Women who are involved in the criminal justice system have unique pathways to criminality. Prevailing themes of dysfunctional and traumatic relationships, addiction, mental illness, poverty, and having limited human and social capital dominate the women’s pathways perspective. A large body of existing research focuses on how these unique risk factors require unique treatment options for women while they are incarcerated in jail or prison settings. My thesis is an argument against the death penalty. Given that public support for the death penalty in America is at a half-century low (according to the Pew Research Center), the timing could not be more appropriate to examine the death penalty. This research project had a two-step approach: first, ethical theory-based arguments for and against the death penalty were examined. Following that ethical theory-based examination, real-world statistics were applied to these theories to test where they stand in modern society. Multiple theories have been proffered to try and explain the Holocaust’s causation, each with varying degrees of acceptance from the Jewish and global communities. Meanwhile dehumanization has been studied however often through the lens of a singular field. Despite the abundance of research on the Holocaust, the subject of perpetrators has had limited exploration as of yet. Approximately 2.7 million children have a parent that is currently incarcerated in the United States. Despite the fact that these children are innocent, they face a myriad of negative consequences due to the separation from their parents. The negative effect of incarceration on children is known as punishment drift. Because the effects of incarceration tend to “drift” onto children, these individuals typically face psychological impacts (e.g., social anxiety and depression), economic impacts (e.g., poverty and food insecurity), and environmental impacts (e.g., foster care) from punishment drift. The notion of law as sacred, and lawyers as righteous saviors, may seem anachronistic in the current context of heavy caseloads and expedited processing in the criminal justice system. Nevertheless, language reflecting these ideals still permeates defense attorneys’ descriptions of their roles, their legal practice, and their relationships to their colleagues and adversaries. We examine this language – specifically, attorneys’ quasi-religious rhetoric – to better understand courtroom dynamics: how attorneys see themselves, their work, their colleagues, and their legal adversaries. In this analysis of semi-structured interviews with 30 defense attorneys, we find that attorneys use of quasi-religious rhetoric manifests as …

One of the most important techniques is DNA analysis which requires viable samples from an individual or crime site. The orofacial region can be a good source for DNA samples because the tissues can resist environmental, thermal, electrical, and mechanical challenges. Teeth are especially useful as a source of genetic material because the DNA located in the pulp is surrounded by protective mineral tissue. The research encompassed a study on the consistency in judicial interpretations and factors that influenced U.S. Supreme Court decisions. To do this, the study explored literature and theoretical perspectives relating to judicial interpretations and decisions. The target population entailed officers in the Office of the Solicitor General for their experience in Court rulings. Interviews were conducted among ten respondents, with data collected, coded, and analyzed. The study results were then presented, discussed, and conclusions derived from them. Generally, the study found serious inconsistencies in interpretations not only between justices but also in almost similar cases. Decisions by justices were conflicting …

Tough-on-crime policies regarding youthful offending have resulted in a pendulum swing in which the juvenile justice system has shifted from a rehabilitative focus to one of punishment. The current paper evaluates different mental health program alternatives, as an option to return to a rehabilitative focus for juveniles, with a major focus on the Juvenile Treatment and Support Court in Kent County, Michigan. Through a qualitative analysis, there were findings of initial success with the youthful offenders presented in the court. Recommendations and limitations from the study are presented to aid further policy change and research.

An Examination Of The Relationship Between Childhood Punishment And Adult Ipv, Anna G. Griffith

Honors College Theses

The goal of this project is to examine the relationship between childhood punishment and experiencing intimate partner violence (IPV) as an adult. Using an anonymous, self-report survey, students from Georgia Southern University were asked about their experiences with IPV, as well as their experiences of childhood punishment administered by both mother and father. The results show that children who receive corporal, verbal, and emotional punishment from their mother are more likely to experience all forms of IPV later in life. When analyzing the same relationships with fathers, corporal punishment is not associated with IPV while verbal and emotional punishment is.

Experiential Learning & Teaching in Higher Education

Experiential learning can be in the form of internships, field trips, service learning, and research projects. The practical nature of criminal justice is a logical fit for experience-based learning. Specifically, academic field trips may be viewed as examples of short-term experiential education. However, do experiential learning trips have an academic impact over time? Using survey data, the current study examines if students acquire and retain knowledge after a prison tour of Eastern State Penitentiary. Pre- and post-tour surveys of student learning outcomes showed a statistically significant gain between the pre- and post-tour survey results. A follow-up survey explored if students …

In Gideon v. Wainwright, the U.S. Supreme Court held that the government must provide a criminal defense lawyer for any accused person who cannot afford one. But for too many people, Gideon's promise remains unfulfilled. In Texas, there are no statewide guidelines about who is entitled to a court-appointed lawyer. Instead, counties create their own rules that create serious gaps in constitutional protection. Getting Gideon Right investigates the financial standards that determine an accused person's eligibility for appointed counsel in Texas county courts. The report reveals a patchwork of county court policies that are both complex and severe.
