The Public Face Of The 'Litigation State:' Federal Empowerment Of Litigation By State Governments, Paul Nolette

Scholars have recently begun exploring the construction of what Sean Farhang has termed the “litigation state” – namely, the distinctly American way in which contemporary federal programs are enforced by means of litigation. The attention in this literature to date has focused on why Congress has encouraged private litigation to enforce various statutory programs. This paper examines the emergence of a related and no less important development – the federal government’s encouragement of state government litigators to help enforce federal regulatory programs, especially state attorneys general ("AGs"). Politics Or Policy? How Rhetoric Matters To Presidential Leadership Of Congress, José Villalobos, Justin Vaughn, Julia Azari

In this study, we examine the linkage between presidential policy proposal messages and legislative success. Employing a dataset on presidential legislative proposals that covers the years 1949-2010, we find that politics matters less than policy. Purely political messages that reference the electoral logic of mandates or appeal to a sense of bipartisanship appear to have no impact on presidential legislative success, nor does policy signaling, though highlighting the role of agency-based policy experts in crafting legislation does. From these results, we conclude that although the way presidents communicate their messages to Congress represents an important component of presidential-legislative relations, it …

Presidential policy czars have been an important and powerful component of President Barack Obama’s approach to management and leadership in the first part of his time in office. By using czars, the President has been able to demonstrate the importance of policy issues, both to his own agenda and to the broader political system. In this chapter, we find that performance outcomes for these czars have been a mixed bag, with as many stories of success to report as tales of frustration and failure. As such, we posit that the cost of czars, in political and organizational terms, has outweighed …

Assessing Devolution In The Canadian North: A Case Study Of The Yukon Territory, Christopher Alcantara, Kirk Cameron, Steven Kennedy

Despite a rich literature on the political and constitutional development of the Canadian territorial North, few scholars have examined the post-devolution environment in Yukon. This lacuna is surprising since devolution is frequently cited as being crucial to the well-being of Northerners, leading both the Government of Nunavut and the Government of the Northwest Territories to lobby the federal government to devolve lands and resources to them. This paper provides an updated historical account of devolution in Yukon and assesses its impact on the territory since 2003. In this article, we examine a model of terrorism that focuses on the tradeoffs facing a terrorist organization that has two qualitatively different attack modes at its disposal. The terrorist organization's objective is to successfully attack at least one target. Success for the target government is defined as defending all targets from any and all attacks. In this context, we examine how terrorist entities strategically utilize an efficient but discrete attack technology e.g., suicide attacks when a more conventional mode of attack is available, and the optimal anti-terrorism measures.

The Center for Women in Politics and Public Policy (CWPPP) at UMass Boston’s McCormack Graduate School of Policy Studies has been tracking the election of women at the municipal level in Massachusetts since 1996. In 2003, the Project expanded to include all New England states. CWPPP remains the only research center in the United States that regularly tracks women’s political representation at the local level.

Lyle Denniston, the longest serving and most experienced journalist covering the United States Supreme Court, takes his theme of an inclusive and open society from the constitutional and cultural vision of the late Justice Lewis F. Powell, Jr. and then offers a detailed argument that America is forfeiting—or at least compromising—that vision in favor of a safer, more secure and more cramped society, at home and abroad. Coding non-manifesto documents as if they were genuine policy platforms produced at election time clearly raises serious issues with error when these codings are used in the standard manner to estimate left-right policy positions. In addition to the long term solution of improving the document base of the Manifesto Project identified by Gemenis (2012), we argue that immediate gains in manifesto-based estimates of policy positions can be realised by using the confrontational logit scales from Lowe et al. (2011), which addresses the problems of scale content and scale construction that are exacerbated by but not unique to the problems found …
