Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. International jurisprudential interpretations of the legal definition of genocide are summarized and used as …

Times of emergency present an inherent conflict between the public interest and the preservation of individual rights. Such times require granting emergency powers to the government on behalf of the public interest and relaxing safeguards against government actions that infringe rights. The lack of theoretical framework to assess governmental decisions in times of emergency leads to a polarized and politicized discourse about potential policies, and often, to public distrust and lack of compliance.

The Iraq War (2003–2011) constitutes by some estimates one of the deadliest and most destructive conflicts of the 21st century (Hagopian et al., 2013). In addition to the disputed figures of excess violent civilian casualties––generally ranging from 180,000 to 210,000 deaths––the war has created one of the major refugee crises of modern times, with 1 in 25 Iraqis estimated to have been displaced from their homes by the 2003 invasion (Costs of War, 2021). This study explores whether the best practices of refugee integration policies, as supported by scholars, are present in the European Union (EU) and some of its Member States between 2014 and 2021, accounting for the responses of these governments to the 2015 refugee crisis in Europe. In addition, it seeks to reveal the likelihood of future collective governance of refugee integration at the EU level. The article analyzes the development of Ukrainian Orthodoxy in the context of the revenge policy of Russia against Ukraine at the turn of the 21st century. The object of the study is provided by the conflict of interests of the Ukrainian society and the Ukrainian Orthodox Church of the Moscow Patriarchate (UOC-(MP) against the backdrop of the 2022 full-scale Russian war against Ukraine. The article considers the impact of new legislative initiatives aimed at minimizing the destructive Russian influence, including on the religious area. The graphic and bodily facts of a legal question of rights are relevant to the courts, particularly in questions that directly implicate physical bodies and pain, such as right to die cases, or what level of search may be allowable and when. However, in the case of abortion, or more specifically the bodily ramifications of pregnancy and childbirth, this detail is conspicuously absent. This article, relying on a content analysis of over 220 legal opinions on abortion rights, documents this absence of rhetoric. This thesis analyzes national identity maintenance by looking at the communications of three far right political parties in Europe. These parties are Alternativ Für Deutschland, the National Rally party, and the United Kingdom Independence Party. The results of this thesis have highlighted that these parties are concerned about maintaining the national identity of their countries and the worry that immigration coming into the nation will change the national identity. The Filipino indigenous custom of collective action known as bayanihan is institutionalized in the Barangay Assembly; a community forum where citizens can directly influence local governance. However; it is not widely utilized because many barangay officials are co-opted by local political dynasties. I draw on literature from the constructivist school of thought and securitization theory, which posits that security threats are socially constructed through the process of securitization.
