Examining Remorse In Attributions Of Focal Concerns During Sentencing: A Study Of Probation Officers, Colleen M. Berryessa

This research, using interviews with probation officers in the United States (n = 151) and a constant comparative method for analysis, draws from the focal concerns framework to qualitatively model a process by which probation officers use a defendant’s remorse to attribute focal concerns in order to guide their sentencing recommendations in pre-sentencing reports. The model suggests that officers use expressions of remorse to make attributions about mitigated criminal intention (blameworthiness and notions of responsibility), reduced dangerousness and a high potential for reform (community protection), and organization-level effects for increasing caseload efficiency and using correctional resources (practical effects of …

The right to an attorney is a one to which all U.S. citizens are entitled, in conjunction with the constitution's sixth amendment. Difficulty arose when people who were unable to provide necessary funds to hire a lawyer and, subsequently, went into trial pro se. Resolution was met with the creation of the public defense system -- a system which is unfortunately understudied, and sometimes regarded in a negative light, including a negative perception that public defense is a broken system. Law-abiding citizens are concerned with deterring and preventing crime. One strategy to accomplish this goal is to increase the costs and reduce the benefits that particular situations present to offenders. This form of crime control is known as situational crime prevention. Like law-abiding persons, offenders must concern themselves with being victimized. Differently, however, offenders must also worry about being detected and punished by formal agents. Thus, situational prevention from the offenders’ perspective is relatively complex, encompassing efforts to block not only opportunities for victimization but also for law enforcement.
