This text provides an environmental justice analysis of the stories of the people who lived in the Owens Valley, who watered its land and cultivated its crops—pine trees, apple trees, and kabocha alike. Telling the personal stories of challenge and resistance that manifested alongside the oppressive forces of military and state domination provides the opportunity to align forcibly relocated, exploited and incarcerated people’s struggles throughout time. The election of Barack Obama as the forty-fourth president of the United States suggests that the United States has made great strides with regard to race. The blogs and the pundits may laud Obama’s win as evidence that we now live in a “post-racial America.” But is it accurate to suggest that race no longer significantly influences how Americans evaluate each other? Does Obama’s victory suggest that affirmative action and antidiscrimination protections are no longer necessary? We think not. Ironically, rather than marking the dawn of a post-racial America, Obama’s candidacy reveals how deeply race affects judgment.

Gender, Race, And Intersectionality On The Federal Appellate Bench., Todd Collins, Laura Moyer

While theoretical justifications predict that a judge’s gender and race may influence judicial decisions, empirical support for these arguments has been mixed. However, recent increases in judicial diversity necessitate a reexamination of these earlier studies. Rather than examining individual judges on a single characteristic, such as gender or race alone, this research note argues that the intersection of individual characteristics may provide an alternative approach for evaluating the effects of diversity on the federal appellate bench. The results of cohort models examining the joint effects of race and gender suggest that minority female judges are more likely to support criminal …

Hispanic Citizenship, Registration, And Voting Patterns: A Comparative Analysis Of The 2000 And 2004 Presidential Elections, Debora Upegui

Introduction: This study examines citizenship, registration, and voting patterns among Latinos in the 2000 and 2004 Presidential Elections.
Methods: Data on Latinos and other racial/ethnic groups were obtained from the U.S. Census Bureau American Community Survey, reorganized for public use by the Minnesota Population Center, University of Minnesota, IPUMSusa. Cases in the dataset were weighted and analyzed to produce population estimates.
Results: There is no doubt that the Hispanic population in the United States has consistently grown in the last two decades and continues to be the largest growing minority group within the United States. According to the 2004 census, …

Voting Rights Act (VRA) is one of the most important—if not the most important—public policies developed over the last half century to increase access to the U.S. political system for people of color. The VRA also provides an important context for understanding the ascension of nonwhite groups into the elected leadership of the nation (Browning, Marshall, and Tabb 1984; Davidson and Grofman 1994; Menifield 2001; Mc-Clain and Stewart 2002; Segura and Bowler 2005; Bositis 2006). The Electronic Ballot Box : Class, Age And Racial Bias On The Internet., Jason Gainous, Kevin M. Wagner

This research creates a theoretical framework for understanding the effect of Internet voting on the electorate. Based on standard Downsian rational choice voting theory, we claim that Internet voting lowers the cost of voting for certain voting demographics based upon race, age, and income.We further contend that this electoral advantage may crystallize the growing turnout disparity be-tween demographic groups. The theory is tested using Bayesian inferential methods with data from the Internet turnout in the 2000 Arizona Democratic Presidential Primary merged with demographic data obtained from the 2000 Census. Our findings lend support for the theory that the Internet provides …

The Pipeline to Public Service Initiative asked the McCormack Graduate School’s Center for Women in Politics & Public Policy at the University of Massachusetts Boston to ascertain the racial diversity in state and local government. The project had the following three goals:
--To identify the race (and gender) of those holding top-level positions filled through gubernatorial appointments, e.g., secretaries, commissioners, directors, deputy commissioners/directors, and undersecretaries, in the Commonwealth’s executive offices and major departments.
--To compile the same information for members of the most influential boards and commissions in the Commonwealth filled through gubernatorial appointments.

This Essay applies the principles of social movement theory and analyzes the legal status of race-based remedies. Many scholars have debated the constitutionality and efficacy of affirmative action, the appropriateness of race-consciousness (from legal and social perspectives) and the legitimacy of structural judicial remedies for various types of discrimination. This paper will add to this literature by demonstrating the influence of conservative race politics and ideology on Court doctrine concerning affirmative action and other race-based remedies. The nature of colonialism in Puerto Rico has caused most political issues to be viewed within the framework of status politics. In the first stage of the struggle to expel the U.S. Navy from the island (1999–2003), civil society in Puerto Rico united when the issues were reframed with links not to status politics but to human rights and social justice. Viequenses symbolized for Puerto Ricans in Puerto Rico, on the mainland, and in the world at large the costs of military colonialism. Black Candidates And Black Voters: Assessing The Impact Of Candidate Race On Uncounted Vote Rates, Michael C. Herron, Jasjeet S. Sekhon

Numerous studies show that the rate at which African‐Americans cast ballots with missing or invalid votes, i.e., the African‐American residual vote rate, is higher than the corresponding white rate. While existing literature argues that the plethora of African‐American residual votes is caused by administrative problems or socioeconomic factors, we show using precinct‐level data from two recent elections in Cook County, Illinois, that the African‐American residual vote rate in electoral contests with black candidates is less than half the rate in contests without black candidates. African Americans, therefore, are able to reduce their residual vote rate when they wish to do …

This Article responds to the advocates of "progressive race blindness" with several critiques of their central claims. Part I examines the contours of progressive race blindness in greater detail, giving centrality to the emergence of this theory in legal scholarship. Part I sets forth the common themes articulated in progressive race blindness arguments and highlights important differences among its proponents. Part II isolates several problems with the progressive race blindness literature and demonstrates that these weaknesses make the literature unhelpful as a political or legal theory and even dangerous to the cause of antiracism.
