Plaintiffs have made several notable attempts to bring nuisance, trespass, and negligence suits against major sources of greenhouse gas emissions for climate change related injuries. While climate change is a widely recognized environmental issue, courts have refused to recognize it as a basis for a valid cause of action in tort, finding either petitioners lack standing to bring the claim, or that the claim raises political questions that should not be addressed by the judiciary. Some more recent climate change tort claims have also included allegations of fraud on the part of the hydrocarbon industry for actively perpetuating misinformation about …

This paper considers the Australian federal government’s approach to climate adaptation policy for remote northern Indigenous communities through the close examination of a seminal Scoping Study. This approach is taken to illustrate the lag between adaptation theory and practice, and to highlight important considerations to enable the development of a just and effective policy. The analysis suggests that policy in this area would benefit from the further consideration of three factors, namely the role of uncertainty in climate policy, the need for meaningful consultation with communities, and the benefit of integrating contextual and bottom-up assessment of vulnerability with decision-making in …

Global environmental change such as climate change and the degradation of ecosystem services is heightening risks and reducing opportunities, especially for poor and vulnerable populations. Such change is taking place in an increasingly globalized, urbanized, interconnected and fast-moving world amidst shifting geopolitical power balances. This paper demonstrates how using the word "carbon" within global warming debates severely impedes lobbyists in favor of building stronger renewable energy policies in the European Union (EU). Within the EU, carbon is widely used to speak about many of the perils of climate change, global warming, energy policy, and contingent subject matters. In political circles, media outlets, and public debates, carbon acts a the pillar for many policies, discussions, and ideas related to fundamental errors of transferring energy from fossil fuels and nuclear sources. Competition for scarce Colorado River water resources is nothing new, but the conflicts that prompted the seven basin states to negotiate the 1922 Colorado River Compact have grown considerably fiercer and more complex in recent decades. In 2007, responding to the challenges of increasing demand and sustained drought, the seven basin states and a number of other affected interests agreed to a set of interim guidelines for allocating Colorado River water in the event of shortages. This article argues that two principal forces have contributed to this development. The largest known oil shale deposits in the world are in the Green River Formation, which covers portions of Colorado, Utah, and Wyoming. Fully one-half of the world’s oil shale lies within 150 miles of Grand Junction, Colorado, and about 80% of these reserves are on federal land. Estimates of recoverable reserves in the Green River Formation range from 500 billion to 1.53 trillion barrels. At present consumption rates, this is enough oil to satisfy 100% of U.S. demand for well over 100 years.

The relationship between R&D investments and technical change is inherently uncertain. In this paper we combine economics and decision analysis to incorporate the uncertainty of technical change into climate change policy analysis. We present the results of an expert elicitation on the prospects for technical change in carbon capture and storage. We find a significant amount of disagreement between experts, even over the most mature technology; and this disagreement is most pronounced in regards to cost estimates. We then use the results of the expert elicitations as inputs to the MiniCAM integrated assessment model, to derive probabilistic information about the …
