Evolving Standards Of Decency: The Intersection Of Death Penalty Theory And Supreme Court Jurisprudence, Rachel S. Sullivan

The American death penalty must be abolished in order to establish a more just system of punishment. This thesis examines the arguments of eight political theorists and their connections with five essential Supreme Court cases on capital punishment in order to determine the Court's theoretical view of the American death penalty. This theoretical view is that justices who affirm the constitutionality of capital punishment use philosophical theories, while justices who critique capital punishment rely upon context-dependent analyses. If the Court ever rules that capital punishment is unconstitutional in all circumstances, these latter theories will be dispositive.

Post-conflict justice mechanisms are designed to provide tools to move a state towards stability. How do political practices influence mass culture? Conversely, how does mass culture influence political practice? This project addresses these questions by turning to the concepts of utopia and dystopia. Imagined utopic and dystopic visions express both the hopes and anxieties of the societies producing them. Dystopias also highlight the mechanisms of power that function within particular social orders. Through readings of Lois Lowry’s The Giver and Phillip K. This study focuses on Palestinian identity in refugee camps and their international representation of rights by the PLO. The goal of this research is to understand how the meaning of the Right of Return has developed through generations of Palestinian refugees residing in camps, in contrast with the international community discourse presented by the PLO on this topic.

After almost two decades since the PLO’s leadership renewal, a gap is visible between Palestinian political representation and the sentiments of Palestinians on the ground. Noting internment’s nearly ubiquitous connection with the World War Machine, The Rise and Fall of the World War Machine examines implications for political community. A postmodern interpretive analysis approach seeks to overcome the constraints of axiomatic designs to ensure that the often hidden movement of internment comes to light. Giles Deleuze and Felix Guattari demonstrate the rise of the World War Machine, a global collection of state war machines that use war as a means to propagate confinement through internment. This Independent Study is divided into four chapters. The first chapter examines the role of capitalism in the formation of our culture. The argument presented here is that culture plays an important role in reinforcing modern neoliberal capitalism and that neoliberal capitalism has massive control over the dissemination of culture and the arts. The chapter concludes that it is necessary to utilize socio-cultural means in combating the influence of capitalism, and there does indeed exist emancipatory potential in artistic political praxis.

This paper explores the role that social movements play in weakening the racial hierarchies that continue to persist in contemporary United States and South Africa. A theoretical analysis of the function of social movements is followed by an historical survey of the racial hierarchies within these two countries, with particular attention paid to the countries’ respective eras of institutionalized racism characterized by the Jim Crow and Apartheid periods. The analysis highlights the inter-connection and intra-connection between societal facts (mythology, symbols, and religion), socio-anthropological concepts (imitation, liminality), and psychological factors (human will and “I will”) with global politics. The approach identifies dynamics and “repetitions” which can affect individuals and societies, perpetuate tension and violence, and constrain certain political outcomes. Thus follows the particular shortcoming of International Relations theory as the product of rational choice, which strives to separate the unconscious from the conscious, to understand and remedy certain socio-political conflicts. Indefinite detention is better defined as “detention without trial,” where the government has no plans for a prisoner’s arraignment, release, or deportation. While this policy has been used by democratic countries in the past and present, it appears to violate a core democratic concept—that of due process of law. This study examines US, British, and French counterterrorism efforts against al-Qaeda, the Provisional Irish Republican Army, and the Armed Islamic Group, to determine which factors are most likely to lead to the employment of indefinite detention. The debates are key events for presidential candidates to influence public support for their policies. This study examines the impact of rhetorical strategies during presidential debates on public perceptions of unpopular issue stances. Using generic criticism, I examined the first two 2012 debates between Barack Obama and Mitt Romney and uncovered four rhetorical strategies used by the candidates: issue framing, appeals to authority, use of rebuttals, and appealing to liberal and conservative presumptions. I then tested an example of issue framing from each candidate to determine its effectiveness in persuading public opinion on unpopular issue stances. My results showed that …

This study seeks to explore perceptions and understandings of democracy in South Africa twenty years post-apartheid. Information from interviews with fifty South African citizens in Durban, KwaZulu-Natal was supplemented with interviews with five experts from institutions relevant to democratic development. Participants agreed that South Africa was a democracy, but disagreed on the meanings of democracy, South Africa’s democratic performance to date, and future prospects for democracy. This study examines whether the 1998 arrest, by order of a Spanish judge, of former Chilean President Augusto Pinochet in London for crimes of genocide and terrorism impacted the attitude of Chilean and Spanish courts toward prosecuting their own country’s human rights violations. It argues that after 1998 Chile’s judiciary increased prosecutions against former regime officials, while the Spanish judiciary upheld Spain’s 1977 Amnesty Law and declined to participate in the national discourse on the country’s past human rights violations. Massad’s thesis is simple, in fact, perfect in its simplicity. Empire is a terrible force that wants to penetrate, overpower and hegemonize. It has a center, a headquarters if you like, the West. It functions with two arms: capitalism (later neoliberal) and Euro-American hegemony. Bosnia and Herzegovina possesses both a history marked by ethnic differences and a tradition of tolerance and coexistence among religious groups. The millet system of Ottoman times depended upon the authority of confessional communities. With the rise of nationalism in the 1800’s, religious identity and organization became complicated by ethnicity. Later, the authoritarianism of Tito enabled the state to accommodate this multinational, multi-religious character, uniting people as socialist Yugoslavs. Thus, the collapse of the socialist, Yugoslavian ideals and structures created new and sometimes polarizing choices for the population.
