May I first pay compliments to the leadership of the Asian Development Bank for hosting this seminar. Asia has a huge stake in the success of the WTO generally, and the Doha Round specifically, but not everyone realizes that. So seminars of this _ nature are terribly important in providing focus to the Doha Round, encouragement to the negotiators, and in building public support for this endeavor. Let's hope we can accomplish those objectives here in Osaka.

This paper analyzes the opportunities and tensions generated by efforts to use conservationbased tourism as a catalyst for economic development. By exploring how historical legacies position actors and influence relationships between them, characterizing the nature tourism sector and its logic, and examining how liberalizing states are likely to engage with community-based tourism. I situate community-based nature tourism ventures in a broader political economic context. The paper draws from research on the Makuleke Region of Kruger National Park, South Africa to illustrate how these factors influence prospects for community benefit from protected area tourism. The livestock sector has significant potential for improving the livelihoods of landless people and small and marginal farmers, who comprise the majority of India’s rural poor. However, resource and institutional constraints prevent poor producers from realizing the full potential of the animals they possess. Developing effective pro-poor livestock policies requires consideration of the political context and attention to the specific characteristics of poor livestock producers.

This thesis proposes that two of the most serious threats to modern American democracy are declining voter participation and rising perceptions of election fraud. The thesis provides examples that these problems do in fact exist and have been becoming more pronounced in the past twenty years. Of particular interest is that in many elections, especially local elections held separately from national elections, decisions are made by fewer than thirty percent of eligible voters, raising the question of how legitimate the elections really are. The relationship between black constituency size and congressional support for black interests has two important attributes: magnitude and stability. Although previous research has examined the first characteristic, scant attention has been directed at the second. This article examines the relationship between district racial composition and congressional voting patterns with a particular emphasis on the stability of support across different types of votes and different types of districts. We hypothesize that, among white Democrats, the influence of black constituency size will be less stable in the South, owing in part to this region’s more racially divided constituencies. This paper examines how international agreements are substitutes for statutes. The statutory law-making system and international agreement negotiations are separate, but sometimes rival, processes for setting national-level policy. International agreements have several advantages over domestic statutes. Under United States law, international agreements can entrench policies that might otherwise be subject to change; they can transfer agenda-setting power from the Congress to the President; and they can delegate authority to international organizations. Each of these effects can lead domestic interest groups to seek international negotiations rather than domestic legislation. We suggest a Tournament of Judges where the reward to the winner is elevation to the Supreme Court. Politics (and ideology) surely has a role to play in the selection of justices. However, the present level of partisan bickering has resulted in delays in judicial appointments as well as undermined the public's confidence in the objectivity of justices selected through such a process. More significantly, much of the politicking is not transparent, often obscured with statements on a particular candidate's "merit"- casting a taint on all those who make their way through the judicial nomination process. Recent work in modeling decision-making work processes has focused on including the national culture of individual decision-makers in order to emphasize the differences in decision criteria between decision-makers of different nationalities. In addition to nationality, a decision-maker is also a member of an organization and brings this organizational culture to his role in the work process, where it may also affect his task performance. In order to represent the organizational impact on the work process, five organizational cultural parameters were identified and included in an algorithm for modeling and simulation of cultural difference in human decision-making. Do payday loan customers form a growing share of bankruptcy petitioners, as many media reports claim? This paper attempts to answer that question and others by analyzing a sample of 3600 bankruptcy petitions filed in selected U.S. counties. From the petitions we can determine the share of debtors that files with payday loans; whether that proportion has been increasing in recent years; how these petitioners compare to other debtors; and whether payday loans are a significant factor in the financial crisis these debtors experience.

Primarily located within legal frameworks that focus on civil and political rights, the right to health is more frequently being used to challenge abuses of health by invoking social and economic rights, even though this places the right to health on slippery terrain that is not as internationally accepted as civil and political rights.

Access to health is an often-overlooked aspect of the right to health. Without practical access, the right to health becomes an empty promise. This thesis examines the Judges Club of Egypt [JCE] between January 1985 and March 2004. My research demonstrates that Egyptian judges rely on the JCE as a space for defending democratic reform and the independence of the Judiciary in Egypt. I will argue that while several laws and internal regulations within the Egyptian judicial structure forbid judges from being involved in any political activity, Egyptian judges craft strategic discursive mechanisms for expanding the role of the JCE beyond its seemingly confined function within the court. In 1960, John F. Kennedy, a wealthy New England Catholic, traveled to a rural, Protestant state to contend in an election that few thought he could win. While many scholars have examined the impact of Kennedy’s victory in the West Virginia primary, few have analyzed the importance that his visit to the state in 1960 and his ensuing administration had on West Virginia. Kennedy enacted a number of policies directed specifically toward relieving the poverty that had plagued West Virginia since statehood. The rule of law is one of the most important components of any explanation of cross-national differences in economic well-being. But what leads to better rule of law in a country? Using an institutional approach this paper probes the effect of legal systems in influencing the rule of law. There has long been speculation that the countries adopting English common law are better at providing legal dispute resolution than those adopting the continental forms of civil law. That speculative assessment is found to be true only in those countries that have been colonized, further analysis demonstrates that it is the …

Retributive Justice: The Gacaca Process In Rwanda, Sandra F. Joireman, Allison Corey

After decades of cycling violence between Hutu and Tutsi groups in Rwanda and Burundi, violence peaked in 1994 with a genocide of Tutsis in Rwanda, during which the Hutu majority slaughtered 800,000 Tutsi and moderate Hutus, leaving the country with 120,000 accused génocidaires awaiting trial. Rwanda's gacaca courts were established as a response to the backlog of untried genocide cases. These courts disturbingly distinguish between genocide and war crimes committed during the same era, trying only those accused of genocide. This article argues that the gacaca process will contribute to the insecurity of all Rwandan citizens in the future, since …

Communitarianism and republicanism are closely related schools of thought - so closely related that friend and foe alike sometimes conflate them. The relationship is evident in their Latin roots: communitarians are concerned with communitas, the common life of people who form a community, and republicans are devoted to the res publica, the good of the public. Of the two, however, only republicanism traces its lineage as well as its name to ancient Rome. Indeed, scholars often look beyond Rome to the philosophers and city-states of ancient Greece, particularly Aristotle and Sparta, for the origins of republicanism. For the …
