There is a significant need for empirical evidence concerning how litigants compare and choose between various modalities of online dispute resolution (ODR) and traditional in-person mediation for resolving legal disputes. To fill this need, we examined three potentially relevant psychological factors: (a) baseline attitudes toward in-person, video, and text-based mediation; (b) past communication style used by litigants; and (c) expert advice via attorney recommendations. Trait responses to emotion (TREs) are personality traits that develop from how one consistently responds to and copes with emotions. TRE development is influenced by demographic factors, such as age, gender, and early life adversity, and TREs can influence how one copes with a variety of stressors. TRE theory and measurement is relatively new, and although TREs have been validated in majority race samples, TRE theory and measurement have not been validated in minority race samples, particularly in African American populations. Compassion Cartography: Mapping The Psychological Landscape Of Altruistic Equity And Effectiveness, Kyle Fiore Law

Psychologists and philosophers have often championed deliberative reasoning over empathy as a better approach to overcoming parochial biases and guiding altruistic equity and effectiveness. Advocates of the effective altruism (EA) philosophy even advise philanthropists to downregulate empathic responses to maximize the impact of their donations. However, recent research reveals that extraordinary altruists (XAs), such as those who donate organs to strangers, are driven primarily by empathy. This dissertation explores whether empathy necessarily impedes altruistic equity (impartial regard for others’ welfare) and effectiveness (prioritizing impact), revealing a more nuanced reality that challenges this perspective.
