Trends. Accountability In Security Organizations: The Case Of The United States Navy, Ibpp Editor

Controversy surrounds the adjudication of the United States Navy (USN) commander whose submarine collided with and then sank a Japanese fishing boat in February 200l. The USN has Issued a letter of reprimand to the commander and is allowing him to leave the Navy with full pension based on his current rank, as opposed to authorizing a court-martial that would have rendered the commander liable to very serious criminal charges and sentences. At Issue have been the effects of the adjudication on military personnel aware of the adjudication.

This paper focuses on court administration as a component of judicial branch reform in the United States and other countries.

Over the past fifty years, state and federal court systems in the United States have undergone a process of significant change. At the beginning of the twentieth century, courts were largely dependent upon the executive branch of government for administrative support and were for the most part externally dominated, disorganized, and poorly managed. Maurice James Holland (1984-1985 Acting; 1986 Acting)

After leaving the Indiana University School of Law in 1986, Maury Holland became the dean at the University of Oregon School of Law. He stepped down as Oregon’s dean in 1992 and continued teaching until his retirement in 2008. Holland died in 2020.

On March 13, 2001, Holland delivered the following lecture to the Round Table of Oregon. The lecture profiles University of Oregon Law Alumni Yosuke Matsuoka, who received his law degree in 1910 and went on to serve as a Japanese diplomat and the country’s Minister of Foreign Affairs.

The author argues here that a declaration of victory by the critics of the dormant foreign affairs doctrine would be premature. Notwithstanding the Court's citation of Ashwander v. TVA, the actual grounds of the decision in Crosby were in no meaningful sense less "constitutional" in nature than a decision based on the dormant foreign affairs power would have been. Moreover, even though the Court said that its decision was based on a straightforward application of "settled ... implied preemption doctrine," the Court's preemption analysis was anything but ordinary. This dissertation tests the hypothesis that water disputes cause serious conflict within and between states. It uses a structured case study approach to see whether there is a link between the independent and dependent variables. It also considers the effect of other variables on serious conflict. Specifically it addresses the effects of national identity and the othering process on conflict. The three case studies are built around rivers in the drier parts of the world. Drawing on democratic theory, this dissertation explores a thesis that the experience of ethnic restructuring significantly effects the ability of a democratizing state to successfully consolidate its emerging democracy. Ethnically restructured states, it is hypothesized, have an especially hard time creating inclusive democratic political communities, which is a necessary prerequisite for a consolidated democracy.

To test the thesis, the comparative case study method is applied to the ethnically restructured states of Latvia, Lithuania, and Estonia. The goal of the case studies is to examine the approaches that the Baltic states used to reduce polarization. The historical background to the case …
