Drawing A Line Between Killing And Letting Die: The Law, And Law Reform, On Medically Assisted Dying, Lawrence O. Gostin

Traditional medical ethics and law draw a sharp distinction between allowing a patient to die and helping her die. Withholding or withdrawing life sustaining treatment, such as by abating technological nutrition, hydration or respiration, will cause death as surely as a lethal injection. The former, however, is a constitutional right for a competent or once-competent patient, while the latter poses a risk of serious criminal or civil liability for the physician, even if the patient requests it.

No need to lament the fate of Mr. Dysart, who does seem to have been a well-intentioned fellow.

The point of relating Dysart's travails is to bring to life, through one illustration, the American legal and constitutional tradition governing sexual immorality, from the founding until the 1960's.

Dysart's lawyers made no constitutional claim. The Supreme Court raised none of its own. The Justices did not even question their prior test for "obscenity." They simply declared that Dysart remained on its safe side, that as a matter of law the notices were not obscene.

I agree with the Supreme Court's conclusion. …

The Americans With Disabilities Act And The Corpus Of Anti-Discrimination Law: A Force For Change In The Future Of Public Health Regulation, Lawrence O. Gostin

In this paper the author reviews the constitutional history of the courts' attempts to check the powers of the public health department. He demonstrates how ineffective and inconsistent constitutional review has been, and suggests that adequate review criteria have not emerged. The author shows that, whether the courts are applying First, Fourth, or Fourteenth Amendment standards, ultimately they are highly deferential to public health officials. Then he carefully examines the key concepts in the Americans with Disabilities Act (ADA) as they apply to communicable disease. He reveals Congress' clear intention to include communicable disease, even asymptomatic infection, as a disability. …

This essay serves as the foreword to Implementing U.S. Health Care Reform, a symposium held in 1993.

The exact specifications of the new health care system depend on the package that President Clinton will send to Capitol Hill and the changes that Congress will make in the reform package. Some of the basic structures and organizing principles of the new system that are being considered by the President are already the subject of intense public scrutiny.

The Cost Of Home Ownership In Vermont, 1975-1990, Arthur G. Woolf

New England Journal of Public Policy

Housing prices in Vermont, like those in the other New England states, shot up dramatically during the economic boom of the 1980s. This article investigates the causes of that price increase and focuses on the cost of home ownership in Vermont in the years 1975 to 1990. Cost of home ownership is defined as the percentage of family income needed to finance an average-price home. Although prices skyrocketed during the 1980s, the actual cost of home ownership as a percentage of income was about 15 percent greater in 1990 than it was during the mid-1970s. The Charter Of Rights And Public Policy In Canada, Patrick J. Monahan, Marie Finkelstein

Much of the literature on the Charter has focused on the manner in which the courts have interpreted the document. This essay examines the Charter from another perspective-its impact on the policy process within government. Drawing on a series of papers prepared by senior government officials at both the federal and provincial levels, the authors argue that the Charter has permanently changed the way in which governments formulate and implement public policy in Canada. Virtually all policy proposals making their way to the Cabinet table must be examined to ensure that they conform to the requirements of the Charter. This …

Examining a recent case in which the U.S. Supreme Court approved the collection of blood and urine samples from railroad employees, the authors conclude that, in attempting to improve railroad safety, both majority and minority opinions reflected undue emphasis on technical issues and inadequate attention to the intangible social values underlying traditional Constitutional rights to privacy.

Housing The Homeless Through Expanding Access To Existing Housing Subsidies, Barbara Sard

The premise of this article is that homelessness in America today is essentially a product of the lack of affordable housing for very low-income people. The article outlines this central income/housing gap analysis as the factual predicate of the goal to alleviate homelessness through securing subsidized housing resources for the homeless and imminently homeless. It explains why, based on the nature and number of annually available housing subsidies, expanding access to existing housing subsidies is a valuable, workable, short-term, at least partial solution to the immediate crisis of lack of affordable housing, albeit one which does not negate the acknowledged …

Shelter The American Way: Federal Urban Housing Policy, 1900-1980, Ronald Dale Karr

New England Journal of Public Policy

American urban housing policy has featured subsidies for the suburban middle class and parsimonious spending for the urban poor. The outlines of this policy took shape during the Progressive Era: acceptance of the capitalistic market economy, support for the deserving poor needing temporary help, toleration of racial segregation, and the designation of overcrowding as the single most important urban problem. Progressive housing reformers championed stricter housing codes and model tenements, but housing conditions for the urban poor showed little improvement.

The U.S. government avoided direct involvement in housing until the early 1920s, when it promoted local zoning legislation. Under the …

The Housing Crisis Enters The 1990s, Peter Dreier, Richard Appelbaum

New England Journal of Public Policy

Homelessness in the United States is a symptom of a much deeper economic and housing crisis — a widening gap between incomes and housing prices. With the end of the Cold War, the nation has the resources to solve these problems, but to do so it must mobilize the political will. This article examines the roots of crisis, the public policies and market forces that created it, and policy recommendations to solve the problem. Key to forging a solution is building the political coalition needed to create a broad public consensus.

The purpose of health insurance is to spread risk. The system works under the assumption that, at any given point in time, only a percentage of the people in a given group will be sick. Regardless of health status, all members of the group will be paying premiums in order to cover the cost of care for those who need it.

As a group, however, seniors represent a high-risk population. They are more likely than younger people to need health care services and tend to require longer hospital stays. Yet, while their expenses are greater, their financial resources are generally …
