This paper will examine prison rape by exploring sexual abuse rates, the causes of underreporting, the gender-based prison and rape cultures, reasons why victims are targeted, and the impact The Prison Rape Elimination Act (PREA) has had on the issue. It draws on both qualitative research and national surveys. Findings have shown that sexual victimization is much more widespread than indicated by official reports due to high rates of underreporting, fears of retaliation, and flawed implementation and enforcement of PREA’s policies. Culture in male prisons are shaped by hypermasculine hierarchies that discourage reporting, while female prisons experience disproportionately high rates …

The Brady doctrine requires prosecutors to disclose all favorable and material evidence to the defense. To effectuate that rule, the U.S. Supreme Court has defined materiality as a “reasonable probability” that the evidence would have affected the outcome at trial. But apart from that definition, the Court has resisted offering any further guidance to lower courts. While far too little is known about how Brady materiality claims are actually adjudicated, there is strong evidence that courts often reject Brady claims involving withheld evidence on the grounds that the evidence was not significant enough to be material.

One of the most common types of cybercriminal groups are, “Ransomware-as-a-Service (RaaS)" groups, who create and sell ransomware. While research is conducted into the development of ransomware, there is limited reporting on the organizational structure and habits of RaaS groups. In 2022, prominent RaaS group Conti had their chat logs leaked, with the logs ranging from 2020 to 2022. This thesis examines the incarceration of Latina women in the United States through an intersectional lens that centers ethnicity, gender, and class, among other factors. While mass incarceration has been widely studied, Latina experiences are often overlooked or reduced to statistics, making their specific pathways into and through the criminal legal system largely invisible. This project argues that Latina incarceration is not simply the result of individual behavior, but is shaped by overlapping systems of structural inequality. This study critically examines how neoliberal social controls and school-based criminalization efforts emerged in response to a series of moral panics surrounding perceived increases in school violence and mass shootings. Largely, this response manifested in the form of rigid zerotolerance disciplinary policies focused on deterrence and retribution. However, research reveals the application of these policies produce racial and income-based disparities in how school discipline is administered, which contributes to the school-to-prison pipeline (i.e., a pathway for youth to be funneled out of education and into incarceration). Hospice care is intended to prioritize comfort, dignity, symptom management, and quality of life for individuals with life-limiting illness. However, when hospice-eligible patients are managed within inpatient hospital settings, significant ethical challenges frequently emerge due to the tension between comfort-focused care and the curative, intervention-driven structure of acute care medicine. Black youth may be even more vulnerable than other youth to admitting to crimes they did not commit in the context of police interrogations. In support, analysis of data from the National Registry of Exonerations indicates that 65% of people who were wrongfully convicted on the basis of false confessions they gave when under 18 years old are Black, whereas only 14% of the U.S. population is Black. The conjunction of substance use disorders, mental illnesses, and violence has been shaped through traditional risk-centered models, yet these approaches fail to explain why most individuals do not engage in violent behavior despite being high risk. This study aims to investigate how resilience may buffer the criminogenic effects of comorbidity and help understand the majority of those at risk who remain nonviolent. The data for this study is drawn from the MacArthur Violence Risk Assessment Study, which consisted of 2.255 person-waves, as the data examined comorbidity across 5 waves, consisting of 451 participants in each wave.Each participant in each wave …

The rapid proliferation of incel-related content across digital platforms has raised concerns about online misogyny and its potential impact on women’s perceived safety. However, less is known about how exposure to such content shapes women’s perceptions of risk and emotional responses in everyday digital environments. This study examines the relationship between exposure to incel-related content and women’s perceived risk of gender-based violence and safety-related anxiety. Guided by strain theory, social control theory, hegemonic masculinity, and intersectionality, the study employs an anonymous cross-sectional online survey of women aged 18 and older. This article explores scientific evidence that societies care more about the welfare and safety of females than that of males, and that this dynamic of "male disposability" is deeply entrenched in culture, and thus in law. The recognition and integration of male disposability theory would mean an evolutionary leap in modern theorizing about gender and the law, but it is ignored. Why? Feminist theory dominates current academic gender discourse. Prior scholarship indicates that past victimization and trauma in childhood, known as adverse childhood experiences (ACEs), are highly prevalent among women offenders. This thesis provides a scoping literature review using the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) updated 2020 guidelines. The ebb and flow of social control efforts aimed at LGBTQ people necessitate a thorough investigation into their experiences. This review of the literature is organized around four key themes that characterize LGBTQ people's experiences with crime, criminalization, victimization, and the criminal legal system—including police, courts, and carceral facilities. LGBTQ people experience excessive rates of arrest and incarceration and have higher rates of victimization, which illustrate disproportionality. Their experiences differ from those of their cisgender and heterosexual counterparts and are conditioned by age, race, class, gender, and sexual orientation, illustrating intersectionality. Smirnova further captures the social inequalities of race and class of those encased in this pipeline. Within this understanding of the detriment that the system, medical providers, and society place on those who use substances, Smirnova’s use of interviews allows for a clear understanding of how these systems work in conjunction to uphold the pipeline.

Children who are victims of physical, sexual, emotional, or verbal abuse are nearly always left deeply traumatized by such events. In extreme cases, abused children may be asked to testify against their abuser(s) in legal proceedings, recounting their trauma in front of a room full of strangers. For some, the trauma of abuse may influence a child’s ability to effectively recall and describe their experiences and for others, the process of participating in legal proceedings creates deeper wounds. This research project will be conducted through temporal and spatial analysis of the information gathered from the Akron Police Department. This analysis will identify common factors and patterns throughout the non-fatal shooting cases. This will then follow with in depth research of intelligence led policing articles that provide relevant solutions. Examining the Perceptions of Alcohol Use and Well-Being by Collegiate Baseball Players was a qualitative study conducted through the use of semi-structured interviews. The purpose of the research was to better understand how team culture, relationships, stress, coping mechanisms, and future aspirations influence alcohol use and mental health within collegiate baseball. Data were analyzed using thematic analysis, resulting in several major themes and subthemes related to athlete experiences. Findings revealed that brotherly team culture, including family-like relationships and consistency among teammates, played a major role in shaping emotional well-being and social behaviors. The determination of muzzle-to-target distance remains a significant challenge in forensic casework. Current approaches to gunshot residue (GSR) analysis rely primarily on colorimetric testing to indicate chemical components present and subjective interpretation, limiting specificity and contributing to ongoing scrutiny within the field. This study investigates a quantitative method for estimating shooting distance based on the concentration of lead present in GSR samples (w/w%) with the utilization of inductively coupled plasma optical emission spectrometry (ICP-OES). While DNA profiling of sexual assault evidence can identify biological contributors, determining the tissue source of recovered profiles remains a significant challenge, particularly in cases of suspected oral assault involving mixtures of epithelial cells. The initial goal of this study was to identify non-genetic signatures for differentiating two types of epithelial cells relevant to oral assaults, saliva epithelial cells and epidermal skin cells. To develop tissue-specific signatures, reference cell populations from saliva and epidermal skin surfaces were collected from 20 donors and analyzed using full spectrum flow cytometry.

Distance determination is a practice used in many forensic laboratories to establish possible ranges of distances between the muzzle of a firearm and a target, and stippling is commonly used for this comparison. This thesis examines whether the protections established in Miranda v. Arizona, 384 U.S. 436 (1966), remain robust within contemporary criminal justice practice or have been weakened through doctrinal and practical developments. Miranda warnings were originally designed to mitigate the risk that coercive custodial interrogation would produce compelled or unreliable self-incrimination. Since 1966, however, both judicial interpretation and evolving law-enforcement practices have created a growing gap between Miranda’s formal legal promise and its practical operation in real-world interrogations.

In Nepal, landless populations can broadly be categorized into two groups: urban squatters and rural landless families. Each group can further be distinguished by its level of political connection and access to power.

Among urban squatters, politically connected groups often occupy open public spaces in cities with some degree of protection or tolerance from political parties. In contrast, less powerful urban squatters usually settle on public land because they cannot afford formal housing. “Punishment” is an all-important category in criminal legal thought. Conventional scholarship adopts a narrow definition and focuses on justifying penal sanctions. Much critical work, in contrast, seeks to expand the category—defining more practices and institutions as “punishment.” In this Article, I argue that the focus on purposes of punishment and on what constitutes punishment distracts from a larger theoretical and practical issue—much of what the criminal system does probably isn’t punishment as such.
