Backlash And The Ada: Conflicting Constructions Of Disability In U.S. Policy, Bess Connolly

The Americans with Disabilities Act (ADA) has faced significant judicial and regulatory backlash, even after the passage of the ADA Amendments Act (ADAAA). Examining the legislative histories and trends in ADA litigation, I argue that this backlash arises from conflicts between the medical and social models of disability embedded in both laws. Compromises made during both legislative processes resulted in a law that accommodates multiple conceptions of disability, allowing courts to reshape the law according to their own views. Ultimately, the ADA remains a site of contestation as its internal contradictions have gone unresolved.

Texas’s localized system of groundwater regulation is complicated by its strong tradition of property rights. This paper examines the legal consciousness of the everyday people subjected to that system. It relies on interviews with local water authorities, as well as an analysis of public comments made by stakeholders. When conflicts emerge, stakeholders tend to attribute negative outcomes to a failure to properly follow legal procedure, or to the improper intrusion of some non-legal entity. Authorities, however, blame the law itself. Both groups feel the law’s presence but struggle to locate its specific source or meaning.

This thesis explores the political, legal, and moral factors that influence Supreme Court justices when penning capital punishment decisions. It also examines the evolution of thinking toward the death penalty by former justices John Paul Stevens and Harry Blackmun throughout their tenure on the Court. Cases are analyzed through fact-pattern analysis and the jurisprudential regime theory, which quantitatively build upon existing literature detailing the theoretical background of judicial decision-making through the attitudinal model. An analysis of Justices Blackmun and Stevens’ papers at the Library of Congress focuses on rhetoric that reflects utilitarian and retributive theories of punishment. Findings show that …

In this study, the two 2024 presidential debates were analyzed for a variety of different trends including: who was on screen, the different camera shots used, and camera movement. Looking specifically at who was on screen, coding counted the moderators, Donald Trump, Joe Biden, and Kamala Harris. Six different camera shot types were also analyzed including: wide-overview shot, split-screen format, single medium shot, two-shot head on, two-shot low camera angle, and two shot high-camera angle. This paper compares the reported statistics of staff-on-inmate sexual misconduct allegations in privately and federally operated correctional facilities. The federal Bureau of Prisons (BOP) was first created with the goal of protecting public safety and promoting rehabilitation for criminal offenders humanely. As decades have passed, and the support for the validity of this mission has wavered, the federal government has implemented oversight and remedial programs to report on the misconduct that is evident in prison management in an attempt to curb these incidents. The data contained in this dataset cover the 2024 Presidential election results. Also included in this dataset are the winner results for the 2016 and 2020 election. Data were sourced from finalized (certified) state election board results wherever possible. All data is reported at the county level. Are federal lawsuits resolved differently based on the race or gender of the judges assigned to hear them? Recent empirical research posits that women and judges of color decide cases more liberally, at least in some identity-salient areas of law. However, these studies analyze small numbers of cases and judges, and use research designs that limit their causal interpretations. Using an original dataset of all civil rights cases filed in 20 federal district courts over multiple decades and a strong causal identification strategy, we find that assignment of cases to judges of color or women has no statistically significant effect …

Past research on cryptocurrency has highlighted its sociotechnical aspects, framing crypto projects as community-grounded movements disrupting traditional state and market structures through technological advancements. What happens when these disruptive promises are absent or only playfully invoked? Cryptocurrencies known as “memecoins” have grown their own followings without pledging future legitimacy that would seriously challenge existing institutions, instead linking their value to the meme they brand themselves with and vague democratic promises. This research explores the many different participatory categories and behaviors within modern-day politics and examines how income, career, and social class affects participation. The World Food Program states that “acute malnutrition in Afghanistan is above emergency thresholds in 25 out of 34 provinces and is expected to worsen”. Aiming to support agriculture, the Taliban began to build the 285 km “Qosh Tepa Canal” to divert 17% of the Amu Darya, which supports the livelihoods of millions of people in downstream Uzbekistan and Turkmenistan. The World Bank estimated that roughly 2.4 million Central Asians could become climate refugees by 2050. Our objectives are to create a timeline of satellite imagery of the canal’s construction. It gives a brief historical account of the evolution of the South Sudanese legal system and the current challenges posed by overlapping normative frameworks. This article examines the ecological sublime in its relationship to the history of colonial aesthetics, anticolonial thought, and contemporary colonialism. It argues that, while Edmund Burke utilized the sublime in support of colonialism (including settler colonialism) in North America and colonial slavery, Samson Occom and Ottobah Cugoano developed versions of the sublime to contest British colonialism in the Americas. The history of this aesthetic contestation has not been represented in scholarship on the ecological sublime, which, this article shows, has a vexed relationship with historical and contemporary colonialism. It focuses on the societal and gendered impacts of revenge porn, particularly examining how victimization differs across genders. The legal analysis explores state-by-state legislation addressing revenge porn, assessing the severity of criminal penalties and the timeline of enactment. For current contextual reasons, the study evaluates how emerging Deepfake artificial intelligence technologies intersect with and complicate existing revenge porn laws. This thesis examines the intersection of populism and religious rhetoric in Spain’s right-wing political party, Vox. By analyzing Facebook posts from Vox’s national and regional accounts in the months leading up to the 2019 and 2023 national elections, as well as key regional elections in Andalusia and Cantabria, this study explores how the party strategically employs religious themes to shape its populist discourse. The findings indicate that Vox primarily uses religious rhetoric to construct an exclusive national identity, framing perceived external threats such as immigration, secularism, and leftist politics. The United States healthcare industry is an integral aspect of every American’s life. The Affordable Care Act (ACA) in 2010 reformed the healthcare system by expanding coverage to millions of Americans and eliminating claim denials due to pre-existing conditions. It requires participating states to submit transparency data. Despite these reforms, coverage denials continue and vary by plan category, metal level, and among different states. What is the relationship between gender ideology and abortion attitudes? For decades now, abortion has remained one of the most controversial topics in the modern world. A greater understanding of the motivations behind abortion attitudes could be useful to predict changes in abortion policy within a variety of cultures. This study analyzes data from the 2021 General Social Survey (GSS). Multivariate regression was used to investigate the effect of gender ideology on abortion attitudes. Taiwan, strategically located in the South China Sea, has long faced challenges in asserting its sovereignty. While much of the existing scholarship focuses on the 20th-century conflict between the Chinese Nationalist Party (Kuomintang) and the Chinese Communist Party, this study turns to the mid-17^th century to trace the roots of the island’s contested status. It centers on Zheng Chenggong (1624–1662), also known as Koxinga, who established the Ming loyalist Kingdom of Tungning in Taiwan (1661–1683) following the fall of the Ming dynasty.
