The Mine Action Information Center at James Madison University has partnered with a British EOD consultancy company, C King Associates Ltd, to conduct a preliminary study into the effects of aging on landmines. This project entailed examination and disassembly of several types of anti-personnel mines, a literature review of relevant material and analysis of the initial findings.

The study confirms a fairly obvious assumption: The characteristics of mines change significantly as they grow older. However, while this situation is constantly observed in the field through the recovery of rotted, rusted and damaged mines, it has never been adequately investigated. The …

First Nations in Canada are seeking new land management relations that fully include and accommodate their Aboriginal rights, any outstanding Aboriginal title, and other interests. Various Canadian judicial decisions have stated that, at a minimum, consultation with First Nations is required when Aboriginal rights may be impacted by land-use activities. This research involved applying case study to identify critical elements that lead to something deeper than mere consultation, as called for in the 1997 Supreme Court of Canada Delgamuukw decision. This thesis describes six land management cases from four First Nations communities in British Columbia. The cases involve natural resources …

Are residents living in communities around the Nevada Test Site aware of environmental remediation activities and do outreach efforts contribute to awareness? Through a U.S. Department of Energy (DOE) grant, the University of Nevada, Las Vegas administered a mail questionnaire to 14,083 residents and received 1,721 responses. Approximately 90% of the respondents reported awareness of past nuclear tests at the Nevada Test Site; 63% reported awareness of low-level radioactive waste disposal at the site; and 41% are aware that the Yucca Mountain Project for high level waste disposal is part of the Office of Civilian Radioactive Waste Management and not …

Until recently, wetlands had value in the marketplace only as targets for destruction. Today, wetlands often have market value for uses that do not require that they be dredged and filled. Such opportunities include: 1. Carbon storage offsets for greenhouse gas emissions; 2. Mitigation banks for destruction of other wetlands; 3. Conservation banks for wildlife protection; 4. Tradable water quality protection rights; 5. Sites for growing algae or other biofuel crops. These new uses have valid public benefits, but most laws and ordinances were not written with these possibilities in mind. Planners and lawyers need to think about ways to …

The supply chains through which foods are produced, processed, and transported can have a significant impact on the environment in terms of the carbon dioxide (CO2) that is emitted during each of these phases; however, little research has incorporated information about environmental impact into supply chain scenarios. Moreover, many consumers are unaware of how their food choices may impact the environment in this way. To fill these gaps, a tool called CarbonScope was developed to show consumers the CO2 emissions associated with different food types and food transportation scenarios. These comments were given by Professor Hope Babcock on April 17, 2008 for the fourteenth annual Lloyd K. Garrison Lecture on Environmental Law at Pace Law School.

In this lecture, Professor Babcock argues that the problem confronting us is that we are nearing the end of achieving future gains in pollution abatement from traditional sources and the pollution that remains is largely caused by individual behavior. This she says, is true even though polls show that people consistently rate protecting the environment among their highest priorities, say they are willing to pay more to protect environmental resources, and indeed, faithfully …

This article addresses the problem of how to set caps for a cap-and-trade program, a key problem in pending legislation addressing global climate disruption. Previous scholarship on emissions trading programs focuses overwhelmingly on trading’s advantages and sometimes wrongly portrays environmental improvement as an automatic byproduct of adopting a cap-and-trade approach. A trading program’s success, however, depends critically upon timely and effective cap setting.

This article shows that often regulators have employed a best available technology (BAT) approach to cap setting for trading programs, i.e., setting the cap at a level that regulated polluters can achieve with government-identified technology. This descriptive …

This book chapter reviews the influence on economic thought about instrument choice and its influence upon United States climate change policy. It shows that the theory of instrument choice made a positive contribution to the United States policy arsenal by emphasizing the cost effectiveness advantages of emissions trading. But because of an ideological climate uncritically supportive of free markets prevailed during the period of U.S. failure to address climate change, the United States favored overly broad trading programs, both in terms of geography and scope. It is well established that ageing handicaps the ability of prey to escape predators, yet surprisingly little is known about how ageing affects the ability of predators to catch prey. Research into long-lived predators has assumed that adults have uniform impacts on prey regardless of age. Here we use longitudinal data from repeated observations of individually-known wolves (Canis lupus) hunting elk (Cervus elaphus) in Yellowstone National Park to demonstrate that adult predatory performance declines with age and that an increasing ratio of senescent individuals in the wolf population depresses the rate of prey offtake. Koblmuller et al. (2009) analyzed molecular genetic data of the wolf in the Great Lakes (GL) region of the USA and concluded that the animal was a unique ecotype of grey wolf and that genetic data supported the population as a discrete wolf taxon. However, some of the literature that the researchers used to support their position actually did not, and additional confusion arises from indefinite use of terminology. Herein, we discuss the problems with designation of a wolf population as a taxon or ecotype without proper definition and assessment of criteria.

Wolves, Canis lupus, on Ellesmere Island traveled a daily round-trip distance of 40.2 km from their den to a landfill during July 2008, plus an undetermined distance hunting after leaving the landfill. Although long travels by Wolves are well known, this appears to be the first documentation of long daily movements by Wolves rearing pups.

This article evaluates an environmental protection instrument that the literature has hitherto largely overlooked, Dirty Input Limits (DILs), quantitative limits on the inputs that cause pollution. DILs provide an alternative to cumbersome output-based emissions trading and performance standards. DILs have played a role in some of the world's most prominent environmental success stories. They have also begun to influence climate change policy, because of the impossibility of imposing an output-based cap on transport emissions. We evaluate DILs' administrative advantages, efficiency, dynamic properties, and capacity to better integrate environmental protection efforts. The use of science has become an important practice in the decision making process of many federal agencies. Many different types of scientific information are used to make decisions within the EPA, with computer models becoming especially important. Environmental models are used throughout the EPA in a variety of contexts and their predictive capacity has become highly valued in decision making.

Increasing economic globalization has coincided with the emergence and escalating influence of non-state actors and organizations in domestic and international policymaking, from shaping policy agendas to promoting private authority. The latter phenomenon has arisen, at least in part, from a critique of states' failures to adopt effective and enduring environmental policies. Rather than contest "command and control" institutions, non-state strategies embrace market approaches built around incentives and price mechanisms. Several forms of non-state authority have emerged, including corporate social responsibility, provision of information through labeling, and self-reporting.
