Environmental law in the United States comprises a complex patchwork of federal, state, and local statutes and regulations, along with the traditions of common law. Most statutory environmental programs emerged in the second half of the twentieth century. Resolving Conflict Between Canada’S Indigenous Peoples And The Crown Through Modern Treaties: Yukon Case History, Kirk Cameron

This article presents an example of how modern treaties with Yukon First Nations have created a foundation for co-relational involvement in the direction and control of land and resource management throughout Canada’s subnational region of Yukon, approximately 470,000 square kilometers in size. The modern treaties with eleven of the fourteen Yukon First Nations create assessment and management structures where appointment to these bodies are nominations not only from the territorial and federal governments but from the Yukon First Nations. The rights captured in the treaties are protected under Canada’s supreme law, the Constitution Act, 1982. The treaty relationship has effectively …

This article contextualizes intractable conflict within the lived experiences and worldviews of an Indigenous person, imbued with academic and scholarly research. The text illustrates how intractable conflict is experienced within the “developed world,” resulting in both freedom and fragmentation. Whether intractable conflict stems from colonial and postcolonial development and influences current Indigenous Peoples’ self-development efforts in Canada, specifically, and possibly across British colonies in general seems to be a new inquiry. The author relates her intergenerational experiences of contact, unpacking research and development in its many forms alongside the characteristics of intractable conflict and related federal Indian and social policy. …

There is a growing appreciation that conflict and violence in many communities have their origins in a history of traumatic experiences. Why this link exists and how it comes about is still unclear. We have no unified psychology of traumatized communities, and little is known about how to address these traumatic origins collectively in these communities. This article proposes a psychodynamic model of collective trauma and a psychoanalytically informed approach to working with traumatized communities to address their issues of conflict and violence. This paper offers a comprehensive political history of the Rhode Island Earned Income Tax Credit (EITC) and an analysis of Rhode Island EITC recipients. It explores the history of the Rhode Island EITC, an income subsidy available to low-income workers, from its introduction in 1975 through 2018. It details the forces behind expansions and reforms and the effects of those changes. It also analyzes microdata to construct a profile of current EITC recipients. The Patient Protection and Affordable Care Act (ACA) sought to improve the United States’ long-term services and supports (LTSS) system by expanding home and community-based services (HCBS). The ACA contained several optional Medicaid HCBS opportunities for states, including the Balancing Incentive Program, the 1915(k) Community First Choice personal care benefit, and the revised 1915(i) state plan benefit. This research examined these HCBS provisions to explain what factors determine whether states participate in the ACA’s new HCBS programs and, after adoption, what factors facilitate or impede implementation of these programs. This report is an examination of parking, curb zones, and government service changes in the context of AVs. Given that there are very few actual AVs on the road, the analysis in this report is an attempt to project what we might see, using the current phenomenon as starting points. The report uses a mix of econometric modeling, cost accounting, and case studies to illustrate these projections. The first section of this report looks at the effects of transportation network companies (TNCs)—Uber and Lyft in particular—on parking revenue in the city of Seattle. The electric bicycle (e-bike) is a low emission mode of transportation that offers communities benefits in the areas of health, planning, time, cost, street safety, congestion, air pollution, noise pollution, and energy security (Blondel, Mispelon, and Ferguson 2011). In a recent study conducted by Portland State University, e-bikes have been found to enable more people to ride a bicycle for longer distances despite physical limitations, difficult terrain, and the presence of cargo (MacArthur et al. 2018). California Rural Legal Assistance is a nonprofit law firm that provides no cost legal services to low-income individuals in Santa Cruz County. The social problem is that too many workers face employment rights violations. The agency problem is a reduction in the number of people seeking employment legal services from CRLA. This outreach project focused on spreading awareness of CRLA’s employment legal services by attending local grocery stores and farmer’s market, with the purpose of promoting agency’s services to the community. This article puts forth a “4M Way” of dealing with the threat of violent Islamist extremism in Southeast Asia. It argues that our narrative must be fundamentally more attractive to the target audience than the competing vision of the violent extremists. The memes that constitute our narrative in the social media space must be “stickier” than those of the violent extremists. The personal credibility of our messenger in the eyes of the target audience should exceed that of extremist ideologues vis-á-vis that same audience. Using a cross-comparative, qualitative case study approach, my research seeks to determine whether the presence of American Indian teachers (passive representation) positively influences educational access and performance of American Indian students in two rural Idaho public school districts located within tribal reservations. One district has representation of American Indian teachers and the other does not. Essential to the stages within the policy process are the individuals who create, implement, and correct public policy. In an effort to understand the effectiveness of the North American Free Trade Agreement, the author uses previous academic literature to assesses the success of the North American Free Trade Agreement’s primary and peripheral goals. To understand how North American citizens, perceive NAFTA and their future relationship with one another, the author uses survey data to analyze attitudes of American and Mexican citizens towards trade liberalization (NAFTA) and labor mobility. Regression analysis reveals that there is a positive relationship between labor mobility and trade liberalization for Mexican citizens but not for American citizens. This article will profile the innovative community engagement process initiated by the "Be the Peace, Make a Change" project to end gender-based violence in Lunenburg County, Nova Scotia, and conclude with lessons learned. These lessons were summarized as "headlines" to imagine a future with new narratives for interpersonal relationships. This project was a three-year grassroots initiative of Second Story Women’s Centre, funded by Status of Women Canada. The Clash Of Civilizations? Statistical Evidence From Armed Conflicts, 1989-2015, Afa'anwi M. Che

Do armed conflicts in the contemporary post-Cold War period reflect a clash of civilizations (CoC) as predicted by Samuel Huntington? This study substantially broadens and temporally extends the scope of major extant quantitative tests of the CoC thesis by assessing not only interactions among states but also interactions between states and non-state armed groups, from 1989 to 2015. Based on Chi-square and logistic regression tests, this study does not find empirical support for the CoC thesis as a basis for adopting foreign policies of civilizational containment.
