On average, US citizens have experienced approximately 400,000 sexual assaults per year, which results in enormous immediate and long-term consequences for individuals, as well as society in general.

In the U.S., the principal method of combatting this crime has been the creation of Sex Offender Registries used to notify the public of the identity and location of convicted sex offenders who may be living in proximity to their residence. In addition to the Registry, laws have been passed forbidding convicted sex offenders from residing within buffer zones around areas of high child concentration [schools/parks/etc.].

Youth involved with the juvenile justice system often have a history of trauma and oppression resulting from their positionality and circumstances. Most juvenile justice-involved youth are boys, youth of color, low-income, LGBTQIA2S+, disabled, and traumatized. This literature review explores the history of the juvenile justice system, issues with the present-day model, and trauma-informed and transformative justice approaches to practice. The implementation of socially just, trauma-informed expressive arts therapy programs is proposed as a more equitable practice to replace commonly used punitive practices across the United States. The South Dakota Criminal Justice System suffers from a high recidivism rate across the state. There are few resocialization methods used within state facilities, and the existing ones have not adequately addressed what is causing the high rate. Over the past few decades, the largely hidden, secretive, and widely used system of plea bargaining has caught the fervent attention of scholars. The Shadow of the Trial model has been central to much of the plea-bargaining literature, despite significant critiques about its oversimplification. The model posits that defendants and their attorneys make plea decisions based largely on the estimated probability of conviction and the severity of the sentence to which the defendant could be exposed at trial.

The model, however, assumes that all actors are rational, equally risk averse, have no competing interests, and possess high predictive accuracy. It …

This dissertation investigates the underexplored relationship between character epistemology and its potential to explain behavior, decision-making, and culture within the criminal justice system, particularly the police. Building on the existing theoretical framework of evidence-based policing (EBP) and the recognized gap in understanding police receptivity to science, this study hypothesized that intellectual character at personal and collective levels positively correlates with science receptivity.

Epistemic character was defined through the aggregation of four traits: open-mindedness, defensiveness, insouciance, and groupthink. Science receptivity was measured by openness to change, desire to learn, reliance on intuition, and mistrust of science. Data were collected through surveys …

Defendants often plead guilty in exchange for reduced punishments. Some argue that these reduced punishments are necessary for the functioning of the criminal justice system, whereas others argue that they are inherently coercive because they place a burden on the exercise of constitutional rights. This potential coercion is of concern because the constitution requires valid guilty pleas to be made by defendants voluntarily. A policy's general deterrent effect requires would-be offenders to be aware of the policy, yet many adolescents do not know they could be registered as sex offenders, and even adolescents who do know may still commit registerable sexual offenses. We tested whether peer influences shape the perceived costs/benefits of certain sexual offenses and, subsequently, registration policy's general deterrent potential in a sample of policy-aware adolescents. The more adolescents believed their peers approve of sexting of nude images, the more likely they were to have sexted. Cultural stereotypes that link Black race to crime in the U.S. originated in and are perpetuated by policies that result in the disproportionate criminalization and punishment of Black people. The scientific record is replete with evidence that these stereotypes impact perceivers’ perceptions, information processing, and decision-making in ways that produce more negative criminal legal outcomes for Black people than White people. Much research has been completed on the forms of crime control theater (CCT), and the impact that the existence of CCT laws have on society. Research on CCT laws has shown that they are definitively unsuccessful in providing the safety they were created to provide. This thesis will utilize completed research to explain the main psychological phenomena holding people back from decreasing their support for CCT laws. It will also describe proven methods of correcting misinformation in order to change the perceptions of people who support crime control theater laws, and provide suggestions for how research should be continued.

Empirical studies have pointed to the increasing importance of procedural justice as a tool for improving the relationship between the police and local communities. The mediating role of procedural justice continues to be embraced by scholars, practitioners, and community members; as a result, we examine in the present study African Americans’ attitudes toward the police via the interpretive lens of procedural justice policing. Using procedural justice questions found in the social-psychology literature, we interviewed seventy-seven African Americans in Durham, NC, to assess their views about the U.S. police. This dissertation examines how psychedelic substances become drawn into particular sociohistorical and political arrangements, and how psychedelic experiences with psilocybin ‘magic mushrooms’ are used as tools of subjectivation. Guided by literatures in philosophy, critical theory, and the social sciences that focus on subjectivity, assemblage theory, and critical posthumanism, I argue that psychedelics are drawn into variegated assemblages, each of which conceptualizes the nature of psychedelics in highly specific ways that reflect implicit conceptions of the world and the self. In developing the concept of psychedelic assemblages, this research provides a window onto the politics of the self in the Anthropocene. …

Despite the low rate of discretionary parole release in New York, much is still unknown about the processes underpinning parole decisions. The present paper delves into how aggravating and mitigating parole case characteristics (e.g. institutional behavior) relate to parole decisions and the perceived humanness of parole applicants. The paper also examines how construal level can moderate the above relationships. Finally, a moderated mediation model outlining the pattern of these relationships is posited and tested. 122 New York residents were recruited online and randomly assigned to read either an abstractly or concretely construed transcript for an interview with a parole applicant. …

This study examined the influence of mental illness on mock juror decisions in a criminal case. With the knowledge that mental illness continues to be highly stigmatized, I hypothesized that the presence of a mental illness in a defendant of a violent crime would have significant effects on participants’ case decisions and their perception of the defendant’s guilt. Participants in the study read a fictional vignette describing a homicide and a defendant in which the defendant’s mental illness diagnosis was varied (major depressive disorder, schizophrenia, borderline personality disorder, no mental illness). White Racial Identity is a relatively new concept with little to no consensus as to the operationalization of such identity. The first ever White Racial Identity model was developed by Janet E. Helms in 1990. The role of White racial identity has been studied in the context of the racial gap in employment and its influence on racial attitudes, but it has yet to be studied in the context of the juvenile justice system. Studies and victimization surveys suggest that many, if not most, crimes are not reported to legal authorities. The overarching aim of this project was to examine the roles of individual and contextual differences in bystanders’ willingness to report crimes to, and cooperate with, legal authorities. A sample of 1,434 adults in the U.S. completed a survey in which they read and responded to crime vignettes and responded to items theoretically measuring individual differences in legal socialization, perceived legitimacy, the need for cognitive closure, right-wing authoritarianism, social dominance orientation, and the general willingness to cooperate. A patriotic POW is brainwashed by his North Korean captors into refusing repatriation and undertaking treasonous anti-American propaganda for the communist regime. Despite the general abhorrence of treason in time of war, the American public opposes criminal liability for such indoctrinated soldiers, yet existing criminal law provides no defense or mitigation because, at the time of the offense, the indoctrinated offender suffers no cognitive or control dysfunction, no mental or emotional impairment, and no external or internal compulsion.
