Scholars have extensively detailed China’s conflation of the Uyghur issue in Xinjiang with the international war on terror following September 11, 2001. Less studied is how the U.S. responded to China’s framing of the Uyghur as terrorists, and of the Chinese government’s characterization of Xinjiang as a region fraught with violence and extremism. On the whole, scholars who have addressed this latter issue conclude that China successfully coopted the U.S., and consequently cracked down on Xinjiang without substantial international outrage. Since 9/11, counterterrorism policies have been one of the crucial policy issues facing the United States. After the attacks on the United States, counterterrorism in this country transformed. Fifteen years later, counterterrorism is typically organized as a one-size fits all approach. This approach generalizes all terrorist threats, trying to target terrorism as a whole. This thesis explains how this is an improper approach to counterterrorism. Instead, policies should be case-specific and created in regards to the specific characteristics embodied by each terrorist organization. These characteristics include history and ideology, organizational and leadership structure, finances, and tactics and targets. These characteristics …

There is a rich literature on the circumstances under which the United Nations Charter or specific Security Council resolutions authorize nations to use force abroad, and there is a rich literature on the circumstances under which the U.S. Constitution and statutory law allows the President to use force abroad. These are largely separate areas of scholarship, addressing what are generally perceived to be two distinct levels of legal doctrine. This Article, by contrast, considers these two levels of doctrine together as they relate to the United States. In doing so, it makes three main contributions. This Article is about the proliferation of private actors playing a role at the “broken border.” The Introduction of this Article sets out the conceptual framework for the Article and provides the roadmap for each part. Part I examines which private actors and corporations have increased their role at the US-Mexico border. These actors include multinational corporations including Mexican-sited factories (maquiladoras) and US government contractors engaging in national security work, as well as criminal organizations like human smugglers (polleros and coyotes) and drug cartels (narcotraficantes) from the Mexico side, and the border vigilantes, such as the Minutemen and American Border …

This project analyzes the role and limits of the presidential policy-making in foreign policy through an examination of President Richard Nixon’s policy of détente with the Soviet Union and China during the 1960s and 1970s.

I will ultimately present a set of four components that I argue played a role in enabling Nixon to pursue détente at the time he did. The four consequential factors include the following: First, domestic conditions exist in which the general public is focused primarily on domestic policy. The Obama administration’s “pivot” or “rebalance” to Asia has shaped the Obama administration’s impact on international law. The pivot or rebalance has been primarily about regional security in East Asia (principally, the challenges of coping with a rising and more assertive China—particularly in the context of disputes over the South China Sea—and resulting concerns among regional states), and secondarily about U.S. economic relations with the region (including, as a centerpiece, the Trans-Pacific Partnership). This paper articulates a framework both for assessing the various government bailouts that took place at the onset of Great Recession and for guiding future rescue efforts when they become necessary. The goals for those engineering a bailout should be to be as transparent as possible, to articulate clearly the reason for the intervention, to respect existing priorities among investors, to exercise control only at the top level where such efforts can be seen by the public, and to exit as soon as possible. By these metrics, some of the recent bailouts should be applauded, while others fell short. We …
