Deterrence Versus Brutalization: Capital Punishment's Differing Impacts Among States, Joanna M. Shepherd

Recent empirical studies by economists have shown, without exception, that capital punishment deters crime. Using large data sets that combine information from all fifty states over many years, the studies show that, on average, an additional execution deters many murders. The studies have received much publicity, and death penalty advocates often cite them to show that capital punishment is sound policy.

Indeed, deterrence is the central basis that many policymakers and courts cite for capital punishment. For example, President Bush believes that capital punishment deters crime and that deterrence is the only valid reason for capital punishment. Likewise, the Supreme …

This Article challenges liberal and conservative assessments of Lawrence, Gratz, and Grutter. Although the outcome of these cases might indeed prove helpful to the agendas of social movements for racial and sexual justice, progressive scholars and activists should not receive these cases with elation. Instead, the research of constitutional theorists, critical legal scholars, and political scientists allows for a more contextualized and guarded account of and reaction to these decisions. Under what conditions is the United Nations High Commissioner for Refugees (UNHCR) able to successfully repatriate and reintegrate refugees to their country of origin? This work aims to evaluate the success of UNHCR's initiative to sponsor the repatriation and reintegration of political refugees who voluntarily chose to return to their homeland. The study of political refugees is essential in International Relations, since it entails the failure of preventing ethnic violence and civil unrest. Since their inception, the actual use of nuclear weapons in conflict is extremely limited. There have been only two documented occurrences which were committed exclusively by the United States. By contrast, however, state posturing with nuclear weapons occurs with regularity transcending historical situations, national wealth, military power, or even the actual possession of nuclear weapons. Rationalist arguments that depict nuclear posturing as a means of deterrence appear insufficient given its tendency to unbalance perceptions of equilibrium, and the public nature in which it occurs. Do democratic norms and political culture play a greater role than structural determinants in realizing a democratic peace? Alexis de Tocqueville, a hitherto unappreciated theorist of international politics, offered such a view 175 years ago. This article examines Tocqueville's perspective on civil-military relations and the connection between democracy and peace. Tocqueville concludes that the key to the pacifism of a democracy is the equality of conditions it enjoys and the education that its soldiers receive prior to entering the military. Thus, in Tocqueville's estimation, the democratic peace has little to do with the practice of democracy, and everything to do …

We explain how to use elicited priors in Bayesian political science research. These are a form of prior information produced by previous knowledge from structured interviews with subjective area experts who have little or no concern for the statistical aspects of the project. The purpose is to introduce qualitative and area-specific information into an empirical model in a systematic and organized manner in order to produce parsimonious yet realistic implications. The purpose of this paper is to uncover the effects of background characteristics on members of Congress' legislative activity. I intend to measure legislative activity using the total number of bills sponsored and cosponsored during each Congress. Beginning in 1973, this original dataset includes over 6,000 observations and is the most comprehensive study of this subject. Because my dataset begins in 1973, I will be able to identify any effect that the unrestricted ability to cosponsor, which began in 1978, had on legislative activeness. This paper examines a unique aspect of Congressional history centering on the passage of the 17th amendment in 1913, which shifted the power of U.S. Senate elections from the state legislature to state electorates. This paper examines how the passage of the amendment affected the relationship between characteristics of the state electorate and the roll call behavior of U.S. Senators. In examining one’s level of religious involvement and orthodoxy of worship, several authors have found significant correlations between levels of these variables and an attachment to political parties, particularly the Republican Party (Layman, 1997). My analysis of a 2002 ABC News/Washington Post poll (ICPSR, 2002) finds that the same mechanism that is indicative of partisanship also influences and reinforces evangelicals’ sympathies toward Israel. While the Republican and Evangelical variables are statistically significant with respect to an elevated level of sympathy toward Israel, the interaction effect of these two variables is the most noteworthy product of this analysis. Empirical research on U.S. foreign policy has largely assumed that the president’s influence is subordinate to global and domestic political constraints. This idea is given further weight by the fact that, even within the political psychology literature, there is scant large-n, quantitative evidence supporting the notion that leaders matter. This study is an attempt to explore the influence of U.S. presidential psychological characteristics on foreign policy actions through assessment of two operational code constructs: “image of the political universe” (P-1), and “strategic preferences” (I-1). This article explores Alan Gewirth’s argument for a secular foundation for the idea of human rights as a possible response to Michael J. Like Sunstein and other advocates of 'republican' or 'civic' liberalism, I believe that it is historically unsound and politically unwise to insist on a sharp distinction between liberalism and republicanism. Others disagree, however, and there is much to be learned from their position even if, ultimately, we should not adopt it. Several key factors explain the incremental approach to election law after the 2000 presidential election. The close election in Florida spurred lawmakers in Virginia to create the Joint Subcommittee Studying Virginia's Election Process and Voting Technologies. This special subcommittee was formed to learn more about the capacity of election administration. Through that process, Virginia officials concluded that the election system was fundamentally sound, though they identified a need for additional resources to increase staff, improve polling place access for disabled voters, and clean up registration rolls. Prior to the 2004 federal election the Australian Greens were rising as the third force in the Australian political system. At the 2001 election they secured an increased share of the vote and returned a second Senator. Conversely the Australian Democrats, held to be the third force in Australian politics went backwards in 2001, losing a Senate seat. From 2001 to 2004 the Greens polled strongly and were buoyed by increased support for their anti-Iraq war and pro-refugee positions. As a party they appeared to be moving beyond single-issue status. The 2002 National Security Strategy for the United States focused American strategic policy around the use, or potential use, of preemptive/preventive strikes, particularly as a counter-proliferation and counter-terrorism tool. The United States Constitution is designed to achieve good government by relying on two distinct systems: a primary system that achieves good governance through democratic electoral accountability; and a set of self-sustaining structural backup systems designed for situations in which the democratic system fails, and which operate by limiting the ability of bad rulers to do serious harm to the public good. Candidates seeking public office must build a strong political following to be successful. This applies at national, state, and even local levels. The support generated for a candidate's campaign can be attributed to factors such as personal characteristics, political following, political resources, and endorsements. This analysis focuses on union endorsements in relation to other political endorsements. The case study of the race for Snohomish County Council in District Five illuminates the connection between endorsements, monetary contributions, and voting behavior. This research project looks at the data at the national level as well as the regional levels in order to see if the data is functioning differently at the different levels.
