Many in the West today talk about the emergent unity of humanity, as social scientists examine the world through “global values,” assessing “global opinion”; economists study the “global economy” and “global finance”; historians write of “universal history;” legal scholars speak of “global domestic politics” and “world society,” while advocating “transnational justice”; political pundits announce the death of the nation-state. One could list additional examples illustrating the same apparent fact: a growing sense of global unity, and a universalist perspective on things social, economic, legal, historical, and political. In response to Professor Lawrence Lessig’s Jorde Lecture, I suggest that corruption is not the proper conceptual vehicle for thinking about the problems that Professor Lessig wants us to think about. I argue that Professor Lessig’s real concern is that, for the vast majority of citizens, wealth presents a significant barrier to political participation in the funding of campaigns. Professor Lessig ought to discuss the wealth problem directly. I conclude with three reasons why the corruption temptation ought to be resisted.

In studies of compliance with international law, the focus is usually on the “demand side” – that is, how to increase the pressure on the state to comply. Less attention has been paid, however, to the consequences of the “supply side” – who within the state is responsible for the compliance. This Article is the first study to systematically address the issue of how different actors within the United States government alter national policy in response to the violations of international law. The Article does so by examining cases initiated under the World Trade Organization (WTO) Dispute Settlement Understanding (DSU). …

Commitment Problems: Understanding Variation In The Frequency Of International Conflict Management Efforts, Molly M. Melin

Why do some militarized interstate disputes involve multiple third party attempts to resolve the dispute, while others seemingly end before movement towards peace is possible? This paper examines third party commitment to international conflict resolution. I argue that a third party’s commitment reflects strategic interests, barriers to entry and the conflict’s prospects for peace, which encourage third party involvement while having a dampening effect on their commitment. I also explore the role of bias in management onset and third party commitment. Analysis of conflict management in militarized interstate disputes from 1946 to 2001 offers significant support for the hypotheses.

Democratic peace theory provides theoretical and empirical arguments of the importance about democratic institutions in shaping and promoting the global order. Yet critics propose that it is the similarity of policy interests that prevent conflict between the joint democracies instead of the effects of regime types (Gartzke 1998; Oneal and Russet 1999c; Russett, Oneal and Davis 1998; Gartzke 2000). Scholars mainly question whether interests directly cause peace or interests are indirectly caused by liberal variables, such as trade or international organizations. The expansion of financial services to the poor, now widely referred to as microfinance, quickly saw tremendous success in Bangladesh beginning in the 1970's and was exported to a number of other countries. For a time microfinance was spoken of as a panacea, in part because it is more detached from governments than other forms of poverty alleviation. I develop a model based on expected utility theory that looks at how risks associated with government policies and characteristics affect whether this mechanism eases poverty. Dueling For Their Votes: A Study On The Impact Of Presidential Debate Rhetoric On Public Opinion, Daniel J. Cohen

The debates are key events for presidential candidates to influence public support for their policies. This study examines the impact of rhetorical strategies during presidential debates on public perceptions of unpopular issue stances. Using generic criticism, I examined the first two 2012 debates between Barack Obama and Mitt Romney and uncovered four rhetorical strategies used by the candidates: issue framing, appeals to authority, use of rebuttals, and appealing to liberal and conservative presumptions. I then tested an example of issue framing from each candidate to determine its effectiveness in persuading public opinion on unpopular issue stances. My results showed that …

The 2012 U.S. Election And Political Messages In Sermons, Daniel Roland, Darin S. Freeburg

This study sought to determine to what degree clergy members of various denominations mentioned the 2012 Presidential Election in their sermons. A convenience sampling of 1,012 sermon texts prepared and delivered by 141 Protestant Christian clergy members from August 5 through November 4, 2012, were gathered and analyzed for occurrences and type of political messages. Analysis found that political messages were more likely to be given by clergy located in Blue States and least likely to be given by clergy located in Red States. Large partisan congressional “classes,” once common, have become more the exception than the rule over the past 60 years. Thus, when they come along, as in 1974 and 1994 (and perhaps 2010), they receive a lot of attention. Moreover, they often do help to change the institution of the House in dramatic ways. After a few years, all such classes lose their distinctiveness and meld into the legislative flow of the era. The research explored the interactions and experiences of participants and facilitators in civic deliberative dialogue and how they worked through tension and conflict. The dissertation question asked: What is the lived experience of participants and facilitators of civic deliberative dialogue and how do group members collectively move beyond tensions and disagreements that surface during dialogue processes? The study analyzed the joint influences of tension and disagreement within the context of seven deliberative dialogues convened on the topics of race, race relations and racism. The ongoing Syrian conflict has been subject to considerable amount of political polemics. Nevertheless, little scholarly work has been conducted in order to comprehend the complexities as well as underlying reasons behind the intensity, scope, and duration of the conflict in Syria. Through qualitative methodology, this research examines the character of the Syrian conflict, by conducting an in-depth and nuanced case study of the Syrian civil war. This thesis investigates the current model of American college athletics and how football and basketball, specifically, have become extremely commercialized. This piece begins with an analysis of the current state of amateur college athletics and the changes that have taken place recently. O'Bannon v. Photographs of the victims of Argentine state terrorism from 1972 to 1983, and most prominently those of the detained-disappeared victims of the Proceso de Reorganización Nacional dictatorship (1976-1983), have had a significant role in elucidating the demands of human rights activists since the aftermath of the Trelew Massacre in 1972. In this thesis I examine the role of photographs of victims of state terrorism in the construction of unofficial, or counter, narratives critical of those produced by two dictatorships and by elected democratic administrations in the demand for truth and justice, and in the construction of social memory. In 2011, the United States Supreme Court struck down a class action suit alleging that Wal-Mart stores discriminated against female employees in pay and promotion decisions, making it more difficult to obtain certification of private employment discrimination class actions. As a result, the role of the Equal Employment Opportunity Commission in seeking structural reform of the workplace, always of substantial influence, has gained in comparative importance. Yet there is remarkably little written about the EEOC’s large-scale injunctive cases. This Article addresses this major gap in scholarship. Among the questions that vex the federalism literature are why states check the federal government and whether Americans identify with the states as well as the nation. This Article argues that partisanship supplies the core of an answer to both questions. Competition between today’s ideologically coherent, polarized parties leads state actors to make demands for autonomy, to enact laws rejected by the federal government, and to fight federal programs from within. States thus check the federal government by channeling partisan conflict through federalism’s institutional framework. Partisanship also recasts the longstanding debate about whether Americans identify with the states. Democratic and …

This paper examines the inherent tension between a Green political party’s genesis and official ideology and the conventional forms and practices of party leadership enacted in the vast bulk of other parties, regardless of their place on the ideological spectrum. A rich picture is painted of this ongoing struggle through a case study of the Australian Greens with vivid descriptions presented on organisational leadership issues by Australian state and federal Green members of parliaments.
