Book Review: Courtrooms And Classrooms: A Legal History Of College Access, 1860-1960, Mark A. Addison

Journal of College Access

Issues of college access are increasingly met with resolutions within social and economic contexts. Models such as cost of production output, and race and socioeconomic-conscious strategies form the basis of such analyses (Jenkins & Rodriguez, 2013; Henriksen, 1995; Treager Huber, 2010; Schmidt, 2012). We can expect retooling and reinventing of such models with increasing college costs and changes in student demographics.

Islamic Terrorism In The United States – The Association Of Religious Fundamentalism With Social Isolation & Paths Leading To Extreme Violence Through Processes Of Radicalization., Shay Shiran

Student Theses

This exploratory study focuses on identifying motivations for religious terrorism and Islamic terrorism in the United States in particular. Terrorism is a crime of extreme violence with the end purpose of political influence. This crime is challenging to encounter for its multi-faced characteristics, the unusual motivations of its actors, and their semi-militant conduct. The hypothesis of this study asserts that religious terrorists are radicalized by passing from fundamental to extreme devout agendas, caused by isolation from the dominant society, and resulted in high potential to impose those agendas by extreme violence. Under the theoretical framework of subculture in criminology, this …

Legislation Meets Tradition: Interpretations And Implications Of The Volunteer Protection Act For Nonprofit Organizations As Viewed Through The Lens Of Hermeneutics, Patricia Groble, Nicholas C. Zingale, Joseph Mead May 2018

Legislation Meets Tradition: Interpretations And Implications Of The Volunteer Protection Act For Nonprofit Organizations As Viewed Through The Lens Of Hermeneutics, Patricia Groble, Nicholas C. Zingale, Joseph Mead

Journal of Public Management & Social Policy

Volunteers enable nonprofit organizations to reach more clients and more effectively fulfill their missions. However, the good done by these volunteers may be offset by their careless behavior. Rising fears that resulting lawsuits and monetary damages would deter potential volunteers from volunteering caused Congress to enact the Volunteer Protection Act. This research studies court decisions to ascertain whether the law fulfills its purpose and considers the implications of these interpretations for nonprofit managers. It also tests the usefulness of the hermeneutical approach to legal interpretation and to determine how the Act has changed as a result of these court decisions …

Exploring District Judges' Decision Making In The Context Of Admitting Expert Testimony, Andrew Bryan Dzeguze May 2018

Exploring District Judges' Decision Making In The Context Of Admitting Expert Testimony, Andrew Bryan Dzeguze

Dissertations and Theses

Over the last several decades, multiple schools of thought have emerged regarding what impacts judicial decision making. In contrast to the classic legal model, studies have argued alternatively that judges are policy actors who rule consistent with their political attitudes; that behavioral traits such as race, gender and socialization influence judicial conduct, both consciously and unconsciously; that whatever policy interests judges may have, these are moderated by institutional constraints and strategic considerations; and that judges are subject to some common cognitive shortcuts in decision making, although they may be moderated or present differently than in the general population in light …

Domestic And International Firearm Laws: Can Implementation Be Used To Nationally Decrease Firearm Violence And Mass Shootings, Kenneth Banuelos May 2018

Domestic And International Firearm Laws: Can Implementation Be Used To Nationally Decrease Firearm Violence And Mass Shootings, Kenneth Banuelos

Themis: Research Journal of Justice Studies and Forensic Science

The issue of firearm violence in the United States is highly controversial, as there are sound arguments on both sides of the discussion. Advocates of stricter gun laws often refer to both international and domestic examples that highlight the effectiveness of more restrictive firearm policies. Japan and Australia are two such countries that are continually referred to when a tragedy, such as a mass shooting, occurs in the United States and initial reactions often emphasis a need for fewer guns in the general public. Opposition to the proposed reforms of firearm policies cite the importance of the Second Amendment which …

The Significance Of Mongolia's Foreign Policy And Security Apparatus On A Global And Regional Scale, Bolor Lkhaajav May 2018

The Significance Of Mongolia's Foreign Policy And Security Apparatus On A Global And Regional Scale, Bolor Lkhaajav

Master's Projects and Capstones

Mongolia, land-locked between two politically, economically, and militarily powerful nations — Russia and China — often must balance its foreign and security policies with its two neighbors and countries beyond. When discussing Mongolia’s foreign policy and security apparatus, historians and scholars look at the international relations of East Asia as a whole. This is the case not because Mongolia’s foreign policy is insignificant but because greater powers impose greater influence on smaller states. Mongolia’s partial involvement in World War II (WWII), and the Cold War introduced new challenges as well as opportunities for Mongolia to modernize its foreign policy principles …

Mineral Warfare: The Dark Side Of Technology And International Mediation, Priyanka Basnyat May 2018

Mineral Warfare: The Dark Side Of Technology And International Mediation, Priyanka Basnyat

Master's Theses

Conflict surrounding the extraction and trade of natural resources is not an uncommon phenomenon. Especially in the case of the Democratic Republic of Congo (DRC), which has historically suffered from the negative impacts of the resource curse since their mineral wealth was first discovered by their Colonial administrators. The importance of Congo’s minerals has fluctuated over the years but has peaked during recent times, as their use in technological advancements are becoming more vital. The global demand for these mineral ores have sky rocketed and consequentially, the largely informal trade has benefitted certain rebel groups, playing a pivotal role in …

An Illiberal Union, Sonu Bedi May 2018

An Illiberal Union, Sonu Bedi

William & Mary Bill of Rights Journal

This Article breaks new ground by applying the philosophical framework of liberal neutrality (most famously articulated by John Rawls) to the United States Supreme Court’s jurisprudence on marriage. At first blush, the Court’s decision in Obergefell v. Hodges—the culmination of marriage rights—seems to affirm a central principle of liberalism, namely equal access to marriage regardless of sexual orientation. Gays and lesbians can finally take part in an institution that celebrates the union of two committed individuals. But perversely, in its attempt to expand access to marriage, the Court has simultaneously entrenched values that are antithetical to the basic tenants …

Institutional Dissonance And Reserved Cooperation: Theory And Evidence From International Environmental Agreements, Erika Komura Masaki May 2018

Institutional Dissonance And Reserved Cooperation: Theory And Evidence From International Environmental Agreements, Erika Komura Masaki

UNLV Theses, Dissertations, Professional Papers, and Capstones

As global environmental problems have received more attention in the international arena, questions of global environmental governance have become more salient. The increase of international and multilateral environmental agreements has raised questions about participation, compliance, and ultimately, effectiveness of these institutions. Consequently, this dissertation seeks to understand what factors affect participation in and compliance with international environmental agreements. Specifically, I find that treaty design plays a critical role in levels of participation. Using both qualitative and quantitative analysis, I also examine the case of the Convention on International Trade in Endangered Species (CITES) as a case study, and find that …

Frictions In Transitional Justice Processes: Colombia's Victims Law, Integral Reparation And The Temporality Of Multiple Victimization In Displaced Women, Sophie Rähme May 2018

Frictions In Transitional Justice Processes: Colombia's Victims Law, Integral Reparation And The Temporality Of Multiple Victimization In Displaced Women, Sophie Rähme

Gobernar: The Journal of Latin American Public Policy and Governance

This article addresses the challenges that integral reparation programs meet when aiming to respond to multiple victimization experienced by displaced women. By adopting the ethnographic concept of “frictions” (Tsing, 2005), I analyze four dimensions of discursive frictions that occur surrounding reparative practice backed by the Law on Victims and Land Restitution and its multiple local encounters and dis-encounters when compensating multiple victimization in the post-conflict of Medellín. Like other studies have identified shortcomings of the idealistic and innovative Colombian reparation program, it becomes evident that the integral reparation efforts fall short in addressing the real complexity of interrelated and multiples …

Proposition 47 And Crime: A Difference In Differences Analysis Of Incarceration Rates And Crime Using Border Counties, Brian J. Fischer

Theses and Dissertations

California passed Proposition 47 by vote and changed the way the state punishes drug and theft. I find an increase in crime using a difference in differences model by computing the change in thefts with the change in inmates. This effect sides with anecdotal claims and disagrees with empirical studies.

Non-Traditional Transitional Justice Mechanisms And Perceptions And Symptoms Of Victimization Among Diasporic Individuals: Members Of The Coptic Christian Diaspora In The United States As A Case Study, Samy S. A. Gerges May 2018

Non-Traditional Transitional Justice Mechanisms And Perceptions And Symptoms Of Victimization Among Diasporic Individuals: Members Of The Coptic Christian Diaspora In The United States As A Case Study, Samy S. A. Gerges

Doctor of International Conflict Management Dissertations

Transitional justice measures are state-centered measures articulating atrocities committed by officials and occurring within the borders of a specific state. Questioning members of a Diaspora about the impact of transitional justice on their self-classification as victims and their experienced symptoms of victimization may therefore support attempts to expand the field of transitional justice. This study contributes to a body of work promoting understanding of the possibilities and constraints of transitional justice mechanisms, in the context of hate crime against Copts by Muslims in Egypt. To analyze the impact of restored relationships on self-classified victimhood and experienced symptoms of victimization, the …

The Presbyterian Enlightenment: The Confluence Of Evangelical And Enlightenment Thought In British America, Brandon S. Durbin May 2018

The Presbyterian Enlightenment: The Confluence Of Evangelical And Enlightenment Thought In British America, Brandon S. Durbin

Masters Theses, 2010-2019

Eighteenth-Century British American Presbyterian ministers incorporated covenantal theology, ideas from the Scottish Enlightenment, and resistance theory in their sermons. The sermons of Presbyterian ministers strongly indicate the intermixing of enlightenment and evangelical ideas. Congregants heard and read these sermons, spreading these ideas to the average colonist. This combination helps explain why American Presbyterians were so apt to resist British rule during the American Revolution. Protestant covenantal theology, derived from Protestant reformers like John Calvin and John Knox, emphasized virtue and duty. This covenant affected both the people and their rulers. When rulers failed to uphold their covenant with God, the …

On The Politics And Conceptualization Of Gender Non-Conformity : Exploring Thailand’S Kathoey Population., Macey E. Mayes

College of Arts & Sciences Senior Theses

The purpose of this thesis is to investigate the politics and conceptualization of gender in Thailand, drawing specifically on the Thai understanding of sex and gender with regard to the kathoey population. This work considers the solidification of a third-gender category and looks to the ways this solidification can inhibit the fluidity of gender and sexuality. It also analyzes the dangers of transnational advocacy and the superimposition of Western queer advocacy and theory on Thai gender identities. I approach this issue from an interdisciplinary framework that seeks to include historical, cultural, and theoretical perspectives. In examining anthropological research, critiques of …

Exploring Creative Problem Solving In Public Policy, Jade A. Costello May 2018

Exploring Creative Problem Solving In Public Policy, Jade A. Costello

Creativity and Change Leadership Graduate Student Master's Projects

This project explores the connection between creativity and public policy-making through guided facilitation. In this exploration, there are several products that have been developed. The first is an index that provides definitions, charts, and process explanations for creativity, facilitation and public policy. The second is a completed facilitation plan that incorporates both the FourSight model for group facilitation (Miller, Vehar, Firestein, Thurber & Nielsen, 2011a) and Marvin Weisbord’s (1992) exploration of creative strategies for discovering common ground through policy conferences. The third product is an evaluation matrix, which would be used post-facilitation to understand the strengths and weaknesses from the …

How have Section 301 investigations impacted trade relations between China and the U.S. in clean energy area, and between Japan and the U.S. in semiconductor and auto part areas, and does the impact provide a guide for the possible outcome of the upcoming Section 301 investigation of China?

After President Donald Trump’s memorandum on August 14, 2017 stating that China’s behavior regarding intellectual property rights (IPR) and the high technology industries adversely influences the U.S. economy, the United States Trade Representative (USTR) declared the initiation of a section 301 investigation of China on the topic of technology transfer and intellectual …

The Two Foundings Thesis, Sonu Bedi, Elvin T. Lim May 2018

The Two Foundings Thesis, Sonu Bedi, Elvin T. Lim

Research Collection School of Social Sciences

Constitutional interpretation generates intense debates over rights and powers. Countless U.S. Supreme Court decisions, articles, and books discuss these debates. With regard to powers, these debates often center around a nationalistic view of the U.S. Constitution, where the U.S. Congress has broad and expansive powers, or a states’ rights view of the document, where Congress has narrow and limited powers.1 With regards to rights, these debates often center around an emphasis on a moral reading of various clauses2 versus an emphasis on originalism

Oops!... I Infringed Again: An Analysis Of U.S. Copyright And Its Intended Beneficiaries, Gabriele A. Forbes-Bennett

Student Theses and Dissertations

This paper seeks to establish the reasons why federal copyright protection was created, discuss the shifts in reasoning behind major amendments, and explore its effects on copyright holders and the public, with a slight focus on the music industry. Federal copyright has existed in the United States since the late 1700s, with the creation of the Copyright Act in 1790. Adopted from the first copyright law ever created, the English Statute of Anne (1710), the Copyright Act was meant to protect citizens from piracy in a world where the risk of such a thing was rapidly increasing. The stated objective …

Impact Of 2001 - 2016 Supreme Court Establishment Clause Cases, Nicole Cumming

Honors Theses

This study will look at United States Supreme Court Establishment Clause cases from 2001-2016. During those 16 years, the Court decided 1,276 cases. Only 10 of those cases dealt with the establishment clause.

At an absolute minimum, the Establishment Clause was intended to prohibit the federal government from declaring and financially supporting a national religion, which existed in many other countries at the time of America's founding. This idea has become vital to the values Americans hold dear. Throughout history, religious freedom and tolerance have been celebrated, and most of that is due to the Establishment Clause. However, there is …

Congressional Redistricting: Keeping Communities Together?, Kalyn M. Rossiter, David W. S. Wong, Paul L. Delamater

Geography Faculty Scholarship

The process of congressional redistricting, delineating boundaries for districts in which voters elect members to the U.S. House of Representatives, has always been an expensive and controversial process. Congressional districts (CDs) are redrawn due to changes in population reflected by the decennial census to ensure equal representation. Laws and regulations literature identifies eight criteria that may be considered when determining the boundaries of CDs and this article focuses on one of those criteria, maintaining communities of interest (COIs). This criterion requires states to preserve these boundaries when delineating CDs but fails to define a COI. This research proposes and evaluates …
