A Vote Cast; A Vote Counted: Quantifying Voting Rights Through Proportional Representation In Congressional Elections, Michael Mccann

The current winner-take-all or first-past-the-post system of voting promotes an inefficient market where votes are often wasted. In this system, representatives are selected from a single district in which the candidate with the plurality of votes gains victory. Candidates who appear non-generic can rarely, if ever, expect to receive the most votes in this system. This phenomenon is especially apparent when African-Americans and other minority groups seek elected office. In part because white voters constitute at least a plurality of voters in every state except Hawaii, minorities in the forty-nine other states have had historically little success in gaining election …

A Positive Political Model Of Supreme Court Economic Decisions, Tony Caporale, Harold Winter

We develop a positive political model of the U.S. Supreme Court. Looking at the Court's economic cases for the period 1953-1993, we find a significant larger fraction of conservative decisions under Republican presidents and more conservative leadership of the House and Senate Judiciary Committees. Conservative decisions are also found to be positively correlated with the fraction of the Court appointed by Republican presidents and the rate of price inflation. We argue that our findings cast serious doubt on the common view of the Supreme Court as a completely independent, apolitical institution.

What are the real prospects for lasting peace and greater prosperity in post-war Guatemala? This is the central question underlying Susanne Jonas's Of Centaurs and Doves and Christopher Chase-Dunn, Susanne Jonas, and Nelson Amaro's Globalization on the Ground. As events continue to unfold for Guatemalans, these scholars tackle the very current issues of democratization, development, justice, and peace in post-war Guatemalan society. The cruel irony is that the very urgency with which these issues must be addressed belies any concrete prediction or even refined characterization of the existing situation.

One of the basic aims of the Spanish empire was to spread the Christian faith in its colonies. In the Philippines, this materialized with the arrival of Ferdinand Magellan in 1521 and its subsequent colonization by Miguel Lopez de Legazpi in 1565. The regular clergies known as friars were responsible in imparting the Christian faith to the locals who absorbed the new faith wholly, albeit, preserving their traditional beliefs to a certain extent. Though Christianiation was successful, the secularization process whereby parishes were to be handed to the secular clergies was denied. This failure had a Jong lasting effect which …

This Article responds to the advocates of "progressive race blindness" with several critiques of their central claims. Part I examines the contours of progressive race blindness in greater detail, giving centrality to the emergence of this theory in legal scholarship. Part I sets forth the common themes articulated in progressive race blindness arguments and highlights important differences among its proponents. Part II isolates several problems with the progressive race blindness literature and demonstrates that these weaknesses make the literature unhelpful as a political or legal theory and even dangerous to the cause of antiracism. Anti-Minority Riots In Unified Germany: Cultural Conflicts And Mischanneled Political Participation, Roger Karapin

Anti-foreigner riots in eastern Germany in the early 1990s have usually been explained by ethnonationalism or racism, ethnic competition for scarce resources, and opportunistic political elites. If anti-minority riots are analyzed as a distinct phenomenon with a cross-sectional approach, local political processes emerge as more important causes. Cultural conflicts, the channeling of mobilization from nonviolent into violent forms, local political opportunities for success, and mobilization by social movement organizations convert ethnic conflict and violence into riots. A comparison of riot and non-riot localities in eastern Germany supports this argument.
