The Far-Reaching Shadow Cast By Ferguson, Kimberly Jade Norwood

In the Dred Scott case, Justice Taney remarked that black people “had no rights which the white man was bound to respect.” In The Far-Reaching Shadow Cast by Ferguson, Professor Norwood questions whether, in today’s society, Justice Taney’s sentiment still holds true. Citing examples of recent police shootings and beatings of unarmed African-Americans and personal and family experiences, Professor Norwood argues that our country is broken and needs fixing. Professor Norwood concludes that we are not the ‘post-racial’ society we claim to be and that the Michael Brown shooting, among others, provides a watershed moment to confront our country’s underlying …

The deference regimes of Auer and Seminole Rock give an agency's interpretation of its own regulation "controlling weight unless [the interpretation] is plainly erroneous or inconsistent with the regulation." This doctrine has long been criticized for giving agencies an incentive to promulgate vague regulations. In this essay I critically review these objections to Auer and Seminole Rock against the backdrop of plausible alternative regimes and recent developments in the lower courts.

This article describes a new measure designed to examine the process of implementation of child welfare systems change. The measure was developed to document the status of the interventions and strategies that are being implemented and the drivers that are being installed to achieve sustainable changes in systems. The measure was used in a Children’s Bureau-supported national effort to assess the ongoing implementation of 24 systems-change projects in child welfare jurisdictions across the country. The article describes the process for measure development, method of administration and data collection, and quantitative and qualitative findings.

African American men have been incarcerated at unprecedented rates in the United States over the past 30 years. This study explored how African American females experience adverse psychosocial responses to separation from an incarcerated mate. The purpose of this qualitative grounded theory (GT) study was to construct a theory to explain their responses to separation and loss. Given the paucity of literature on this topic, helping professionals may not understand this problem or know how to support these women. Disenfranchised grief and the dual process model of bereavement were used as a theoretical lens for this study. Data were collected …

While lead exposure during childhood has been linked to criminal activity later in life, prior research has failed to develop a theoretical foundation explaining why lead and crime rates are positively related at the aggregate level. Utilizing tract-level data, I examine the relationship among elevated blood lead level rates, levels of concentrated disadvantage, and crime rates. Through a biosocial approach, I explore the lead-crime relationship using a measure of concentrated disadvantage to account for the variations across tracts. Finally, I discuss the results of this study as well as implications for public policy and future research.

Within the field of criminology, increased attention has been afforded to the influence and importance of individual exposure to violence and victimization. Research has demonstrated that violence – whether actual or anticipated – is not distributed evenly across individuals, but is amplified during the period of adolescence and is strongly influenced by individual risky behavior. Perhaps for no other group has the role of violence been more pronounced than in the lives of gang affiliated youth. Linguistic deception theory provides methods to discover potentially deceptive texts to make them accessible to clerical review. This paper proposes the integration of these linguistic methods with traditional e-discovery techniques to identify deceptive texts within a given author’s larger body of written work, such as their sent email box. First, a set of linguistic features associated with deception are identified and a prototype classifier is constructed to analyze texts and describe the features’ distributions, while avoiding topic-specific features to improve recall of relevant documents. The Siemens S7 protocol is commonly used in SCADA systems for communications between a Human Machine Interface (HMI) and the Programmable Logic Controllers (PLCs). This paper presents a model-based Intrusion Detection Systems (IDS) designed for S7 networks. The approach is based on the key observation that S7 traffic to and from a specific PLC is highly periodic; as a result, each HMI-PLC channel can be modeled using its own unique Deterministic Finite Automaton (DFA). This paper presents a fast multi-stage method for on-line detection of RTP streams and codec identification of transmitted voice or video traffic. The method includes an RTP detector that filters packets based on specific values from UDP and RTP headers. When an RTP stream is successfully detected, codec identification is applied using codec feature sets. The paper shows advantages and limitations of the method and its comparison with other approaches. Attackers tend to use complex techniques such as combining multi-step, multi-stage attack with anti-forensic tools to make it difficult to find incriminating evidence and reconstruct attack scenarios that can stand up to the expected level of evidence admissibility in a court of law. As a solution, we propose to integrate the legal aspects of evidence correlation into a Prolog based reasoner to address the admissibility requirements by creating most probable attack scenarios that satisfy admissibility standards for substantiating evidence. Software tools designed for disk analysis play a critical role today in forensics investigations. However, these digital forensics tools are often difficult to use, usually task specific, and generally require professionally trained users with IT backgrounds. Mobile devices usually provide a “factory-reset” tool to erase user-specific data from the main secondary storage. 9 Apple iPhones, 10 Android devices, and 2 BlackBerry devices were tested in the first systematic evaluation of the effectiveness of factory resets. Tests used the Cellebrite UME-36 Pro with the UFED Physical Analyzer, the Bulk Extractor open-source tool, and our own programs for extracting metadata, classifying file paths, and comparing them between images. Two phones were subjected to more detailed analysis. Results showed that many kinds of data were removed by the resets, but much user-specific configuration data was left. Android devices did …

In 2004, the Trojan horse defense was at a crossroads, having been successfully employed in two child pornography cases in the United Kingdom, resulting in acquittals. Despite the early successes, the Trojan horse defense has failed to become a regularly employed strategy. The original Trojan horse defense has now become part of the more general technical SODDI (Some Other Dude Did It) defense, which includes the possibility of unknown actors using unsecured Wi-Fi connections or having physical access to a computer to perform criminal acts. This paper presents a new development in the forensics of software copyright through a juxtaposed comparison between the proven AFC test and the recent POSAR test, the two forensic procedures for establishing software copyright infringement cases. First, the paper separately overviews the 3-stage, linear sequential AFC test and then the 5-phase, cyclic POSAR test (as AFC’s logical extension). Best practices in digital forensics demand the use of write-blockers when creating forensic images of digital media, and this has been a core tenet of computer forensics training for decades. The practice is so ingrained that the integrity of images created without a write-blocker are immediately suspect. This paper describes a research framework that compares forensic images acquired with and without utilizing write-blockers in order to understand the extent of the differences, if any, in the resultant forensic copies. Bytewise approximate matching is a relatively new area within digital forensics, but its importance is growing quickly as practitioners are looking for fast methods to screen and analyze the increasing amounts of data in forensic investigations. The essential idea is to complement the use of cryptographic hash functions to detect data objects with bytewise identical representation with the capability to find objects with bytewise similarrepresentations.
