Kosovo’S Strategic Missteps With International Law, Parker W. Remick, Robert Muharemmi Sep 2026

Kosovo’S Strategic Missteps With International Law, Parker W. Remick, Robert Muharemmi

Journal of Peace, Conflict, and Security Studies

This paper interrogates the principle of selective engagement with international law in the foreign policy of Kosovo, arguing that international law functions less as a neutral arbiter between states and more as a pliable instrument wielded in the pursuit of national objectives. Through a meticulous analysis of Kosovo’s post-2008 trajectory, the study unveils a pattern of selective engagement with international legal mechanisms highlighting both moments of strategic acumen and critical miscalculations. Despite possessing the legal attributes of statehood, Kosovo’s struggle for international legitimacy is hampered by a failure to fully exploit legal avenues, from multilateral treaty accession to litigation and …

Eviscerating The State: An Update, Jean L. Cohen

Emancipations: A Journal of Critical Social Analysis

A year after the publication of her article “Eviscerating the State: The New Oligarchic and Authoritarian Project to Undermine American Constitutional Democracy (Emancipations, Vol.4: Iss.2, July 2025) Jean Cohen looks again at the threats to American constitutional democracy posed by new oligarchic and authoritarian actors in the economy, the state, and society.

From Monopoly To Orchestration: The Hilltop And Farm Youth And The Changing Organization Of State Coercion - The Israeli Case, Idan Yaron Sep 2026

From Monopoly To Orchestration: The Hilltop And Farm Youth And The Changing Organization Of State Coercion - The Israeli Case, Idan Yaron

Emancipations: A Journal of Critical Social Analysis

Drawing on more than a decade of ethnographic fieldwork – as a social anthropologist, studying the Far Right in Israel, on the ground, and through intimate and prolonged relationships with opinion leaders and rank-and-file activists – this essay examines the Hilltop and Farm Youth in the West Bank to reconsider Charles Tilly's influential account of state formation and the organization of coercion. It asks a simple but troubling question: why would a powerful modern state, fully capable of suppressing autonomous violent actors, sometimes allow them to persist? I argue that Tilly's theory should be confirmed, adapted, and amended. His fundamental …

Uneven And Combined Fascism: A Postapocalyptic Perspective, Daniel Loick Sep 2026

Uneven And Combined Fascism: A Postapocalyptic Perspective, Daniel Loick

Emancipations: A Journal of Critical Social Analysis

This essay develops the concept of “uneven and combined fascism” as an alternative to dominant liberal approaches that understand fascism primarily as a future rupture or return of the European past. Analogizing the crisis of democracy with environmental crisis, it argues that fascism, like ecological catastrophe, should be understood as an ongoing and differentially distributed condition: already present for some while remaining latent or emergent for others. The essay develops this claim by consulting approaches of "postapocalyptic environmentalism" as well as thinkers and activists from the Black Radical Tradition, particularly the analyses of Aimé Césaire and the Civil Rights Congress’s …

Border Fascism And The Fascistization Of Society, Nicholas P. De Genova Sep 2026

Border Fascism And The Fascistization Of Society, Nicholas P. De Genova

Emancipations: A Journal of Critical Social Analysis

The massive destruction and social dislocation wrought by capitalist crisis has culminated, historically, in the brutal cataclysms of fascism and other forms of authoritarian rule. Today, across the globe, we are confronted with the aggressive advance and entrenchment of a variety of such authoritarian political projects. Anxious discourses about ascendant fascism have become perfectly mainstream. These developments command our acute attention and critical analysis. This essay addresses these dire questions and the conceptual vexations surrounding the concept of fascism, particularly as it has been elaborated in various Marxist analyses.  Specifically, much of the debate around fascism as an analytical category …

Las Voces Olvidadas Del Territorio: Infancias Mayas Ante El Conflicto Socioambiental En Ixil, Cielo María Ávila López, Myriam Montserrat Baca Canché, José Israel Herrera

Journal of Maya Heritage

The Institutional Production Of Ethical War Across Modern Conflict, Katerina Udov Jul 2026

The Institutional Production Of Ethical War Across Modern Conflict, Katerina Udov

Binghamton University Undergraduate Journal

This paper argues that modern warfare operates through an ethical infrastructure that enables, rather than restrains, the use of violence. Contrary to the common assumption that moral frameworks such as Just War Theory function as safeguards against harm, the historical record shows that ethical language, humanitarian rhetoric, and democratic narratives serve as mechanisms to legitimize intervention, manufacture consent, and naturalize civilian suffering. Through case studies including Vietnam, Iraq, Afghanistan, U.S.-backed coups in Latin America, and French intervention in Mali, the paper traces how political leaders, media institutions, and corporate actors frame war as a moral necessity while pursuing strategic and …

What Is To Be Done About The Radical Far-Right?, Bernard E. Harcourt Jul 2026

What Is To Be Done About The Radical Far-Right?, Bernard E. Harcourt

Faculty Scholarship

The far Right in America has become radical. In the process, it has outmaneuvered the progressives. In the first months of his second mandate, President Trump has mounted a revolution (or counterrevolution) against the liberal democratic state. Steve Bannon said he was Leninist and wanted to “smash the state.” President Trump has done just that. In this essay, I explore the far Right’s embrace of Lenin. I return to the Hegelian roots of Lenin’s politics to explain what he meant by “smashing the state machine.” I then argue that the Left should reclaim Lenin’s dialectics and his call, in the …

They, The People, Ammel Sharon Jun 2026

They, The People, Ammel Sharon

Socio-Legal Review

This essay engages with Rohit De and Ornit Shani’s Assembling India’s Constitution by situating it within a broader conceptual history of “the people.” While the book offers a compelling account of participatory constitution-making, the essay suggests that it opens up further questions about the conceptual and historical conditions shaping the people as a political subject. Drawing on contemporary political theory on populism, the essay explores how politics invokes the people through affective and performative practices alongside constitutional forms.

Critical Geopolitics And The Reconstruction Of Meaning: A Discourse Analysis Of The 'Terrorism' Label Applied To Hamas By Western Hegemony, Cahaya Mulyani Sakti, M.Hamdan Basyar May 2026

Critical Geopolitics And The Reconstruction Of Meaning: A Discourse Analysis Of The 'Terrorism' Label Applied To Hamas By Western Hegemony, Cahaya Mulyani Sakti, M.Hamdan Basyar

Journal of Terrorism Studies

The emergence of Hamas in 1987 cannot be separated from the configuration of modern colonialism and the continuity of occupation that shaped the political reality. Hamas’s early phase was rooted in socio-religious activities through education and community empowerment programs, before evolving into armed resistance against the occupation. The labeling of Hamas as a “terrorist” organization began in the mid-1990s in U.S. legal documents, which subsequently generated debate and gave rise to counter-narratives. This study employs the frameworks of critical geopolitics (Ó Tuathail & Agnew) and the Discourse-Historical Approach (Wodak) to analyze the labeling of Hamas as “terrorist” by Western hegemony. …

The Autonomy Plan In Morocco: Legal Foundations, Political Dimensions And Prospects For Resolving The Sahara Conflict, Limam Boussif, Jalila Ait Soudane May 2026

The Autonomy Plan In Morocco: Legal Foundations, Political Dimensions And Prospects For Resolving The Sahara Conflict, Limam Boussif, Jalila Ait Soudane

Journal of Maya Heritage

Summary: The territorial conflict over the Sahara is one of the most enduring territorial disputes in international relations, involving issues of sovereignty, self-determination, and regional stability. In this context, Morocco’s 2007 Autonomy Plan is presented as a negotiated framework of self-government under Moroccan sovereignty.

This article analyzes the evolution and consolidation of the Autonomy Plan using a conceptual approach based on self-determination, territorial governance, and conflict resolution theories. It shows that the initiative has progressively evolved from a national proposal into an internationally recognized framework, particularly through growing diplomatic support and developments within the United Nations Security Council, including Resolution …

Les Grands Chantiers De La Transition Énergétique Au Maroc: Le Cas De Dakhla-Oued Eddahab Entre Réalisations, Facteurs De Réussite Et Perspectives, Limam Boussif, Jalila Ait Soudane

Journal of Maya Heritage

Hammurabi’S Laws: Ancient Traditions Of Violence, Aaron Secrist May 2026

Hammurabi’S Laws: Ancient Traditions Of Violence, Aaron Secrist

The Confluence

The tradition of enforcing private property through violence is truly ancient, and goes back thousands of years to the first civilizations. There exists a prevailing attitude that contemporary culture is more “civilized” than the first organized societies – and while it’s true in some ways, our laws are still remarkably similar to those practiced in antiquity. In the following essay, I analyze the Law Code of Hammurabi and examine its parallels to the way laws function today. First, I will provide context for the technological advances that made the first city-states possible, then give a cultural and economic overview of …

Navigating Radical Indeterminacy In The Struggle For A Global Collective Consciousness: The Question Of Eco-Justice And Law Or Universalize The Pluriverse: A Manifesto, More Or Less, Omar Auf Feb 2026

Navigating Radical Indeterminacy In The Struggle For A Global Collective Consciousness: The Question Of Eco-Justice And Law Or Universalize The Pluriverse: A Manifesto, More Or Less, Omar Auf

Theses and Dissertations

The processes of interpretation, communication, and re-interpretation leads to the emergence of an approximated collective consciousness, for which it may be struggled and contested by hegemonic. The dominant forces of this contest, capitalism and nationalism, lead to an interdivided world: one that possesses the tools to empathize with each other but is instead leading people to keep their heads down and focus on surviving their own contexts, perceived as existing within different historical times on the same timeline. This leads to legal and justice systems that fail their claim to universality and/or impartiality. Incorporating an ecological lens to justice within …

Reading Wars, Don Herzog Jan 2026

Reading Wars, Don Herzog

Books

Once again, we’re fighting wars over reading. Who gets to read? What do they get to read? These days, the right is obsessed with removing LGBTQ books from school and public library shelves and ensuring students read only the Correct version of American history. The left is obsessed with eradicating right-wing fantasies, not to mention outright lies, from the internet, and with airbrushing or even purging racist texts. You don’t have to stoop to whataboutery to notice a suspicious resemblance. But once again is wrong. We’ve always fought these wars, even if the enemies come and go. In this book, …

Immigration Policy Priorities In The Carter And Reagan Administrations, Sulgi Kim Jan 2026

Immigration Policy Priorities In The Carter And Reagan Administrations, Sulgi Kim

History and Political Science | Senior Theses

Historically, immigration policy has been important for the United States. It has shaped the nation’s economy, demographics, and political landscape. In each presidential administration, immigration has been addressed differently, shaped by a combination of political, economic, and international factors. While scholars such as Higham (1956), Zolberg (2008), and Pineau and Waters (2016) have examined the events leading up to and the effect of various immigration policies, the literature has not focused on a critical actor in immigration policy: the president. This thesis asks what factors shaped the immigration policy priorities of Presidents Jimmy Carter and Ronald Reagan? This study used …

Between Borders - The Realities Of Immigration Limbo, Jennifer C. Valenzuela Jan 2026

Between Borders - The Realities Of Immigration Limbo, Jennifer C. Valenzuela

Honors Undergraduate Theses

In this research, I looked into different immigration pathways in the United States and determined different characteristics from those pathways that might be leading the Latino population into a limbo status. With the Latino population being the largest minority group in the United States, and the continuously growing number of Latino immigrants, I decided to do this research to spread awareness of possible barriers and struggles that Latinos might face when applying for an immigration pathway. I researched the different immigration pathways, focusing on Asylum, TPS, and Family Reunification, to understand the requirements that each requires to apply and the …

Behemoth Unbound: An Internal Critique Of Carl Schmitt’S Nazi-State Structure, Zaynamin Murtaza Jan 2026

Behemoth Unbound: An Internal Critique Of Carl Schmitt’S Nazi-State Structure, Zaynamin Murtaza

CMC Senior Theses

This paper offers an internal critique of Carl Schmitt's Nazi-era state theory from the perspective of the counterrevolutionary political-theological tradition to which Schmitt belongs. Using Schmitt's political-theological method which holds that all political theories have a systematic theological structure, the paper argues that Schmitt's 1933 turn to National Socialism contradicts this tradition. The paper proceeds in five sections. The first establishes the political-theological framework that will be utilized throughout the paper. The second develops Schmitt's concept of the katechon—the restrainer of lawlessness drawn from Christian eschatology— which he uses as a model for his theory of the state. The …

The Tech-Nuclear Renaissance: A New Critical Juncture For American Nuclear Energy Policy, Henry P. Otte Jan 2026

The Tech-Nuclear Renaissance: A New Critical Juncture For American Nuclear Energy Policy, Henry P. Otte

CMC Senior Theses

Nuclear energy has re-emerged as a central priority in American energy policy. This thesis examines the Trump administration’s efforts to support nuclear energy development and plant restarts, and asks whether today’s nuclear renaissance represents a critical juncture for nuclear energy policy. By analyzing American, French, and Swedish nuclear energy history, this thesis applies a three-variable analytical framework, state autonomy and administrative structure, political permeability, and crisis influence, to identify the institutional conditions necessary for durable policy change and evaluate the structural characteristics of this new environment. The central finding is that today’s push is distinct from prior attempts at expansion, …

Politics As Usual: Racial Pay Inequity And The Illusion Of Inclusion In The Rise And Fall Of Diversity, Equity, Inclusion, And Accessibility Executive Orders, Francois C. Melville Jan 2026

Politics As Usual: Racial Pay Inequity And The Illusion Of Inclusion In The Rise And Fall Of Diversity, Equity, Inclusion, And Accessibility Executive Orders, Francois C. Melville

West Chester University Graduate Theses, Dissertations, and Final Projects

This research examines pressing moral policy questions of our time: who determines when the United States of America has fulfilled its broken promise of equality for all, and what constitutes an appropriate measure of reparative justice. It interrogates why the Diversity, Equity, and Inclusion (DEI) Executive Orders (EOs) implemented across presidential administrations, intended to advance social equity, were grounded in conflict and symbolic gestures rather than scientifically evidenced issues such as wage inequality directly linked to upward career mobility. Race conscious policy generates cultural clashes centered on the perception that gains made by Black and Brown Americans come at the …

Pronatalism In The United States: How Political Ideals Surrounding Family And Reproductive Health Care Contribute To Neglect In The Foster Care System, Carson Sebree Dec 2025

Pronatalism In The United States: How Political Ideals Surrounding Family And Reproductive Health Care Contribute To Neglect In The Foster Care System, Carson Sebree

Undergraduate Honors Theses

Within the past decade, conservative reproductive politics in the United States have experienced an ideological shift from pro-life toward pronatalism. This has been intensified through the rollback of reproductive rights and the rise of Christian nationalism. However, there has been no commensurate additional funding for the foster care system. This project asks the interrelated questions of: “how is pronatalism linked to neglect within the foster care system?; and, how do theories of democratic care highlight the necessity to rethink support for the foster care system and create policies that will address its shortcomings, given the rise of pronatalist aw and …

Prerogative In Common: On The Emancipatory Potential Of Radical Mutuality Amid Sovereign Decisionism, Matthew Builes Sep 2025

Prerogative In Common: On The Emancipatory Potential Of Radical Mutuality Amid Sovereign Decisionism, Matthew Builes

Dissertations, Theses, and Capstone Projects

In times of crisis, liberal democracies resort to authoritarian measures that undermine core democratic values. Dominant thought in the study of emergency-era law and politics appeal to a dichotomy of normal and exceptional times, to critique or justify the turn to sovereign decisionism. While this strategy seems clear-cut, the persistence of exceptional spaces and the crises that supposedly generate them challenge existing frameworks by blurring the line between norm and exception. This project explores the prospect of radical mutual aid, as a transformative response to the enduring crisis of modernity.

Schools As Geopolitical Spaces: Violence Against Education During The Bosnian War (1992-1995), Allyson Bachta Aug 2025

Schools As Geopolitical Spaces: Violence Against Education During The Bosnian War (1992-1995), Allyson Bachta

Graduate Doctoral Dissertations

Attacks on education have long been a feature of conflict, yet their strategic use by state and non-state actors remains underexamined. Despite global concern and growing documentation efforts by the international community, the motivations and patterns behind school attacks are not well studied. This project investigates the strategic use of such violence by Bosnian, Serbian, and Croatian state and non-state armed actors during the Bosnian War (1992-1995) and challenges the assumption that attacks on schools are simply collateral damage. Drawing from political and anti-civilian violence literature, this study situates schools as both symbolic and strategic geopolitical targets, targeted not only …

When Culture Becomes Law: Mayan Heritage And The New Constitutional Recognition Of Collective Rights In Mexico, José Israel Herrera, Victor Manuel Colli Ek

Journal of Maya Heritage

Abstract. The constitutional reform of September 30, 2024 to article 2 marks a substantive change in the recognition of indigenous peoples as subjects of public law, with their own patrimony, valid normative systems and express right to conserve, protect and develop their cultural, material and immaterial heritage. This article analyzes the legal implications of this reform in the context of the Maya people, especially with regard to collective intellectual property, the right to prior consultation and the constitutional recognition of bioculturality. A critical reading of the new normative framework is proposed, with emphasis on its transformative potential for the territorial …

Extractivism And Water Crisis In The Moroccan Draa Oasis: Global South Reflections On Responsibility And Resistance, Ahmed El Khatabi Jun 2025

Extractivism And Water Crisis In The Moroccan Draa Oasis: Global South Reflections On Responsibility And Resistance, Ahmed El Khatabi

Journal of Maya Heritage

Abstract. The Draa Oasis in southeastern Morocco is experiencing severe water scarcity, driven by climate change and intensified by the expansion of watermelon agribusiness and desert tourism. This article explores how external investors, empowered by national agricultural policies, have disrupted traditional water governance systems rooted in collective management. Through ethnographic fieldwork involving interviews, focus groups, and spatial mapping, the study examines the socio-environmental consequences of groundwater depletion and land commodification. It argues that investors fail to assume ethical accountability for the ecological degradation they cause, despite being aware of the oasis’s fragile ecosystem. Meanwhile, local communities and civil society actors …

Journal of Maya Heritage

Abstract

This study encompasses the following urban wetlands: "La Kisst," situated in the city center, and "María Eugenia," located in the southern part of the city of San Cristóbal de las Casas. There are four wetlands within the municipality, all of which have been protected as natural areas by a Ramsar decree since 2008. The research aims to assess the socio-environmental vulnerability of the two wetlands using indicators in the environmental, social, and legal dimensions, thereby establishing the degree of vulnerability of the urban population exposed to flooding. The methodological process is defined by the proposal of CENAPRED, which establishes …
