Management-Based Regulation: Prescribing Private Management To Achieve Public Goals, Cary Coglianese, David Lazer

We analyze a little-studied regulatory approach that we call "management-based" regulation. Management-based regulation directs regulated organizations to engage in a planning process that aims toward the achievement of public goals, offering firms flexibility in how they achieve public goals. In this paper we develop a framework for assessing conditions for using management-based regulation as opposed to the more traditional technology-based or performance-based regulation. Drawing on case studies of management-based regulation in the areas of food safety, industrial safety, and environmental protection, we show how management-based regulation can be an effective strategy when regulated entities are heterogeneous and regulatory outputs are …

This report’s primary concern is how U.S. state governments should respond to the fiscal volatility created by their balanced budget constraints. Applying the principles of risk allocation theory to this recurring problem, we conclude that states should primarily adjust the rates of broad-based taxes as their economies cycle, rather than fluctuating public spending.

The last two decades have witnessed a proliferation of scholarly discourse on performance management. This discourse evolved out of a number of forces in the early 1990s from the new public management movement, which called for government to show its efficiency in expending public resources as well as prove that substantive results—or outcomes related to a program‘s effectiveness—had been generated by its activities. In addition, Osborne and Gaebler‘s (1992) 161 Reinventing Government echoed a revolutionary change in conventional wisdom by deploying words such as "reengineering," "entrepreneurial management," "empowerment," and "privatization". Senior centers off#11;er a variety of services to facilitate independent living of older adults. In the U.S., increasing suburbanization and aging of suburban residents necessitate reconfiguring senior services. We propose a two-echelon network of senior centers across large study areas and formulate a stochastic facility location/allocation model with mixed-integer recourse. We apply our model to Allegheny County, Pennsylvania, which has one of the oldest population in the U.S. Our model shows that a two-echelon network design is appropriate for increasing the occupancy of senior centers as community focal points while maintaining customized and accessible programming in small neighborhood areas.

Punctuated equilibrium theory in public policy replicated from biological punctuated equilibrium theory has concluded that public policies alternate between stasis and punctuation. However, recent research on Pacific Northwest forest policy, U.S. state tobacco policy, and U.S federal auto efficiency policy have found no punctuations despite an attempt to do so. What is the efficacy of using biological punctuated equilibrium theory to also explain punctuated equilibrium in public policy? From Undemocratic To Democratic Civil Society: Japan's Volunteer Fire Departments, Mary Alice Haddad

How do undemocratic civic organizations become compatible with democratic civil society? How do local organizations merge older patriarchal, hierarchical values and practices with newer more egalitarian, democratic ones? This article tells the story of how volunteer fire departments have done this in Japan. Their transformation from centralized war instrument of an authoritarian regime to local community safety organization of a full-fledged democracy did not happen overnight. A slow process of demographic and value changes helped the organization adjust to more democratic social values and practices. The way in which this organization made the transition offers important lessons for emerging democracies …

Following the Bush Administration, the Obama team enhanced access for citizens to participatory venues. Extending and enhancing access gives citizens opportunity to develop their citizenship skills, potentially influence policy, and potentially become better connected to community life. The Administration can be applauded for participatory innovations, but the Administration needs to proceed strategically to ensure the innovations do not produce more harm than good and to ensure that the real change they are producing is not whisked away in the next Administration as rapidly as an information cascade infects the citizenry. The original studies of organizational red tape (Waldo 1946, Kaufmann 1977) emphasize that worker perceptions of organizational rules and procedures are dependent on workers’ frames of reference. However, most subsequent study has not accounted sufficiently for how these reference points vary across workers, even if they work in the same or similar organizational context. While the effects of contemporaneous worker attitudes on perceptions of red tape have been considered in numerous studies, unexamined is how perceptions of organizational rules and procedures as red tape are related to workers’ prior work experiences. What are the attitudes of public managers who have had full-time private sector work experience? Public managers with private sector work experience report different perspectives when compared to their counterparts who have spent their entire careers in the public sector. Though private sector work experience negatively correlates with job satisfaction, it only does so for the “new switcher,” whose last job was in the private sector. As careers advance, the negative impact seems to wane, leaving a public sector workforce that, in part as a result of their private sector work experience, are relatively more intrinsically motivated and involved in …

Poinciana, Florida is a growing community in Central Florida. The master homeowners association contracted for an incorporation feasibility study to determine whether Poinciana could survive as a city. This article describes the public participation process designed and implemented as part of the feasibility study and articulates the goals, principles, and venues of the design, the challenges or barriers confronted, and suggestions for revisions to statutory guidelines for incorporation are described with the purpose of moving towards the institutionalization of public participation as a cultural norm.

The promotion and support of urban agriculture (UA) has the potential to contribute to efforts to address pressing challenges of poverty, under nutrition and sustainability among vulnerable populations in the growing cities of sub-Saharan Africa (SSA). This may be especially relevant for HIV/AIDS-affected individuals in SSA whose agricultural livelihoods are severely disrupted by the devastating effects of the disease on physical productivity and nutritional well-being.
