After reviewing the progress of the Clark County GIS Vulnerability Project to date, it appears to me that now is an appropriate time to look to the end of the project, and use that to shape the next several steps. The NOAA guidelines may still have use, but it is more important that the project make progress than that it meet particular prescriptive steps.

Legislative/Judicial Interaction: Do Court Ideologies Constrain Legislative Action?, Elizabeth A. Stiles, Lauren L. Bowen

Political Science

This paper seeks to contribute to our understanding of the degree of success enjoyed by bills in state legislatures. More specifically, we propose a model of bill success that includes a measure of judicial preferences such that we can ascertain the extent to which judicial ideology and perceived judicial climate constrain legislative behavior. We argue that liberal bills are less likely to be enacted in states where the court of last resort is also liberal as opponents will be concerned that the high court will read the legislation too expansively. There is, thus, additional incentive to mobilize to prevent passage …

Nearly 14 million Americans have serious problems because of their drinking including eight million men and women who suffer from alcoholism, a chronic disease. Alcoholism can be clinically diagnosed and people with the disease typically experience many additional alcohol-related medical complications. Research demonstrates that treatment can save lives, restore families, reduce health care costs, increase productivity in the workplace and make our communities safer.

Many persons with significant disabilities are unable to obtain health insurance in the private sector that provides coverage of the services that enable them to live independently and enter, remain in, or rejoin the workforce. For individuals with disabilities currently receiving health care under Medicaid, the fear of losing their health care and related services is one of the greatest barriers keeping such individuals from maximizing their employment, earnings potential, and independence. This Issue Brief examines managed care corporate failures and the legal process. Managed care organizations are corporate hybrids that possess the features of both insurance and health care. As a result, the question of whether the proper legal forum for addressing a failure is the federal bankruptcy process or state insurance insolvency procedures is a complex one. The answer to this question is more than academic: legal protections for purchasers, members, and health care providers differ significantly depending on which legal system is used.

Transportation modal choice for the Air Force retrograde movement of reparable assets within the CONUS is inflexible and is not synchronized with the depot repair process. Additionally, transportation coordinators are compelled by unsynchronized priorities and shipping policies to use express air modes in all cases when the use of LTL modes may be available to meet actual service level requirements at a lower cost, There may be cases where the retrograde shipments of reparable assets via an alternative transportation mode, such as LTL, can still meet fast transportation requirements at an even lower cost than can premium transportation. The author argues that the U.S. and its partners have rightly arrived at war on Iraq as a just and necessary last resort. The potential problems with the just-war case are notable, particularly concerning the after-effects of the war, but they do not incurably undermine the case for going to war. Instead, both supporters and critics of the war around the world should strive to keep their governments committed to post-war reconstruction and a transition to a free and stable government in Iraq. HQ AFMC has consistently experienced problems with the Second Destination Transportation budget being under funded. This under funding causes the command to implement control actions on how funds are allocated to ensure that enough funds are available. This research effort was intended to show the relationship between spending restrictions and how vehicles move between theaters. Current infrastructure network models of single functionality do not typically account for the interdependent nature of infrastructure networks. Infrastructure networks are generally modeled individually, as an isolated network or with minimal recognition of interactions. This research develops a methodology to model the individual infrastructure network types while explicitly modeling their interconnected effects. The result is a formulation built with two sets of variables (the original set to model infrastructure characteristics and an additional set representing cuts of interdependent elements). This formulation is decomposed by variable type using Benders Partitioning and solved to optimality using a Benders Partitioning algorithm. Current infrastructure …

Testimony which will focus on the scope of the legislation's proposed shield against noneconomic damages with respect to the plaintiffs whose claims would be affected, the corporate defendants that would benefit from the shield, and the types of injuries that would be shielded. This measure is so vast in scope that it reaches every conceivable health care claim against every health care corporation or manufacturer of health care products, regardless of whether the violation of law in question bears any relationship to what would reasonably be considered the types of injury commonly associated with the concept of medical liability.
