International Human Rights Law Journal

Many cynics of the universality of international human rights point to persistent large-scale human-rights abusing regimes, such as the Democratic Republic of North Korea, as proof that there is nothing at all universal about human rights. This essay is an attempt to root out the implications of internal national policies on the suitability of international human rights whilst reinforcing their universality. The author of this essay, a military lawyer, reaches the conclusion that the pump of universal human rights don't work within the North Korea cause the vandals took the handle.

The UN treaty body system is an imperative component in the enforcement of international human rights law, but it currently does not have the mechanisms sufficient for the effective internalization of international human rights law standards. One of its current mechanisms, namely, concluding observations, are by their nature of being addressed to states insufficient to ensure enforcement in state parties not politically, economically, socially, or culturally inclined to obey the recommendations. Japan has long been criticized for its failure to address the issue of international child abduction. In response to international pressure, Japan adopted the Hague Convention on the Civil Aspects of International Parental Abduction in April 2014. Despite its ratification of the treaty, great concern remains whether Japan is willing to comply with the legal obligations imposed by the Convention. This article examines Japan’s struggle with the issue of international child abduction, analyzing its traditional approach to family matters such as its “divorce by conference” system, which permits couples to negotiate issues of child custody and visitation without any judicial …

“Bracketing” Foreign Policy From Domestic Affairs: A New Paradigm For International Negotiation And Decision-Making, Scott Gerschwer Ph.D.

This paper argues that geo-political negotiators must separate domestic issues from their calculations and consider only strategic goals and international concerns when working through issues with other global leaders. The impetus for this paper is a recent poll that shows that 52% of Americans want to bomb Iran, apparently without considering the consequences. I will give some history, present some recent cases and attempt to create a mechanism for separating international and domestic issues to relieve a source of pressure on negotiators.

Recent polls have revealed that Americans of both the political left and right support the use of military drones. This statement stands true among groups who traditionally do not support the use of military force. I hypothesize that people of a more liberal persuasion will be more concerned with whether or not the drone program endangers innocent civilians, while those of a more conservative view will be more concerned with the legality of conducting military drone strikes. I analyze data obtained from the Pew Research Center to examine people's attitudes on military drone strikes via framing theory. My hypothesis has …

The Russian Federation and the United States of America signed on April 8, 2010 the New START nuclear arms control treaty. The New START treaty replaced the lackluster SORT treaty in order to establish a nuclear agreement that would put new limits on numbers of weapons and delivery vehicles while also establishing an innovative framework for transparency and data transfer to allow confidence building between two countries that have not always seen eye-to-eye. Following instructions received from the U.S. Congress in the 2000 National Defense Authorization Act, the Department of Defense prepared an annual report on Chinese military power. This report contains classified and unclassif ied editions. Documenting Chinese military space power developments was one of the provisions in this law’s authorizing language. This article will examine how Chinese military space power documents have been described by the Department of Defense during this report's existence through 2015 and detail how members of Congress and Congressional committee hearing witnesses reacted to these developments in Congressional hearing transcripts and in Congressional debate through Fall 2015.

Numerous U.S. government agencies are involved in developing and implementing U.S. policy toward Korean Peninsula events, trends, and developments. Those studying U.S. government policies toward this region need to pay particular attention to the role played by U.S. Congressional committees in this policymaking. Congressional committees are responsible for approving new legislation, revising existing legislation, funding U.S. government programs and conducting oversight of these programs. Harry Truman is an overshadowed figure in presidential politics and history. His presidency was wedged between two titans of the office, the politically savvy Franklin Roosevelt and universally beloved war hero Dwight Eisenhower, and his overall influence and impact is downplayed when compared these two men. My research examines how and why American presidents speak about human rights issues around the world, using rhetoric about human rights from the Clinton, George W. Bush, and Obama administrations. I theorized that rhetorical attention to human rights issues would be dependent on the strategic value of the region where the abuses take place, and that the president would shy away from criticizing countries where high numbers of U.S. military personnel were stationed. Using descriptive statistics and a measure of bivariate correlation, I found compelling evidence that presidential human rights attention was influenced by regional location, but only weak evidence …

This paper focuses on the hegemonic politics between the Eggon and Hausa/Fulani ethnic groups in Nasarawa, North-Central Nigeria, which eventually erupted into the Ombatse crisis of May 2013- a precursor to the 2015 general elections. This dissertation analyzes punitive trade conflicts between the U.S. and two trading partners: China and Japan. Punitive trade conflicts can be defined as trade wars between two states, retaliatory tariffs, or other forms of conflict, e.g. preventing the acquisition of foreign assets or sanctions for an undervalued exchange rate. I will examine several trade conflicts between the U.S. and Japan in the 1980s and several trade conflicts between the U.S. and China from 2001 to the present. Since 9/11, counterterrorism policies have been one of the crucial policy issues facing the United States. After the attacks on the United States, counterterrorism in this country transformed. Fifteen years later, counterterrorism is typically organized as a one-size fits all approach. This approach generalizes all terrorist threats, trying to target terrorism as a whole. This thesis explains how this is an improper approach to counterterrorism. Instead, policies should be case-specific and created in regards to the specific characteristics embodied by each terrorist organization. Scholars have extensively detailed China’s conflation of the Uyghur issue in Xinjiang with the international war on terror following September 11, 2001. Less studied is how the U.S. responded to China’s framing of the Uyghur as terrorists, and of the Chinese government’s characterization of Xinjiang as a region fraught with violence and extremism. On the whole, scholars who have addressed this latter issue conclude that China successfully coopted the U.S., and consequently cracked down on Xinjiang without substantial international outrage. This essay examines presidential candidate Bill Clinton’s rhetoric regarding America’s role in the world during the 1992 presidential campaign. Despite the fact that foreign policy was George H.W. Bush’s strength during the campaign, candidate Clinton was able to develop a coherent vision for America’s role in the world that he carried into his presidency. I argue he did so by fusing together the American exceptionalist missions of exemplar and intervention. In doing so, Clinton altered a tension embedded in debates over U.S. foreign policy rhetoric.
