment decision, MTAS provided the following analysis prepared by Dr. Ed Young, Director of Policy Development of the Tennessee Municipal League.

Around September 1, 1977 the Tennessee Department of Employment Security mailed to each city in Tennessee a packet of informational material and forms related to municipal administration of the unemployment compensation insurance program for public employers which becomes effective January 1, 1978. The primary purpose of this Technical Bulletin was to alert city officials to the immediate necessity of determining whether the city would be a "taxpaying" or "reimbursing" employer.

On Oct. 20, 1976, President Ford signed into law Public Law 94-566, the Unemployment Compensation Amendments of 1976, which had been passed overwhelmingly by both houses of Congress. The Tennessee General Assembly, by adopting chapter 330 of the Public Acts of 1977, has acted to comply with the federal law. This Technical Bulletin addresses some questions about the unemployment compensation insurance program.

This Technical Bulletin discusses two different sets of federal government guidelines for employee selection procedures. One set is a re-publication of EEOC guidelines first issued in 1970. Another, in which EEOC does not concur, was issued jointly in November 1976 by the Labor and Justice Departments and Civil Service Commission. Both sets apply to local governments.
