The Role Of Recognition In Kelsen's Account Of Legal Obligation And Political Duty, David Ingram

Philosophy: Faculty Publications and Other Works

Kelsen’s critique of absolute sovereignty famously appeals to a basic norm of international recognition. However, in his discussion of legal obligation, generally speaking, he notoriously rejects mutual recognition as having any normative consequence. I argue that this apparent contradiction in Kelsen's estimate regarding the normative force of recognition is resolved in his dynamic account of the democratic generation of law. Democracy is embedded within a modern political ethos that obligates legal subjects to recognize each other along four dimensions: as contractors whose mutually beneficial cooperation measures esteem by fair standards of contribution; as autonomous agents endowed with equal rights; as …

This article tempts to verify the intricate dynamics of political alliances between Islamist groups and opposition parties in Indonesian elections, focusing on the 2018 West Java gubernatorial contest. The study employs exit poll data, investigating the relationship between religiosity, politico-religious narratives, and voting behaviour. While the mobilising power of Islamist groups appeals to political parties, creating a temporary alliance, these do not guarantee electoral triumph even in a conservative region. The politico-religious propaganda, in principle, consolidates Islamist-inclined voters. Despite high levels of religiosity among voters, the alliance's strategies fail to convey this religious mobilisation into broad electoral success. This underscores …

This dissertation examines the relationship between purity and order, and the ways this relationship informs and reproduces exclusionary forms of governance. The starting point for this analysis is the puzzling use of the language of limpieza social [social cleansing] as a justification for violence in Latin America. Such language is publicly disseminated by vigilantes, criminal organizations, paramilitaries, and other extralegal armed actors as a frame for violence against those presumed to be criminals, drug users, sex workers, unhoused, LGBTQ, or mentally ill. In this essay, I will define cultural institutionalization and articulate the ways in which the phenomenon modulates subversive countercultural movements and integrates them into Western, capitalist cultural structures. I will then illustrate my theory of cultural institutionalization by analyzing three historical case studies of subversive countercultural movements in the United States. The first of which will be the drag queen phenomenon, which provides the most convincing case for the theory in the artistic sphere. As the hegemonic form of international trade, transnational supply chains are potent symbols of global interdependence that can appear as both a cause of precarity, when oriented to them as a worker subjected to capital mobility and corporate domination, and as a welcome cushion to precarity, when oriented to them as a consumer seeking low prices and convenience. This paper provides a review and discussion on the emancipatory potential of the notion of ‘precarity’. Since the 1980s, the notion of ‘precarity’ has been used increasingly by scholars and activists to account for variegated grievances. Specifically, it has been used to address issues related to the transformations of labour in the XXIst century: neoliberal reorganization of labour markets, increasing unavailability of stable jobs, increased personal debts, debilitating labour unions or the lack of accessible housing among other issues. Now is a propitious time to re-examine the present forms and political implications of precarity. As my colleagues and I write the essays for this special issue of Emancipations, questions abound regarding the manifestations of precarity that have appeared since popular movements in France first adopted the slogan of ‘the precariat’ in the early 2000s. Then, ‘precarity’ fit as an intuitive name for people’s negatively altered living and working conditions as national governments, corporations and supra-national institutions consolidated neoliberal transformations as, indisputably, the new norm. Two decades hence, should this situation simply be reaffirmed as the not-so new normal?

Once the apartheid system in South Africa ended in the early 1990s, spatial planning in Cape Town needed to be reassessed to address its historically-racialized use. Led by city planners, this assessment resulted in the 1996 Municipal Spatial Development Framework (MSDF) Technical Report. Yet, there ended up being a disconnect between planning and implementation, and by the late 2000s, economic growth and development had largely remained in the historically-white areas of the city. Meanwhile, historically-Black neighborhoods and communities of color remained systemically neglected. In 2012, a new MSDF was approved to address the shortcomings of these efforts. To illustrate the logic and grammar of coercion, this analysis relies on decision-theory methods, such as game theory, that examine the strategic decision-making process in interactions with adversaries and partners. The intent here is not to offer predictive models of rational-actor behavior. Rather, the intent is to use game-theory and similar approaches to understand how coercion works better. This analysis considers competitive interactions between actors that have discrete and qualifiable, if not quantifiable, preferences and who behave rationally, though this analysis acknowledges the behavior that is considered rational is frequently informed by nonrational social, cultural, and psychological factors. In the American bipartisan system, ideologies and beliefs create political views that sort voters between two groups. Political sorting increases polarization based on cultural preferences for an in-group that become ethnocentric views, which develop into ethnocentric cultural politics. I present an augmented concept of authoritarianism in America that encompasses sorting based on aspects of political belief, encapsulating sources of polarization and cultural attachments to political associations.

I develop the argument that authoritarianism is the result of political attachment to identities that feed off one another as individuals identify with an in-group, such as a party platform. My central theory is …

Addressing the urgent issues facing humanity today, in his recent encyclical on social friendship, Fratelli Tutti, Pope Francis reminds us that it is “all the more urgent that we rethink our styles of life, our relationships, the organization of our societies and, above all, the meaning of our existence” (no. 33). In this and in his previous encyclical on care for creation, Laudato Si’, Francis makes clear that we do not have a moment to waste. This essay describes the advocacy of Archbishop Antonio J. Ledesma, currently the co-president of Pax Christi Philippines and archbishop emeritus of the archdiocese of Cagayan de Oro, Mindanao, Philippines, towards peace and development not only in Mindanao but also throughout the country. He is a strong proponent of interreligious dialogue and the importance of addressing the roots of the armed conflict so there can be an enduring peace in the Philippines and beyond.

Bishop Macram Max Gassis is a near-legendary figure in Sudan since he first spoke out against human rights abuses in his country before a committee of the US Congress in 1988. Targeted by the Islamist military dictatorship which ruled Sudan for thirty years, for protesting enslavement, religious oppression, forced starvation and mass murder in Sudan, he lives in exile, bringing help and hope to his persecuted people.

Archbishop Denis Hurley, OMI (1915-2004) was a major figure in mobilising the Catholic Church’s struggle against apartheid in South Africa. Rooted in Catholic Social Thought and an active participant and implementer of Vatican II, he led by example, moving the Southern African Catholic Bishops Conference (SACBC) into one of the foremost religious defenders of human rights. His theological skills and personal courage translated in ecumenical and interfaith activities that served justice and peace. He supported conscientious objectors and faced prosecution for exposing state atrocities in Namibia.

This paper studies Marin Luther King, Jr.’s and Desmond Tutu’s strivings for justice and reconciliation as the leaders of movements against white racist systems in the US and South Africa. Despite their differences in terms of nationality, age, religious denomination, and geography, the paper demonstrates how King’s and Tutu’s quests were grounded in the distinctive communal ethics informed by their Christian faith and their shared spiritual heritage as African peoples, which emphasize community, the ubiquity of religion, the moral order of the universe, and hopefulness.
